BASIS OF AWARD

A. General.

(1) This solicitation is an unrestricted competitive acquisition using Lowest Price Technically Acceptable (LPTA) source selection process for the award of a firm fixed-price contract. Award will be made on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptable standards for non-cost factors. This acquisition will utilize FAR Part 15 LPTA source selection procedures, leading to selection of the proposal representing the best value to the Government.

(2) Offerors shall submit a technical proposal, and a price proposal. The evaluation results of the non-price and price proposals will determine an awardee. In order to be considered awardable, the offeror’s proposal must receive an “acceptable” rating in every non-price factors.

(3) The Government intends to make an award without discussions, but reserves the right to conduct discussions should discussions prove to be necessary or advantageous to the Government. Because the Government does not intend to hold discussions Offerors are encouraged to include their best pricing in their initial proposal.

(4) All proposals received will stand alone and be considered complete and final. The evaluation board will not consider any information or data incorporated by reference or otherwise referred to. The successful Offeror will be selected solely on the basis of the evaluation factors set forth below. Accordingly, proposals submitted in response to this solicitation should provide clear, complete, concise, and straightforward responses to the evaluation factors. Elaborate proposals, color brochures, and other excesses are discouraged.

EVALUATION FACTORS

Volume I – Technical (Non-Price) Submission Requirements and Evaluation Method:

FACTOR 1 (TAB 1) – Experience

Submission Requirements:

The Offeror shall submit information for up to two projects that demonstrates the offeror’s experience installing and/or modifying adult/juvenile fish collection facilities , fish hatchery facilities, and/or wastewater treatment facilities. Information submitted for each project must include the information outlined in Attachment B, Offeror’s Experience Form.

To be evaluated, projects must have been completed or must be substantially complete within five years of the date that proposals are due and be projects valued over $5,000,000.00. Substantially complete is defined as being 75% complete by the date that proposals are due. If an offeror submits a project that it represents is “substantially complete,” the offeror must reasonably explain why the project is considered at least 75% complete. If an offeror submits an ongoing project without providing an accompanying reasonable explanation that explains how the project is at least 75% complete, the Government reserves the right to reject the project.

A maximum of two projects will be evaluated. If an offeror disregards these instructions and submits more than two projects, only the first two projects will be evaluated. Offerors should describe each project with enough detail to ensure that the Government can meaningfully assess whether the projects submitted meet the minimum evaluation criteria outlined below.

Note: The Government may consider experience information regarding predecessor companies, key personnel who have relevant experience or subcontractors that will perform major or critical aspects of the requirement.

Evaluation criteria: Experience will be rated on an “acceptable” or “unacceptable” basis.

Acceptable: To be determined “acceptable,” the offeror’s proposal must demonstrate that the offeror has experience installing and/or modifying an adult/juvenile fish collection facility, fish hatchery facilities, and/or waste water treatment facility valued over $5,000,000. The offeror’s proposal must also demonstrate that the offeror has performed civil, structural, mechanical, and electrical work at an adult/juvenile fish collection facility, fish hatchery facilities, and/or waste water treatment facility valued over $5,000,000. To be determined acceptable under this factor, each project submitted does not need to demonstrate all functional categories (civil, structural, mechanical, and electrical work) for each individual project. Rather, to be acceptable an offeror must submit a proposal that includes up to two projects that collectively demonstrate the offeror’s experience with all four discrete categories of work: civil, structural, mechanical, and electrical.

Unacceptable: The offeror’s proposal fails to demonstrate experience installing and/or modifying an adult/juvenile fish collection facility, fish hatchery facilities, and/or waste water treatment facility valued over $5,000,000. The offeror’s proposal fails to demonstrate experience performing civil, structural, mechanical, and electrical work at an adult/juvenile fish collection facility, fish hatchery facilities, and/or waste water treatment facility valued over $5,000,000.

Table 1. TECHNICAL Acceptable/Unacceptable RATINGS

RATING DESCRIPTION

Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

FACTOR 2 (TAB 2) – Past Performance

Submission Requirements:

The offeror shall provide past performance information for each project listed by the offeror under Factor 1, Experience. Recent and relevant projects are those projects completed or substantially completed** within five years of the date that proposals are due that are valued over $5,000,000 and that are similar in scope and complexity to the work in this requirement.

** Substantially completed is defined as having completed more than 75% of the project work at the time proposals are due.

If a completed Contractor Performance Assessment Reporting System (CPARS) evaluation is available, it shall be submitted with the proposal. Do not submit a PPQ when a completed CPARS is available.

Completed PPQs should be submitted with your proposal if a CPARS is not available. If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ (Attachment A), which will provide contract and client information for the respective project(s). Offerors should follow-up with clients/references to ensure timely submittal of questionnaires. If the client requests, questionnaires may be submitted directly to the Government's point of contact, Michael I. Grasso, via email at Michael.I.Grasso@usace.army.milprior to proposal closing date. The offerors shall instruct the clients to refer to the solicitation number in the subject line. The PPQs are Source Selection materials. All successfully submitted PPQs will receive an e-mail confirmation upon receipt. If the offeror does not receive the confirmation, it is their responsibility to follow up to ensure the government has received the information.

Offerors shall not incorporate by reference into their proposal PPQs or CPARS previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted past performance information in the past performance evaluation.

Offerors may provide explanation on problems encountered on past projects and the corrective actions taken by the offeror.

In addition to the above, the Government may review other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the PPIRS, including Contractor Performance Assessment Reporting System (CPARS), using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal, inquiries of owner representative(s),FAPIIS, telephone interviews with organizations familiar with the offeror’s performance, Government personnel with personal knowledge of the offeror’s performance capability, and any other known sources not provided by the offeror.

While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.

Evaluation Method:

The past performance evaluation results is an assessment of the offeror’s probability of meeting the minimum past performance solicitation requirements. This assessment is based on the offeror’s record of relevant and recent past performance information that pertain to the project outlined in the solicitation requirements.

There are two aspects to the past performance evaluation. The first is to evaluate whether the offeror’s present/past performance is relevant or not relevant to the project.

The second aspect of the past performance evaluation is to determine how well the contractor performed on the contracts. The Government will evaluate the offeror’s past performance to ensure previous work performance satisfactorily met the contract requirements, performance schedules, prescribed quality of work, safety requirements, and other customer expectations on these projects.

The Government reserves the right to obtain or verify offeror’s past performance information from references and other sources available to the Government.

Past performance under Factor 2 shall be evaluated using the following rating of an “acceptable” or “unacceptable” basis using the ratings stated in Table 2:

Table 2. PAST PERFORMANCE EVALUATION RATINGS

RATING DESCRIPTION

Acceptable Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown. (See note below.)

Unacceptable Based on the Offeror’s performance record, the Government has no reasonable expectation that the Offeror will be able to successfully perform the required effort.

Note: In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”

FACTOR 3- Work Plan

Submission Requirements:

The Offeror shall submit a work plan explaining the offeror’s technical approach for completing the project in accordance with the specifications outlined in this solicitation. The plan shall include a detailed narrative that addresses the procedures proposed for the successful completion of the following major features of work:

1. Modifications to existing fish facility

2. Fish Ladder Extension

3. Pre-sort pool

4. Sorting area

5. Post sort pools with underneath truck loading

6. Fish return to river pipe

7. Water supply and discharge piping

8. Building and shade structures.

9. Electrical improvements

10. Civil site improvements

11. Spray in place pipe lining

12. Commissioning

The work plan shall also include the offeror’s schedule, in Gantt chart format, for completing the work within the proscribed timeframes described in the solicitation requirements. At a minimum, the schedule shall include the following:

1. Critical path,

2. Contractual milestones described in 52.211-10,

3. Fish facility shutdown periods,

4. In-water work periods,

5. Pre-construction submittals,

6. Mobilization,

7. Major features of work as described in the Project Background and Objectives,

8. Demobilization, and

9. Closeout submittals.

Evaluation Method: The Work Plan will be rated on an “acceptable” or “unacceptable” basis.

Acceptable: To be determined “acceptable,” the offeror’s proposed work plan must include the offeror’s plan for completing each feature of work outlined in the submission requirements above and demonstrate a feasible plan for completing the work in accordance with the requirements outlined in the solicitation specifications. The offeror’s work plan must also include a Gantt chart that includes a feasible schedule for completing the work items outlined in the submission requirements above, and within the timeframes described in the solicitation specifications.

Unacceptable: The offeror’s proposed work plan fails to include all of the features of work included in the submission requirements. The offeror’s proposed work plan is not feasible or fails to demonstrate the ability to complete the work in accordance with the requirements of the solicitation. The offeror’s plan fails to include a schedule in Gantt chart format addressing each of the work items contained in the submission requirements. The offeror’s proposed schedule demonstrates an inability to complete the work within the timeframes described in the solicitation specifications or inability to feasibly complete the work on time.

Table 1. TECHNICAL Acceptable/Unacceptable RATINGS

RATING DESCRIPTION

Acceptable The proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

Volume II - Price.

Price Evaluation

Award will be made on the basis of the lowest evaluated price (sum of all CLINs) of proposals meeting or exceeding the acceptability standards for non-cost factors.

The Price Proposal will be evaluated to determine fairness and reasonableness. For evaluation purposes, the total evaluated price will be calculated by adding the total price for all optional items to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the options.

The Government may determine that a proposal is unacceptable if the prices proposed are materially unbalanced between line items or subline items. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.

SUBMISSION OF PROPOSALS AND EVALUATION

A. Administrative Details and General Instructions: Proposals are due no later than the time and date specified in Block 13 of Standard Form 1442.

(1) General Proposal Format: Submit each copy of the proposal in tabbed, 3-ring binders with a “D” ring or locking closures.

Title Page. Each copy must include the Offeror’s name and address, phone number and email address, title of the solicitation, solicitation number and date of submittal clearly identified on the front cover of the binder.

Table of Contents. Each binder of the proposal shall contain a detailed table of contents. The complete table of contents shall be included in each binder.

Printed Matter Submissions. Pages containing text are expected to be 8 ½ x 11 inches with at least one-inch margins at the top, bottom, and both sides. Paragraphs should be separated by at least one blank line. A standard 11-point font in either Arial or Times New Roman is preferred.

Organization charts or schedules. A folded 11” x 17” format may be used. Larger format drawings or tables may be added by folding them to fit within the binder.

All information must be confined to the appropriate volume. If the materials do not fit within a single volume, they should be separated in additional binders, but clearly identified as such. Each volume of the proposal is expected to contain a table of contents, summary section with a brief abstract of the volume, and the narrative discussion.

THE OFFEROR SHALL SUBMIT AN ELECTRONIC VERSION OF EACH PROPOSAL. The electronic version shall be on a readable CD. Any discrepancies between the electronic and paper copies shall give precedence to the paper copy.

(2) Proposal Content Limitations.

The Offeror must confine the proposal to relevant information and documentation sufficient to provide an adequate basis for evaluation. Offerors are responsible for including sufficient details, in a concise manner, to permit a complete and accurate evaluation of the proposal. The page count is at the discretion of the Offeror, however the proposal may not be more than 50 pages total.

The evaluation panel for the Government is instructed to evaluate the non-price proposal factors on the basis of the information provided. Extraneous information provided in the proposals will not be considered in the evaluations; therefore, the Offeror should only provide information that satisfies the solicitation requirements. Merely restating the specifications without sufficient elaboration demonstrates a lack of understanding of the requirement.

DO NOT cross reference past performance information. It is acceptable to repeat data, project information or experience in more than one non-price area as long as it satisfies the requirements of the factor.

Proprietary information must be clearly marked.

B. Content of Proposals: All proposals must be prepared in two volumes: A technical proposal (Volume I), a price proposal (Volume II). Each of the volumes shall be separate and complete in itself so that evaluation of one may be accomplished independently from evaluation of the other. The technical proposal (Volume I) must not contain reference to price. The narrative and content structure of the proposal shall follow the format shown under Volume I below. Offerors who fail to submit a complete proposal may be excluded and thus receive no further consideration for award.

(1) Technical Proposal, Volume I: Provide one (1) original and three (3) copies and one (1) pdf. file on a CD-ROM. Volume I shall consist of information for the three (3) factors, listed in tabular form, as noted below. Repeating or restating the specifications without sufficient elaboration will be determined to show a lack of understanding of the requirement.

Volume I – Technical (Non-Price) Factors and Sub-factors:

Tab 1 - Factor 1 - Experience

Tab 2 - Factor 2 – Past Performance

Tab 3 - Factor 3 – Work Plan

Volume II – Price Proposal:

Price Proposal, Volume II: The Price Proposal shall be complete, detailed and submitted on forms provided in the Request for Proposal (RFP) (one (1) original and one (1) pdf. file on a CD-ROM).

Offeror shall provide pricing and complete all line items on Standard Form 1442 (SF 1442).

Volume II - Price. Offeror’s price proposal must be prepared in accordance with below paragraphs and must include:

Tab 1 - SF1442, Solicitation, Offer, and Award.

The SF1442 shall be filled out completely by the Offeror and signed by an official that is authorized to bind the company. The Offeror shall also acknowledge all amendments to the solicitation in accordance with the instructions on the Standard Form 30 or Block 19 of SF1442.

Tab 2 – Section 00010, Proposal Price / Bid Schedule.

The Offeror shall fully complete this section.

Tab 3 - Representations, Certifications and other Statements of Offerors.

The Offeror shall complete all representations and certifications in Section 00600 and also ensure current registration and completed/updated Annual Representations and Certifications on the System for Award Management (SAM) website, www.sam.gov.

Tab 4 – Banking and Bonding point of contacts.

The Government is required to determine Contractor’s responsibility; the Offeror shall provide contact information (Company name, point of contact, address, email, and phone number) for the offeror’s bank and bonding institutions.

Tab 5 - Bid/Offer Guarantee. The Bid Bond shall be at least 20% of the bid price, but shall not exceed $3million.

Tab 6 - Subcontracting Plan. Other than U.S. Small Business offerors must also submit a subcontracting plan meeting the requirements of FAR 52.219-9 and DFARS 252.219-7003 (or DFARS 252.219-7004 if the offeror has a comprehensive subcontracting plan) contained in Section 00700 of the Contract Clauses. Other than U.S. Small Businesses must submit acceptable subcontracting plans to be eligible for award. Subcontracting Plans shall reflect and be consistent with the commitments offered in the Small Business Participation Plan.

Large Businesses shall provide a completed Subcontracting Plan and most recent annual subcontracting report. A model subcontracting plan is included as an appendix to this solicitation. For information on the evaluation of subcontracting plans, see Army Federal Acquisition Regulation Supplement, Appendix DD. See Attachment C for the template.

1.4 SCHEDULE FOR CONSTRUCTION

In accordance with Section 00700 Contract Clause 52.236-15, SCHEDULES FOR CONSTRUCTION CONTRACTS, submit a detailed schedule for accomplishing the work in this Contract (per Section 01 32 01.00 25, PROJECT SCHEDULE). The schedule will not be used by the Government to select a Contractor; rather it will be used to ensure that the Contractor is capable of accomplishing the necessary work in the allotted time periods. The schedule must be consistent with the completion dates as specified in Section 00800 Contract Clause 52.211-10, COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK. Other Contractor's work must also be coordinated in accordance with Contract Clause 52.236-8, OTHER CONTRACTS.

1.5 INTERIM CONSTRUCTION COMPLETION DATES

All Contract requirements must be complete by the completion date as specified in Section 00800 Contract Clause 52.211-10, COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK. Refer to Section 01 11 00.00 25, SUMMARY OF WORK for interim construction completion dates.

1.6 PERMITS AND RESPONSIBILITIES

Obtain all permits and licenses for the work as required under Section 00700 Contract Clause 52.236-7, PERMITS AND RESPONSIBILITIES (Nov 1991).

1.7 TIME LAPSE CAMERA

Provide a time-lapse video and selection of still images documenting the construction process on the subject Contract. Document all work performed in and around the pre-sort pool, post-sort pool, and fish sorting building by coordinating with the on-site GQAR to position one camera on USACE property. See attachment A11 for a screen shot of the 3-D model showing

SECTION 01 10 10.00 25 Page 4 the desired view. The camera must be operational 5 days prior to commencing on site work. Pictures must be taken every 15 minutes and uploaded to an internet based site daily. USACE personnel must have access to the pictures on the internet based site. Use the resulting images to create at least one video approximately 20 minutes in length.

Provide the finished video(s) in DVD and Windows Media File formats.

Coordinate with the CO and Project Engineer for an example of the desired finished videos. Provide a representative selection of approximately 100 print-quality (8- by 10-inch, 300 dpi. .jpg or .tif format) digital images spanning the Contract work period. The Government will own the rights to all digital files used in the creation of the video(s).

1.8 WORK ON THE EXISTING FACILITY

1.8.1 Fish Facility Shutdown (FFS) Periods

The Government has established periods, described as "fish facility shutdown periods", coinciding with the annual cycles of fish migration and related allowed maintenance periods. In general, this is a work period that allows for work in the existing fish collection facility. The FFS periods established for this Contract are: 1 November 2016 through 28 February 2017, and 1 October 2017 through 28 February 2018. All work must be completed during the dates indicated in Section 00800, Contract Clause, 52.211-10, COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984).

1.8.2 Fish Facility Shutdown Activities

For purposes of this Contract, all work in the existing fish ladder and supporting facilities must be restricted to the FFS period, along with further work restrictions.

1.8.3 Interim Fish Collection

During the execution of this Contract, the USACE will be collecting adult fish at Fall Creek Dam by using the existing fish ladder. USACE will be collecting fish from NTP to 31 October 2016 and from 1 March 2017 to 31 October 2017. USACE will require access to the existing fish collection facility during interim fish collection. After the first FFS period from 1 November 2016 to 28 February 2017, the existing fish ladder must be turned over to USACE in a condition that allows fish collection. Submit an Interim Fish Collection Plan describing the work planned for each FFS to confirm that the work planned for the first FFS period does not put interim fish collection at risk. The Contractor is encouraged to complete as much work as possible during the first FFS period to mitigate schedule risk during the second FFS period. Work items that shall be restricted to the second FFS period from 1 November 2017 to 28 February 2018, are described below but are not limited to:

a. Demolition and construction of weirs.

b. Demolition of the pre-sort pool crowder.

c. Demolition of the hopper and hopper structure.

d. Saw cutting and core drilling in the existing ladder.

e. Removing gates and blocking the opening.

SECTION 01 10 10.00 25 Page 5

f. Raising the concrete floor.

g. Raising wall screens.

1.9 IN-WATER WORK

1.9.1 In-Water Work (IWW) Periods

The Government has established periods, described as "in-water work periods," coinciding with the annual cycles of fish migration and related allowed maintenance periods. In general, this is a work period that allows for work in the water, on the water, and adjacent to the water where the work might affect fish passage. The IWW period established for this Contract is: July 1, 2016 to August 31, 2016 and July 1, 2017 to August 31, 2017.

1.9.2 In-Water Work Activities

For purposes of this Contract, work items that shall be restricted to the IWW period, along with further work restrictions, are described below:

a. All work involving barges or other floating plants.

b. All work involving cofferdam installation and removal.

c. All work in an active stream bed.

1.9.3 Fall Creek Hydrology

For information on reservoir operations, forebay elevations, and tailwater elevations see Attachment A7.

1.9.4 Tailrace Cofferdam

A cofferdam may be required at the fish ladder entrance to install a new entrance gate. Submit a Cofferdam Plan for Government approval prior to starting any cofferdam work. Installing a cofferdam at the fish ladder entrance and installing a new entrance gate can only be completed during a FFS period and will not be considered IWW.

1.10 INCLEMENT WEATHER CONSTRUCTION

The Contractor's schedule must reflect adverse weather days in all weather dependent activities as defined in Contract Clause 52.236-4, PHYSICAL DATA. Protect work areas from inclement weather, wind damage, and precipitation so that no delay in the prosecution of critical work items, or damage to USACE property occurs. No time extensions will be authorized for materials, work in place, or equipment damaged due to negligence during periods of inclement weather.

1.11 UTILITY OUTAGE REQUEST AND UTILITY CONNECTION REQUEST

a. Notify the Contracting Officer (CO) at least 48 hours prior to starting excavation work. Verify and mark all utilities not shown.

SECTION 01 10 10.00 25 Page 6 installing new work closer than nearest manhole or other structure at which an adjustment in grade can be made.

c. Schedule work to hold outages to a minimum.

d. Requests for utility outages and connections must be made in writing to the CO at least 14 calendar days in advance of the time required.

Each request must include the system involved, location involved, utilities being affected, approximate duration of outage, and the nature of work involved.

1.12 WORK BY THE GOVERNMENT CONCURRENT WITH CONTRACTOR WORK

The Government will limit interference with the Contractor's work to the maximum reasonable extent and the Government and Contractor shall coordinate as necessary.

1.13 WEEKLY COORDINATION MEETINGS

Weekly coordination meetings must be held between the Contractor and the Government. This meeting will be used to discuss Contractor's safety, Quality Control Program, submittals, deficiencies, Contract administration, schedule, actual progress in the last week, and work planned in the upcoming two weeks. Any work requiring Project support or potential impacts to Project operations or maintenance must be noted. During the Preconstruction Meeting, the Government will determine responsibility of running this meeting. If the Government elects to run the coordination meeting, the Contractor must provide a two week look ahead, with the previous week as-builts, 48 hours before each weekly meeting to the Government representative. The responsible party must prepare and distribute, by e-mail, the coordination meeting agenda with a two week look ahead no later than 24 hours before each meeting. A meeting time and place will be mutually agreed upon for the same time each week. Coordination meeting notes with changes to be distributed no later than the close of business the first workday following the weekly meeting if the meeting.

1.14 PARTNERING

The Government intends to encourage the foundation of a cohesive partnership with the Contractor and its subcontractors. This partnership will be structured to draw on the strengths of each organization to identify and achieve reciprocal goals. Among the objectives are effective and efficient Contract performances and are intended to achieve completion within budget, on schedule, and in accordance with the plans and specifications; and to develop a single cooperative management team focused on the success of the project to mutual benefit of all stakeholders. This partnership will be bilateral in makeup, and participation will be totally voluntary. Any cost associated with effectuating this partnership will be agreed to by both parties, and will be shared equally with no change to the Contract price. An integral aspect of partnering is the resolution of disputes in a timely, professional, and non-adversarial manner through the use of issue clarification and problem solving. Alternate Dispute Resolution (ADR) methodologies will be encouraged in place of the more formal dispute resolution procedures. ADR will assist in promoting and maintaining an amicable working relationship to preserve the partnership.

ADR is a voluntary, non-binding procedure available for use by the parties to this Contract to resolve any dispute that may arise during performance.

SECTION 01 10 10.00 25 Page 7

1.15 CONTRACTOR EMPLOYEES

Ensure that all employees are capable of demonstrating adequate knowledge of tools, supplies, equipment, and techniques necessary to competently perform the work. All personnel employed by the Contractor must be fully qualified in their respective fields to render the services necessary. The Government may require the Contractor to discontinue using any employee in the performance of the work specified in this Contract determined by the Government to be unsatisfactory. Contractor employees will not be permitted to bring guests, family members, or non-employees to the job site at any time.

1.16 ACCESS AGREEMENTS AND WORK AREAS

1.16.1 Access Agreements

a. Submit access procedures to and from the work site after the Contractor, the Contract Officer, and the Project's Representative have coordinated and determined the most advantageous access to, and staging of, the Contractor's assets deployed to the work site.

b. The right-of-way for the work (or delivery site) and access thereto will be furnished as stated in this paragraph subject to mutual agreement between the Contractor and the Government concerning the specific route the Contractor is to use. Such mutual agreement shall be reached prior to initiation, construction, or delivery.

c. The existing access roadway and any associated access roads on the Project, shall not be closed as a result of construction or delivery activities associated with this Contract unless previously coordinated and approved by the Government. Traffic delays will only be permitted in accordance with the provisions of this Section.

When directed at any time during the progress of the work when space is needed within the right-of-way for other purposes, any part of the grounds that have been in use must be promptly vacated and cleaned up. However, it is not the intent to require the Contractor's plant or material to be removed from an area while such plant, material, or area is still being actively used.

d. The Project staff will brief the Contractor on security procedures.

Any such procedures will not be the basis for claims for additional money or time. The Project areas off limits to Contractor personnel will also be designated.

e. Salespersons or personnel seeking employment will not be permitted inside the Project security fences without prior Government approval.

1.16.3 Employee Access and Parking
