https://www.logisticsinformationservice.dla.mil/CAGETier3/

CONTRACTOR RESPONSIBILITY, PREAWARD SURVEY:

In order to determine a contractor's responsibility for purposes of contract award in accordance with FAR Part 9, the contractor is required to provide a statement regarding previous experience and past performance in performing comparable work, information related to the business organization, financial resources, and/or plant to be used in performing the work (Attachments, Preaward Survey). All offerors will complete and return the Preaward Survey as part of the Price/Cost proposal. (W91238-18-R-0034).

Failure to submit the Preaward Survey in conjunction with the price proposal will not of itself render the offer unacceptable.

In order to be determined to be responsible a prospective contractor must:

1. Have adequate financial resources to perform the contract or the ability to obtain them.

2. Be able to comply with the required or proposed delivery or performance schedule, taking into consideration all existing commercial and governmental business commitments.

3. Have a satisfactory performance record. In making the determination of responsibility, the Government Contracting Officer shall consider relevant past performance information. A prospective contractor shall not be determined responsible or non-responsible solely on the basis of a lack of relevant performance history except when there are special standards set forth in the solicitation which applies to all bidders that must be met in order to receive the award. These special standards may be necessary when unusual expertise or specialized facilities are necessary in the performance of the contract; therefore, in order to be determined to be responsible for that particular contract, the offeror must be able to meet those special standards. A prospective contractor that is or recently has been seriously deficient in contract performance shall be presumed to be non-responsible unless the Contracting Officer determines that the circumstances were beyond the contractor's control or that the contractor has taken appropriate corrective action. Other responsibility considerations by the Contracting Officer will include past efforts by the contractor to apply sufficient tenacity and perseverance to perform acceptably, to meet quality requirements of contracts, and the contractor's past compliance with subcontracting plans (if required) under recent contracts.

4. Have a satisfactory record of integrity and business ethics.

5. Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them (including, as appropriate, such elements as production control procedures, property control systems, quality assurance measures, and safety programs applicable to materials to be produced or services to be performed by the prospective contractor and subcontractors).

6. Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them.

7. Be otherwise qualified and eligible to receive an award under applicable laws and regulations.

Determination of Contractor Responsibility will be completed in accordance with FAR 9.104-1.

If the contractor or subcontractor does not already have sufficient resources demonstrated in the completed Pre-award Survey, acceptable evidence of "the ability to obtain" the required, adequate resources (all of the resources discussed in FAR 9.104-1) normally consists of a commitment or explicit arrangement that will be in existence at the time of contract award to rent, purchase or otherwise acquire the needed facilities, equipment, other resources, or personnel.

The Pre-award Survey as a tool used by the Government in determining responsibility of the offeror is submitted as part of the Price/Cost proposal and is separate from the technical proposal's response to the technical evaluation criteria found later in this section. Some of the information required from the offeror for completion of the Pre-award Survey and the technical proposal may be duplicative but it is necessary that the information be provided in full in both places and that the Price/Cost proposal and the Technical proposal be separate documents. DO NOT state, for example, in the technical proposal, "See Price/Cost proposal for past performance information".

GENERAL PROPOSAL PREPARATION.

The proposal shall be submitted as summarized below and as required by the specifications.

Both volumes must be received at the location shown in Block 8 of Standard Form 1442, not later than the date and time specified in Block 13 of Standard Form 1442. The information in the two volumes is evaluated separately and independently. Therefore, all information intended by the Offeror to be evaluated as part of the price volume must be contained within the price volume. All information intended by the Offeror to be evaluated as part of the technical volume must be submitted as part of the technical volume. Do not merely cross-reference similar material between the technical and price volumes.

Offerors shall provide past performance evaluation information for the projects submitted. Projects shall be within the past five years that are of similar scope, magnitude, and complexity compared to the Live Fire Exercise Shoothouse project (e.g. Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), Construction Contractor Appraisal Support System (CCASS), questionnaire, similar performance evaluation, or other performance evaluations completed previously).

The contractor shall also describe any performance issues, quality control on past contracts, and timeliness of performance, customer satisfaction and cost control. Furthermore, the contractor must describe the project and how it is similar in terms of scope, magnitude and complexity to the Live Fire Exercise Shoothouse project.

The Past Performance Questionnaire (PPQ) included in the solicitation is provided for the offeror or its team members to submit to the client for each project described above in 4.3.4.2.a. Byrd-Craig using email at Lequita.Y.Byrd-Craig@usace.army.mil prior to proposal closing date. Offerors shall not incorporate, by reference, into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

The Standard Form (SF) 1442 must be completed by the Offeror and duly executed with an original signature by the official(s) identified in the proposal cover sheet as authorized to bind the Offeror in accordance with FAR 4.102, which includes specific instructions pertaining to individuals, partnerships, corporations, Joint Venture participants, and agents. Include the Offeror’s DUNS number in block 14 of the SF 1442, along with the Offeror’s address. All amendments must be acknowledged in accordance with the instructions on the Standard Form 30, Amendment. If the Offeror is a Joint Venture (JV), include a copy of the JV agreement and indicate its status.

Tab 3 of the Price Proposal: Pricing Schedule.

Submit the completed Contract Line Item Number (CLIN) Schedule (Section 00 10 00) with the Offeror’s proposed contract prices inserted in the appropriate spaces. Prices must be proposed for all contract line items (except for those CLINs deleted from the solicitation). Unit prices must be extended to the actual “dollar and cents” amounts (e.g., to two decimal places). Do not round off the extended prices to the nearest dollar. Check your pricing submission very carefully for mathematical and clerical errors prior to submission. Any qualification of pricing may render the proposal unacceptable and therefore not eligible for award. However, Offerors are encouraged to use callouts, footnotes, etc. to explain their lines of thinking where it would aid in the Government finding the price(s) fair and reasonable.

Tab 4 of the Price Proposal: Work Breakdown Structure.

Submit a Work Breakdown Structure of the Offeror’s proposed contract prices, for each line item in the CLIN Schedule, using the format below, in accordance with Unified Facilities Criteria (UFC) 3-740-05 2-13.1. Again, Offerors are encouraged to use callouts, footnotes, etc. to explain their lines of thinking where it would aid in the Government finding the price(s) to be balanced.

Tab 7 of the Price Proposal: Pre-Award Survey Information.

The contracting officer is required to make an affirmative pre-award determination of the prospective contractor’s responsibility in accordance with the mandatory requirements of Part 9 of the Federal Acquisition Regulation (FAR) and its supplements. The contracting officer must have sufficient information available to determine that a prospective contractor meets these minimum standards. Therefore, the Offeror is requested to provide the pre-award survey information described below with its price proposal:

(1) The completed Construction Contractor Data Form with Supplemental Schedules A-C (see format which follows). If the Offeror is a large multi-segmented business concerns, the data provided on the supplemental schedules may be limited to information that directly pertains to the specific segment of the business concern (i.e., the division, group, unit, etc.) proposed to perform work under the prospective contract with its own work force. If the offer is being submitted by a Joint Venture, submit a separate form for each Joint Venture participant. The Offeror may submit pre-award survey information in another format, provided that the information furnished is substantially the same as that which would be furnished on the Construction Contractor Data Form and its supplemental schedules.

(2) Current financial statements. If the Offeror’s financial statement is more than 60 days old, submit a certificate stating that the firm's financial condition is substantially the same, or, if not the same, state the changes that have taken place. If a Joint Venture, provide this information for each participant in the Joint Venture.

(3) Banking information. Provide letters from banks or other financial institutions with which the Offeror conducts business. The letters should contain information about your firm's accounts, loans, lines of credit, etc. The Government is interested in financial stability, timely payments, the length and nature of the relationship between the firm and the financial institution, and the firm's financial ability to perform the contract. The letters should also provide the name and telephone number of the bank representative the Government may contact. If a Joint Venture, provide this information for each Joint Venture participant.

The Government will treat the pre-award survey information submitted by the Offeror as proprietary.

SECTION 00 22 00 - SUPPLEMENTARY INSTRUCTIONS

PROPOSAL EVALUATION

SOLICITATION SECTIONS PERTAINING TO OFFEROR’S SUBMISSION AND EVALUATION

PROPOSAL BASIS OF AWARD

GENERAL SUBMISSION REQUIREMENTS AND

INSTRUCTIONS, EVALUATIONS, AND

CONTRACT AWARD

A. Basis for Award

AWARD SELECTION CRITERIA:

1. Proposals must meet the criteria stated in the RFP in order to be eligible for award, to include responsiveness, responsibility, technical acceptability, and fair and reasonable pricing.

2. The Source Selection Authority, independently exercising prudent business judgment, will determine which Offeror, if any, will receive the contract award. Award will be made to that Offeror whose proposal is technically acceptable and has the lowest price that is determined fair and reasonable.

3. The Government reserves the right to reject any and all offers.

4. Offerors are reminded to include their best technical and price terms in their initial offer and not to assume that they will have an opportunity to participate in discussions or be asked to submit a revised offer.

B. Order of Review

Lowest Priced Technically Acceptable (LPTA) Evaluation Process

1. Evaluation of technical proposals: The Source Selection Authority will give all proposals to the Source Selection Evaluation Board (SSEB). Although each offeror's price proposal will not be revealed to members of the SSEB, the Board will review technical proposals in ascending order of the value of each offerors' price proposal. Accordingly, the Board will first consider the technical proposal of the lowest-priced offeror. If the proposal is found acceptable as to all evaluation factors, no further technical offers will be reviewed and the lowest-priced offeror’s price proposal will next be evaluated. If, on the other hand, the lowest-priced offeror's technical proposal is not found acceptable for any factor, the Board will set aside that technical proposal and will review the next lowest-priced offeror's technical proposal. This process will continue until the Government finds a technical proposal that is fully acceptable for each evaluation factor.

2. Evaluation of price proposal: Next, the price proposal of the first offeror whose technical proposal is found to be acceptable for each evaluation factor (as explained in Step 1, above) will be analyzed for price reasonableness, for balanced pricing, and for evidence that its offeror possesses a clear understanding of project requirements. If the evaluators find the price proposal to be reasonable, balanced, and reflective of an adequate understanding of project requirements, then its offeror will be recommended as the prospective contract awardee.

3. While the Government’s intent is to award without discussions, any debriefing of an offeror whose proposal was reviewed but not selected for contract award will be limited to an explanation of the deficiencies that prevented the Government from finding the proposal acceptable as to all factors contained in this solicitation.

4. No debriefing can be provided to offerors whose proposals were not evaluated by the Government.

STANDARDS OF REVIEW

1. Technical proposals will be evaluated consistent with the uniform evaluation procedures set forth in this section of the solicitation. The SSEB will conduct an in-depth review of each proposal against the factors established in the solicitation as follows:

a. All proposals received will be subject to an initial screening by the Contracting Officer to determine compliance with the instructions set forth herein and responsiveness to their terms and conditions.

b. Each member of the SSEB will independently evaluate all information provided in a proposal against the prescribed non-price factors. Once these individual evaluations are completed, the SSEB will assign a consensus rating for each evaluation factor. The SSEB will not consider any documents incorporated by reference, except as expressly allowed by this solicitation.

c. Each board member’s rating for each offeror’s submission in response to each evaluation factor, as well as the board’s overall rating of each offer as either ACCEPTABLE or UNACCEPTABLE, and any supporting documentation, shall be provided to the Source Selection Authority.

d. Offerors are reminded that unsupported promises to comply with contractual requirements will not be sufficient. Proposals must not merely parrot the contractual requirements, but rather provide substantive, understandable and realistic evidence to support promised performance.

e. NOTE: For purposes of evaluating Experience and Past Performance, the Offeror is defined as the firm identified in Block 14 of the Standard Form 1442. If more than one firm is listed in Block 14, then a signed Joint Venture/partnership agreement must be submitted with the proposal and the Joint Venture/partnership shall be registered as such in the System for Award Management (SAM) database. However, each party of the Joint Venture/partnership must submit its own DUNS number with the JV/partnership proposal. Submitted projects performed by entities than the Offeror, such as teaming joint-venture or partners or subcontractors, will not be evaluated for Offeror experience or Offeror past performance, unless those other entities are part of a Joint Venture/partnership, as demonstrated by a signed JV/partnership agreement. Also, cited project examples must identify the Offeror’s role in the project if the Offeror was not the prime contractor – i.e., if it was acting as a subcontractor at any tier.

f. For purposes of this RFP, an “Offeror” may include a group of two or more entities that have formed a “contractor team arrangement,” as that term is defined in the Federal Acquisition Regulation, Section 9.601. In the case of entities that have formed a contractor team arrangement, the experience and performance history of any member of the team, whether or not gained while working with the other member(s) of the currently-proposed contractor teamarrangement, may be considered as a part of the evaluation of the Offeror’s proposal.

g. An Offeror that relies upon the performance history of a member or members of a proposed contractor team arrangement will be expected to maintain that arrangement during performance of any contract awarded to that Offeror under this RFP. As a part of their proposal, the Offeror must provide a contractor team agreement signed by all parties, identifying the legal name(s) of all entities and describing the nature of each entity’s relationship (teaming/partnering, joint venture, etc.) and its role on this project. Past Performance information of other than the Offeror will not be considered without the teaming arrangements. In the case of joint ventures, at least one project will be submitted from each member to demonstrate past experience. This documentation shall be provided in Binder 1 of the Offeror's proposal.

C. Non-Price (Technical) Evaluation Criteria

TECHNICALLY ACCEPTABLE / UNACCEPTABLE RATINGS:

1. Proposals selected for technical review will be evaluated against the minimum requirements for each non-price evaluation factor.

2. In order to receive an overall ACCEPTABLE rating, a proposal must receive an ACCEPTABLE rating on all non-price factors and any sub-factors. A proposal receiving an UNACCEPTABLE rating on one or more non-price factor or sub-factor will receive an overall UNACCEPTABLE rating and be ineligible for award.

3. The final overall rating, along with ratings on individual factors, will be provided to the SSA and used in making the determination of which Offeror(s) is/are eligible for award.
