g. What counts as a page? A page shall be an 8 ½ X 11” sheet of paper. When both sides of a sheet display printed material, it shall be counted as two pages. m. Electronic Copies (CD ROM). All electronic copies of volumes shall be submitted on one (1) CD-ROM disk with a separate file for each volume. The electronic copies of the proposal will be an exact duplicate of the “original” paper proposal. The Government will not perform a word-by-word check of the “original”

vs. the electronic copies. However, if discrepancies are identified between the electronic copies and the “original” paper proposal, the offeror bears the risk that the Government’s evaluation may use either version. Sound or video (e.g. MPEG) files should not be embedded into the proposal files. The CD-ROM and protective sleeve will be clearly marked as to volume number, Offeror's name, solicitation title, solicitation number, and marked as “Initial” or “Revision X,” with “X” indicating the number of the revision. Elaborate CD-ROM disk labels are not required or desired.

4. Proposal Content.

a. Volume I – General. Volume I – RFP Documents. Offerors are required to submit a completed SF 1449 (including acknowledgment of all Amendments) and Addendum to FAR Provision 52.212-1. Failure to follow the below Contract Proposal preparation instructions may cause your proposal to be deemed unacceptable by the Government. Volume I will be organized as follows and contain the identified information

i. TAB A, Executive Summary. Provide an executive summary that introduces the contractor team and proposal submission, to include a list of team members and subcontractors and the task areas they are designated to provide support. The executive summary shall also include a list of the proposal package contents.

TAB B, Solicitation, Offer and Award. The SF 1449 will be submitted fully completed. The offeror is cautioned that the SF 1449 must contain an original signature in block 30a of the form. The contractor will acknowledge all amendments to the RFP in accordance with the instructions on the SF 1449 and with

Addendum to FAR 52.212-1, Instruction to Offerors Commercial Items. The offeror shall provide the name, title and telephone number of the company/division point of contact regarding decisions made with respect to your proposal and who can obligate your company contractually. Also, identify those individuals authorized to negotiate with the Government.

TAB C, Section B (Services and Prices) - Section SF 1449 - CONTINUATION SHEET shall be submitted fully completed and error free. It shall contain the offeror’s prices for the established Contract Line Items Numbers (CLINS).

TAB D, FAR 52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS COMMERCIAL

ITEMS, (Oct 2018) (Representation, Certifications, and Other Statements of Offerors) – The offeror shall ensure that all identified certs and reps clauses are submitted thoroughly completed with all blocks in each certification/representation completed truthfully and completely. Offeror Representations and Certifications that SAMS registration verification can be submitted in lieu of completing 52.212-3.

b. Volume II – Technical Volume. The Technical Volume shall be clear, concise, and include sufficient detail for effective evaluation and for substantiating the validity of stated claims in the Offeror’s proposal.

Legibility, clarity and coherence are very important. Your responses will be evaluated against the Technical factors defined in Addendum to FAR Clause 52.212-2, Evaluation – Commercial Items. The Offeror should address, as specifically as possible, the actual methodology used for accomplishing the PWS tasks. The proposal should not simply rephrase or restate the Government's requirements, but rather should provide convincing rationale to address how the Offeror intends to meet these requirements. Statements that the Offeror understands, can, or will comply with the PWS (including referenced publications, technical data, etc.); statements paraphrasing the PWS or parts thereof (including applicable publications, technical data, etc.); and phrases such as “standard procedures will be employed” or “well known techniques will be used,” etc., will raise questions regarding an Offeror’s technical ability to perform the services contained herein and may be grounds to eliminate the proposal from further consideration for contract award.

Offerors should assume that the Government has no prior knowledge of their facilities and experience, and that it will base its evaluation on the information presented in the Offeror’s proposal. Elaborate brochures or documentation, binding, detailed art work, or other embellishments are unnecessary and are not desired.

Submission of resumes are not required.

The Technical Volume shall, at a minimum, be prepared in a form consistent with the Performance Work Statement (PWS) (Annex A and Annex E) and the evaluation criteria for award set forth in Addendum of FAR Clause 52.212-2, Evaluation – Commercial Items, of this solicitation. The section shall be prepared in an orderly format and in sufficient detail to enable the Government to make a thorough evaluation of the contractor’s technical competence and ability to comply with the contract task requirements specified in the PWS. The offeror shall address as specifically as possible the actual methodology to be used for accomplishing the PWS tasks. The volume shall be organized according to the following general outline.

SECTION M - EVALUATION FACTORS FOR AWARD

The following have been modified:

ADDENDUM TO FAR 52.212-2

A. BASIS FOR AWARD

A Lowest Price Technically Acceptable (LPTA) approach will be used; the evaluation criteria are described herein.

The policies and procedures under the Federal Acquisition Regulation (FAR) Part 12, Acquisition of Commercial Items, in conjunction with FAR Part 15, Contracting By Negotiation and FAR Part 19, Small Business Program, will be utilized for this procurement. The Government will award a contract resulting from this solicitation to a responsible Contractor whose proposal conforms to the solicitation and will be most advantageous to the Government.

A basis for trade-offs between cost/price and non-cost/price factors are not permitted.

Award will be made to the responsible offeror whose proposal is deemed technically acceptable (technical capability) and offers the lowest price.

The Government will evaluate the offeror’s technical proposal to determine whether it satisfies the minimum for successful contract performance. In order to be considered for award, offerors proposal must receive “acceptable” rating in every non priced factor and subfactor.

The Government intends to evaluate proposals and award one (1) contract without discussions with offerors.

Therefore, the offeror’s initial proposal should contain its best terms from a technical and price standpoint.

However, in accordance with (IAW) FAR Part 15.306, should discussions become necessary, the Government reserves the right to hold them. If this occurs, a competitive range will be determined and offerors notified. The competitive range may be limited for purposes of efficiency IAW FAR Part 15.306 (c)(2).

The Contracting Officer will make a determination of responsibility in accordance with the standards of FAR 9.104.

In order to be determined responsible, a prospective contractor must meet all standards of FAR 9.104-1.

B. FACTORS AND SUB-FACTORS TO BE EVALUATED

Award will be made to the offeror whose proposal is most advantageous to the Government based upon an integrated assessment of the evaluation factors and subfactors described below.

The following evaluation factors and subfactors will be used to evaluate each proposal:

Factor 1: Technical Acceptability

Subfactor 1: Management Approach Subfactor 2: Staffing Approach

Factor 2: Price

FACTOR 1 - Technical Capability: The Technical Submission evaluation provides an assessment of the offeror’s capability to satisfy the Government’s requirements.

All submitted documentation should demonstrate the offeror’s capability to meet the technical standards listed below. Any offeror that fails to provide proper documentation of their ability to meet the below standards will receive an unacceptable rating for Technical Acceptability, and will not be considered for award.

Subfactor 1: Management Plan. To be deemed Technically Acceptable, the Offeror’s Management Plan must be complete, meet all PWS requirements, show a good understanding of the requirements, and must demonstrate:

a. The offeror’s plan to maintain or acquire the required equipment necessary to complete all requirements of the PWS is feasible, to include the additional containers that may be required during contract performance, and meets all PWS requirements.

b. The offeror described an adequate methodology to successfully generate and produce reports of outcomes associated with PWS.

c. The management plan demonstrates an organizational chart which identifies an appropriate management structure of key personnel, including a description of roles and responsibilities, likely to result in successful performance. Key personnel must meet all PWS requirements.

d. The offeror’s plan provides a good approach to ensuring all personnel possess and maintain the required certifications in accordance with PWS.

Subfactor 2: Staffing Plan. To be deemed Technically Acceptable, the Offeror’s Management Plan must be complete, meet all PWS requirements, show a good understanding of the requirements, and must demonstrate:

a. The staffing plan provides adequate staffing and includes appropriate labor categories and appropriate number of personnel proposed for successful performance of all PWS tasks. Offerors provide feasible methodology for successfully accomplishing the following: accommodating fluctuating workloads, minimizing personnel turnover, recruiting and retaining qualified and experienced personnel, cross-training and cross-utilization of personnel.

b. The provided staffing matrix is complete and identifies all appropriate labor category, appropriate quantity of each labor category proposed, and this labor mix is adequately cross-walked to each task identified in the PWS in a manner that demonstrates successful performance of all PWS requirements.

c. Narative to demonstrate an understanding of the skills required to execute contract tasks, as well as, how they are to be implemented and utilized in contract performance in accordance with the PWS (including procedures to develop collection schedules, source separations, transporting refuse and recycle, weighing).

Technical Acceptable/Unacceptable Ratings

Rating Description

Acceptable Proposal meets the minimum requirements of the solicitation.

Unacceptable Proposal does not meet the minimum requirements of the solicitation.

Factor 2 –Price. Price will not be assigned an adjectival rating; however, price will be evaluated for reasonableness in accordance with FAR 15.404-1. The Government will evaluate the Offeror’s total price, to include the base period, first option period, second option period, third option period, fourth option period, and one-half of the fourth option period for purposes of FAR 52.217-8, using price analysis techniques. In order to be eligible for award, an offeror's price must be determined Fair and Reasonable and consistent with a Fair Market Price. The contracting officer will evaluate each price proposal using price analysis techniques delineated in FAR 15.404-1 in order to establish Fair and Reasonable pricing. Price proposals that fail to follow instructions, are incomplete, or are contradictory internally or with other portions of the proposal, may be determined to be ineligible for award. The government reserves the right to fix minor clerical errors within the price proposal without entering discussions.

Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). As part of price evaluation, the government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding one-half of the offeror's final option period price to the offeror's total price. Thus, the offeror's total evaluated price for the purpose of evaluation will include the phase-in, base period, 1st option, 2nd option, 3rd option 4th Option, and 1/2 of the 4th option for purposes of the FAR 52.217-8 option to extend services. Offerors should not enter a price for that six-month period.

Unbalanced Pricing may be evaluated in accordance with FAR 15.404-1(g), as applicable, to assess potential performance risk for unreasonably high prices.
