SECTION 00 22 00 - SUPPLEMENTARY INSTRUCTIONS
The following have been modified:
EVALUATION CRITERIA
PROPOSAL SUBMISSION REQUIREMENTS AND INSTRUCTIONS
a. REQUIREMENT FOR SEPARATE PRICE AND NON-PRICE PROPOSALS.
(1) Each Offeror must submit both a Price Proposal and a Non Price Factor Proposal. The Price Proposal and the Non Price Factor Proposal must be submitted as separate volumes. Ensure that the outside of each separate volume is clearly marked to indicate its contents; and the identity of the offeror.
Additionally, clearly identify the “original” cost/price proposal and the “original” technical proposal on the outside cover.
(2) Both the Price Proposal and the Non Price Factor Proposal must be received by the closing date and time set for receipt of proposals.
(3) No dollar amounts from the Price Proposal are to be included in the Non Price Factor Proposal.
(4) All information intended to be evaluated as part of the Non Price Factor Proposal must be submitted as part of the Non Price Factor Proposal. Do not merely cross-reference similar material in the Price Proposal, or vice versa. Also, do not include links to websites in lieu of incorporating information into your proposal.
(5) Do not include exceptions to the terms and conditions of the solicitation in either the technical or price proposal. Should the offer include any standard company terms and conditions that conflict with the terms and conditions of the solicitation, the offer may be determined "unacceptable" and thus ineligible for award. Should the offeror have any questions related to specific terms and conditions, these should be resolved prior to submission of the offer. Notwithstanding the above, the Offeror must clearly describe in the Proposal Cover Sheet submitted with the Price Proposal any exceptions to the contractual and/or technical terms and conditions of the solicitation contained in the Offer.
b. DISCUSSIONS. The Government does not intend to enter into discussions in accordance with FAR 52.215-1, Instructions to Offerors—Competitive Acquisitions.
c. COST OR PRICING DATA. Offerors are not required to submit Cost or Pricing Data with their offers.
d. GENERAL INSTRUCTIONS.
(1) Submit only the hard-copy paper documents and the electronic files specifically authorized and/or required elsewhere in this section. Do not submit excess information, to include audio-visual materials, electronic media, etc.
(2) Use only 8 ½ by 11 inch paper for hard copy submissions, unless another paper size is specifically authorized elsewhere in this section for a particular submission. Do not use fold-outs (e.g., 11” x 14” or 11” x 17” sheets) unless specifically authorized in this section for a particular submission. Do not use a font size smaller than 10, an unusual font style such as script, or condensed print for any submission. All page margins must be at least 1 inch wide, but may include headers and footers.
(3) The preferred method for assembling your proposals is to use three-ring binders; however, the use of pressboard or other report covers with compression or other type fasteners is acceptable. Do not use spring clamps or exceed the recommended capacity of the fastener or binder. Do not use plastic multi-hole/spiral binding systems, heat binding systems, or other systems which do not facilitate the ready insertion of additional pages.
(4) “Confidential” projects cannot be submitted to demonstrate capability unless all of the information required for evaluation as specified herein can be provided to the Government as part of the Offeror’s technical proposal. Offerors that include in their proposals information that they do not want disclosed to the public for any purpose, or used by the Government except for evaluation purposes, must be clearly marked in accordance with the instructions at FAR 52.215-1, “Instructions to Offerors— Competitive Acquisition”, paragraph (e), “Restriction on disclosure and use of data”.
(5) In the case of an Offeror that is part of a large, multi-segmented business concern, provide information directly pertaining to the specific segment of the business concern (i.e., the division, group, unit, etc.) that will perform work under the prospective contract.
(6) For submissions with page limitations, the pages will be counted as follows: One side of the paper is one page; information on both the back and front of one sheet of paper will be counted as two pages. Where authorized, fold-out pages (11" x 14" or 11" x 17") will count as one page. (4) Detailed Submission Requirements for the Technical Proposal. The following is a detailed description of the information to be submitted under each TAB.
(i) TAB 1: SUB FACTOR 1.1, RELEVANT CONSTRUCTION EXPERIENCE OF OFFEOR/PRIME: (Definitions for the purposes of this factor):
Relevant construction project means a construction project located on an active United States military installation (located within the continental United States, Alaska, Hawaii, or United States territory) that is capable of offloading, transferring, storing, and delivering aviation fuel, constructed for the purpose of fueling aircraft.
Substantially completed means at a minimum turned over for beneficial occupancy in its entirety (not partially turned over).
Key Subcontractor means a subcontractor who at a minimum directly performed all the major or critical aspects of a relevant construction project. Major or critical aspects are the facilities or systems for offloading, transferring, storing, and delivering aviation fuel.
The Offeror shall submit a minimum of two (2) and no more than four (4) examples of relevant construction projects on which the Offeror performed either as the prime contractor or as a Key Subcontractor (how the Offeror performed must be clearly indicated).
a) The Offeror may also submit projects where its Key Subcontractor performed either as the prime contractor or as a Key Subcontractor (how the Key Subcontractor performed must be clearly indicated); however, at least one of the total number of submitted projects must have been performed by the Offeror (i.e., all projects submitted cannot have all been performed by the Key Subcontractor). If any project submitted is that of a Key Subcontractor, it must be accompanied by a signed Letter of Commitment from that Key Subcontractor committing them as a member of the team for this project.
b) The submitted projects shall either be 100% construction progress complete or substantially complete within six (6) ten (10) years from the date of issuance of this solicitation.
At least one project example shall include all elements of the following four phases of airfield fueling: [1] offload, [2] transfer (systems of pumps, filters and pipes), [3] aviation fuel storage, and [4] fuel delivery to equipment that incorporates refueler truck fill stands or otherwise complies with the direct aircraft fueling systems criteria for Type III, IV, or V hydrant fueling systems as specified in the Unified Facilities Criteria (UFC) 3-460-01. The construction contract for this project example shall be a minimum of $10 million in magnitude.
All other project examples shall include at a minimum two (2) elements of the following four (4) phases of airfield fueling, but may include multiple or all phases: [1] offload, [2] transfer (systems of pumps, filters and pipes), [3] aviation fuel storage, or [4] fuel delivery to equipment that incorporates refueler truck fillstands or otherwise complies with the direct aircraft fueling systems criteria for Type III, IV, or V hydrant fueling systems as specified in the Unified Facilities Criteria (UFC) 3-460-01. The construction contract for these project examples shall be a minimum of $7 $5 million in magnitude.
Using a Relevant Experience Matrix similar to that shown below in Table 3, clearly identify to which phase of airfield fueling each project example submitted pertains.

Note: Table 3 above is an example. All projects submitted must meet all applicable requirements.
The Offeror shall also submit an explanation briefly justifying each designation in the Relevant Experience Matrix for each submitted example project. This explanation shall not exceed four (4) 8.5” x 11” double-sided pages or eight (8) 8.5” x 11” single-sided pages, regardless of the total number of projects submitted.
a) For each project submitted where work was performed as a Key Subcontractor as opposed to a prime contractor, the Offeror shall submit an additional, separate statement that includes the total contract amount, the dollar amount of the work performed as the Key Subcontractor, a description of the elements of work specifically completed by the Offeror (or the Offeror’s Key Subcontractor) while working as a Key Subcontractor, and the percentage of work performed as the Key Subcontractor of the overall project work. The statement shall also justify how the Offeror (or the Offeror’s Key Subcontractor) meets the definition of “Key Subcontractor” in the context of the example project(s) submitted. The statement shall not exceed two (2) 8.5” x 11” double-sided pages or four (4) 8.5” x 11” single-sided pages. If it is determined by the Government that based on the information provided by the Offeror that it does not in fact meet the definition of a Key Subcontractor, the project will not be considered for evaluation.
If the Offeror submits more than four (4) project examples, the Government will only evaluate the first four (4) submitted projects.
Evaluation Method for this Sub Factor:
Factor A will be evaluated to determine whether the Offeror’s submission meets the requirements of this factor. If any of the required information is not provided in the Offeror’s proposal or fails to meet the requirements, the Offeror will be evaluated as “Unacceptable.”

Unacceptable The narrative and schedule do not clearly demonstrate a complete understanding of the requirements of the project.
(iii) TAB 2: SUB FACTOR 2.1, PAST PERFORMANCE: The project examples submitted for Sub Factor 1.1 will be used for evaluation of Past Performance of the Offeror (or Affiliate), as well as any other past performance information that the Government may independently obtain.
Past Performance References: For the projects submitted, the government will query the Contractor Performance Assessment Reporting System (CPARS) to validate past performance ratings. For each project that does not have a final CPARS evaluation, Offerors shall provide a NAVFAC/USACE Past Performance Questionnaire (Form PPQ-0) to the point of contact, clearly identifying the project to be evaluated. A NAVFAC/USACE Past Performance Questionnaire (Form PPQ-0) is included at the end of the RFP as Attachment 2. When completed, these forms shall be mailed, faxed or emailed to the Little Rock District Contract Specialist identified in the RFP. It is the contractor’s responsibility to ensure that the reference documentation is provided as the Government may not make additional requests for past performance information from the references.
Offerors submitting responses shall present a list of reference contacts that were mailed a past performance questionnaire to complete. The Offeror shall briefly discuss its past performance on each project identified above in order to explain any ratings that may impact its overall rating for this factor (positively or negatively).
The Government will assess the degree of success of the Offeror’s past performance in recent relevant projects. Owners/references will be asked to comment on items such as quality of construction, timeliness, management of subcontractor work, including timely payment to subs or suppliers, safety, relations between owner and designer or contractor, level of support for such items or tasks as as-built documentation, O&M manuals, training, correcting construction errors, warranty work, etc. The Government will target areas identified in the requirements of this solicitation including records conforming to quality, schedule, cost control, customer satisfaction, and level of support for such things as as-built documentation, O&M manuals, training, and problem resolution for construction errors, warranty work, and safety
Other Sources: The Government may contact sources other than those provided by the Offeror for information with respect to past performance on projects completed, or at least 50% complete.
These other sources may include, but are not limited to CPARS, telephone interviews with organizations familiar with the Offeror’s performance, and Government personnel with personal knowledge of the Offeror’s performance capability. The Government may be unable to obtain any qualitative information under subcontracts due to the Government’s lack of privity with subcontractors. Unless otherwise requested by the subcontractor, adverse subcontractor performance information will be provided to the Offeror if discussions are held and/or during a requested debriefing.
Evaluation Method for this Sub Factor:
The Government will evaluate an Offeror’s past performance based on a demonstrated record of performance in accordance with FAR 15.305(a)(2). Past performance information is an indicator of an Offeror’s ability to perform the contract successfully.
The Government will evaluate the successful completion of all project examples for the past six
(6) years. The Government reserves the right to check any or all cited references to verify supplied information and to assess owner satisfaction.
The Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System (CPARS). This information may involve the Offeror’s Affiliate if an Affiliate’s project is submitted for Factor A.
While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.
TABLE 5: FACTOR B – PAST PERFORMANCE OF OFFEROR EVALUATION RATING
Rating: Description:
Acceptable
Based on the Offeror’s (or Affiliate’s) past performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown.

ADJECTIVE RATINGS AND DEFINITIONS TO BE USED TO BEST REFLECT
YOUR EVALUATION OF THE CONTRACTOR’S PERFORMANCE
RATING DEFINITION NOTE
(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.
An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating. Also, there should have been NO significant weaknesses identified.
(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.
A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.
(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.
A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract. There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.
(M) Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.
A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.
(U) Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.
An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.
