STATEMENT OF WORK (SOW)
FP Powerhouse 1 Battery Replacement Project at Ft Peck Dam May 2023
1.0 General Information.
1.1 Background. The Fort Peck Project is located in Fort Peck, Montana on the Missouri River, approximately 20 miles from Glasgow, Montana. There are two plants; Plant 1 contains three generating units; Plant 2 contains two generating units. The Fort Peck Batteries have reached end-of-life cycle and exhibiting signs of failure, it is imperative to start a replacement process.
1.2 Scope of Work. This project will involve the replacement and testing of the Station Service Battery system at the Ft Peck Project.
The contractor shall supply and install the following components:
a. Power Plant #1 UPS Battery:
Procurement of one (1) each sixty (60) cell stationary flooded cell lead acid battery bank.
b. Power Plant #1 Station Service Battery:
Procurement of one (1) sixty (60) cell stationary flooded cell lead acid battery bank.
c. Power Plant #2 Station Service Battery Testing:
Capacity testing of one (1) existing sixty (60) cell stationary flooded cell lead acid battery bank located in Power Plant #2.
d. Power Plant #1 UPS Inverter/Charger:
Optional - Procurement of One (1) Inverter Charger
e. Power Plant #1 & 2 Battery Chargers:
Optional - Procurement of Four (4) Battery Chargers
f. New Battery Rack:
Optional - Provide and install if replacement batteries are not compatible with the existing battery rack.
1.3 Existing Battery Cells.
a. Power Plant 1 UPS. The existing 60-cell 15 jar storage battery consists of C&D type XT4J9. Specification sheet and photos in appendix A.

1.4 New Battery Cells. The battery cells to be furnished under this contract shall meet the following specifications:
1.4.1 Power Plant 1 UPS. Each battery shall be a flooded lead-acid type with lead-calcium alloy plate grids. Cell containers shall be sealed, clear, shock absorbing, heat-resistant plastic, with electrolyte high- and low-level markers, individual number ID on each jar and spray proof vents.
Each battery shall be rated in accordance with the following table:

The operating environment of this battery system is a standard power plant battery room with ventilation and temperature control.
1.4.2 Power Plant 1 Station Service. Each battery shall be a flooded lead-acid type with lead-calcium alloy plate grids. Cell containers shall be sealed, clear, shock absorbing, heat-resistant plastic, with electrolyte high- and low-level markers, individual number ID (1-60) and spray proof vents. Each battery shall be rated in accordance with the following table:

The operating environment of this battery system is a standard power plant battery room with ventilation and temperature control.
1.5 Battery Rack
1.5.1 Furnish UPS Battery Rack. The existing battery rack may be reused if compatible with the dimensions of the new batteries. The contractor will be responsible for furnishing a new battery rack and ensuring adequate spill containment if the new batteries exceed the dimensions of the existing rack. The battery rack and spill containment shall not exceed the width of the existing spill containment.
1.5.2 UPS Battery Rack Dimensions. Existing UPS battery rack dimensions are 170 inches in length and 19 inches in width. Existing spill containment dimensions are 172 inches in length and 20.5 inches in width.
1.5.3 UPS Battery Rack Requirements. UPS battery rack shall be a one-step design to allow for easy access for maintenance. The racks shall be constructed of structural steel. Before application of paint, all surfaces shall be carefully cleaned of all dirt, moisture, rust, scale, lubricants and other substances. Lubricants shall be removed by suitable solvents. Rust and scale shall be removed by sandblasting, power sanding, power grinding, or power wire brush. All steel shall have not less than two finish coats of acid-resistant ANSI 61 gray paint or acid resistant epoxy.
Battery supporting rails shall be covered with a protective vinyl runner plate not less than 1/16 inch thick. The battery rack shall have the proper seismic rating for below grade installation (seismic zone 0).
1.6 Battery Accessories
1.6.1 Each battery shall be furnished with the following accessories:
a. Lead coated intercell connectors.
b. Lead coated interstep connectors for each battery rack.
c. Acid resistant connector bolts and nuts
d. Solderless terminal lugs for 1- 4/0 AWG cables per polarity of the battery total of four (4) each.
e. Cell lifting facilities
f. Vinyl coated assembly wrenches
g. Oxidation inhibiting grease
h. Explosion proof, flame arrestor type vent caps
i. Non-conductive protectors over all connectors to provide a dead front
j. Portable Hydrometer
k. Thermometer
1.7 Optional UPS Inverter Charger Recommendation
1.7.1 UPS Inverter Charger Requirements. The Contractor shall provide a written document/report with battery charger/inverter recommendations. Based on the UPS battery provided, the Contractor shall provide a recommended battery charger/inverter system. The recommendations shall include charger input voltage and current; charger output DC Amps and DC Voltage, and inverter output at least equivalent to the existing inverter.
The inverter/charger must have hot swappable module replacement capability, availability for expansion, isolated output, and an external make-before-break bypass switch. The recommendations shall also include information on charger operation, current limiting settings, DC ground protection, DC output continuous, equalizing timers and settings, and output ripple voltage. The recommended inverter/charger shall be able to operate without batteries as a DC supply. The recommendation shall include the make, model number, and quote for the recommended inverter/charging system. The Government may elect to purchase this option or use the existing battery inverter charger.
1.7.2 Existing UPS Inverter Charger. The existing inverter/charger is a Powerware 9170+ UPS with a maximum rating of 9kVA. Input power to the Powerware is hardwired through an external make-before-break disconnect switch (BPE-14-MBB-1A) to a 120/208V wye, 3-phase panel utilizing a 50A 2 pole breaker. The Powerware has four (4) power modules (ASY-0673 split-phase), one (1) charger module (ASY-0675), and an isolated output.
1.8 Optional Station Service Battery Charger Recommendation. The Contractor shall provide a written document/report with battery charger recommendations. Based on the batteries provided, the Contractor shall provide a recommended battery charging system, utilizing two parallel filtered chargers. The recommendations shall include charger input voltage (480V, 3-phase) and current, charger output DC Amps and DC Voltage. The recommendations shall also include information on charger parallel operation, current limiting settings, DC ground protection, DC output continuous, equalizing timers and settings, parallel load sharing, and output ripple voltage. The recommended chargers shall be able to operate without batteries as a DC supply. The chargers must be sized to operate in parallel as a redundant system as a source of DC supply. The recommendation shall include the make, model number, and quote for the recommended charging system. The Government may elect to purchase this option or use the existing battery chargers (PP1: GNB model GSCR-130-T-150-FE; PP2:
Hitran model 3 SCRF 130-150).
1.9 Installation. The UPS and station service battery systems will be installed by the contractor under the supervision of the government. The station service battery system will be installed in the existing rack. All new battery posts shall be cleaned; new oxide coating shall be applied and torque all connections to factory specifications. All lock out tag out will be performed by the government and any outage coordination will be provided by the government. Before install can begin, a minimum of four (4) weeks’ notice is required in order to coordinate the unit outages. All DC systems shall remain operational throughout all contract activities. The Contractor shall provide a temporary 125VDC power source to maintain all battery loads for the duration of each installation.
1.10 Inspection and Acceptance Testing For Power Plant 1
1.10.1 Inspection. All battery cells and battery rack components shall be inspected by a representative of the government before installation, during installation and a final inspection shall be performed and documented after the installation is complete.
1.10.2 Acceptance Testing. The battery bank shall be acceptance tested in accordance with IEEE 450 to include capacity tests, voltage readings, intercell connection readings, hydrometer readings and internal ohmic readings. A digital copy of the acceptance test results shall be provided to the government. All testing shall be witnessed by a representative of the government. Contractor shall provide all test equipment, tools and personnel required to perform the prescribed testing. Batteries shall be recharged after testing.
1.11 Capacity testing for Power Plant 2. One (1) existing battery bank shall be capacity tested in accordance with
IEEE 450 to include capacity tests, voltage readings, intercell connection readings, hydrometer readings and internal ohmic readings. A digital copy of the capacity test results shall be provided to the government for each bank tested. All testing shall be witnessed by a representative of the government. Contractor shall provide all test equipment, tools and personnel required to perform the prescribed testing. Batteries shall be recharged after testing.
1.12 Disposal. The contractor shall be responsible for the removal and recycling of all replaced equipment. The contractor shall provide proof of applicable certifications for the disposal and a “certificate of disposal” is required.
1.13 Temporary Spill Containment. Provide temporary spill containment in power plant #1 in accordance with IEEE 1578 during the removal of the existing battery systems and during the installation of the new battery system.
1.14 Warranty
1.14.1 Warranty. The manufacturer shall provide a warranty against any defective materials or workmanship for a period of one year from the date of installation. During the initial one-year warranty, the manufacturer shall replace any cells or parts of the battery which do not meet the manufacturer’s published specification for new materials.
1.14.2 Comprehensive Warranty. The manufacturer shall also provide a comprehensive, prorated warranty for a period of 20 years from the date the batteries are received. If the battery or any cell fails to deliver 80% of its published rated capacity in ampere-hour at the specified discharge rate, the battery Manufacturer shall at their option: (1) repair the defective cell or battery to original specification at the Manufacturer’s expense, OR (2) apply a discount to the cost of replacement of the defective cell with a similar model in an amount equal to the purchase price of the defective item multiplied by the months of unexpired warranty divided by the months of total warranty.
1.15 Instructions and operating manuals. A digital copy of standard instruction and operating manuals shall be furnished to the government for all new equipment. A minimum of three (3) hours of onsite training shall be provided on proper battery system maintenance. A minimum of three (3) hours of onsite training shall be provided on proper battery charger maintenance. A minimum of two (2) hours of onsite training shall be provided on proper inverter/charger system maintenance class size ten (10).
1.16 Response to Specification. The manufacturer shall affirm categorically that the equipment offered meets or exceeds each requirement of this specification. All battery specification sheets, battery rack equipment drawings and acceptance and capacity test procedures shall be included with all bid packages. Any alternatives offered in lieu of any specified requirement shall be fully explained and meet the minimum requirements of this specification
2.0 General Requirements
2.1 Period of Performance. The period of performance for this contract will be 210 days from NTP.
2.2 Contractor Personnel
2.2.1 The contractor shall perform all work under this contract using his or her own forces except as provided in Paragraph 1.4.2 Subcontracting. Employees who perform this work shall be qualified persons on the contractor’s own payroll.
2.2.2 Subcontracting. The contractor shall not subcontract any work without written approval of the Contracting Officer. Compliance with the provisions of this contract by subcontractors shall be the responsibility of the contractor.
2.3 Quality Control
2.3.1 The contractor shall designate, in writing, an employee who shall serve as the contact for matters involving quality and performance or nonperformance of the required work stated in this PWS. The employee(s) shall be qualified and fully competent with full authority to act for, and on behalf of, the contractor as necessary to ensure that the required work is performed in accordance with the standards contained herein. The contractor shall furnish the above written designation to the Contracting Officer’s Representative (COR) no later than the first day of work.
The contractor shall include the name(s), address(s), and telephone number(s) of the responsible individual(s).
2.3.2 The Contracting Officer reserves the right to disapprove any individual whom he considers incompetent to perform the work required. The Contracting Officer will provide a written notice of any disapproval to the contractor.
2.4 Quality Assurance. The government will use the methods stated in this PWS to ensure that the Contractor is performing the services required by this PWS in an acceptable manner. The Government may use Quality Assurance Evaluators (QAE(s)) to provide assistance with the quality assurance methods.
2.4.1 The government has the right to inspect all services called for by the contract, to the extent practicable at all times and places during the term of the contract. The government shall perform inspections in a manner that will not delay the work.
2.4.2 If any of the services do not conform to contract requirements, the government may require the contractor to perform the services in conformity with contract requirements and at no increase in cost. If the contract requirements are not met after a second attempt the government may (1) require the contractor to take necessary action to ensure that future performance conforms to contract requirements and (2) reduce the contract price to reflect the reduced value of the services performed.
2.4.2.1 Upon verification of a validated customer complaint or corrective action report, the COR will notify the contractor that they are required to re-perform specific services. If the contractor is required to re-perform services, work will be completed within 30 days and COR must be notified within 3 days.
2.4.3 The government may take action, if the contractor fails to perform the services again or to take the necessary action to ensure future performance is in conformity with the contract requirements. The government may (1) by contract, or otherwise, perform the services and charge to the contractor any cost incurred by the government that related to the performance of such service or (2) terminate the contract in whole or in part
2.4.4 The contractor is responsible to replace/repair any damage to government property due to negligence, at his or her own cost. The government may take action, if the contractor fails to replace/repair any damage to government property. The government may (1) by contract, or otherwise, replace/repair damaged government property and charge to the contractor any cost incurred by the government to replace/repair any damage.
2.5 Pre-Work Meeting. Within One (1) week of award, the contractor shall arrange a Pre-work Meeting with the COR. The Contractor shall coordinate their proposed work and delivery schedule with the COR during this meeting.
2.6 Site visit. A site visit is scheduled for 20 June 2023 at 9:00 am local time. Contractors interested in seeing the site need to make a reservation with Irene Whitmer telephone (406) 526-3411 ext. 3008 or by e-mail at

2.7 Submittals. N/A
2.8 Standards and Regulations. The Contractor shall perform to the standards in the contract and comply with all Local, State, and Federal Regulations during the services performed. The Contractor is responsible for ascertaining the extent to which these regulations affect the operations resulting from this contract. The Contractor shall comply will all applicable regulations. Applicable regulations include, but are not limited to the following:
a. Code of Federal Regulations (CFR), Title 36, Chapter III, Part 327, Rules and Regulations Governing

2.8.1 Activity Hazard Analysis (AHA). The contractor shall prepare the AHA in accordance with Paragraph 01.A.14 or 01.A.15 of the EM 385-1-1. If using Paragraph 01.A.15, prepare the AHA IAW Figure 1-2.
Note: Contractors and other individual employer’s typically use Job Safety Analyses (JSAs), Job Hazard Analyses (JHAs), or similar Risk Management assessment tools. The government considers equivalent to, and acceptable substitutes for, the USACE’s AHA provided the data collected is the same as that required by the AHA, commensurate with the type of services the contractor is performing.
2.8.2 Abbreviated Accident Prevention Plan (APP). EM 385-1-1 in its entirety may be too complex for the type of work performed under these contracts; contractors may reference Appendix A, for abbreviated Accident Prevention Plan (APP). The contractor shall only need to submit items in Appendix A that are pertinent to the contract. The contractor shall use a qualified person to prepare the site-specific abbreviated Accident Prevention Plan (APP). The contractor shall prepare the APP in accordance with the format and requirements of the EM 385-1- 1 and supplemented herein. The contractor shall sign and submit the APP for approval prior to the start of work onsite.
2.8.3 Accident Reporting. All accidents (employee injuries, vehicle, building, or equipment property damage, etc.)
regardless of their severity, shall be reported as soon as possible to the onsite Government representative.
2.9 Physical Security
2.9.1 The contractor shall be responsible for safeguarding all government property, and materials provided for contractor use. The contractor shall secure at all times all government property, and materials. Specific security conditions may change based on threats to national defense, and based on the risk of specific facilities to these threats. The contractor shall abide by these changing conditions at all times, as applicable.
2.9.2 Fort Peck Project gates are locked during normal duty hours. The Contractors on-site supervisor shall work with the Fort Peck personnel for entry procedures. After the stated Government project personnel working hours, the project gate accesses are locked. Contractor's personnel will not have access into the work area except during approved work hours. The security of the Contractor's property and items furnished under this contract, until accepted, are the responsibility of the Contractor whether stored inside or outside the power plant security gate.
2.9.3 Employee Identification. When required by the Contracting Officer, the Contractor shall obtain and submit proof of U.S. citizenship and/or fingerprints of all persons employed or to be employed on the project. The Contractor shall be responsible for furnishing to each employee and for requiring each employee engaged on the work to display such identification as may be approved and directed by the Contracting Officer. The employee information shall be submitted prior to scheduled start of work.
2.10 Antiterrorism/Operation Security Requirements. See AT/OPSEC requirements in clauses section.
2.11 Pre-screen candidates using E-Verify Program. See AT/OPSEC requirements in clauses section.
2.12 Payment
2.12.1 The government will make payment upon the completion of each CLIN item, after the government has inspected and accepted the services, and the government has reviewed, approved, and processed the contractor’s invoice. The contractor shall submit the invoice to the COR and/or any other person that has been designated in the contract to receive the invoice.
2.12.2 The contractor must provide the contractor’s name, address, contract number, period of services completed (i.e., for the month of January or for the period of performance of January 1 through February 23), CLIN number and specific quantities of work performed (i.e., 1 Month, 40 days, 100 acres, etc.), and total requested, for an invoice to be considered proper. The contractor shall submit the invoice by the fifth (5th) of the month for services completed the previous month or submit the invoice upon completion of all services, in accordance with the period of performance stated in the CLIN.
2.13 Protection Of Material, Work And Facilities. Materials, supplies, tools, equipment and Government property shall be protected and preserved in accordance with manufacturer's recommendations. If material, equipment, supplies, and work performed are not adequately protected, such property may be protected by the Government and the cost thereof will be charged to the Contractor or deducted from any payment due. All operating equipment shall remain accessible. Any designations covered relating to fire protection equipment shall be remarked upon covering.
The Contractor shall be responsible for the removal of all stains and residues and for the repair of damage to structures and equipment. Operating components of existing power plant equipment shall be protected. Existing facilities shall be protected whether or not shown on the drawings. Upon completion of the work, existing facilities shall be left in a condition equal to the original condition prior to the contract. Costs for repair and restoration of any facilities shall be considered to be incidental to and included in the contract price.
2.14 Cooperation With Others. The Contractor shall cooperate and coordinate his work with that of others as required for orderly completion of all work.
2.15 Site Working Hours. The scheduled working hours of the Power Plant staff are Monday thru Thursday, from 7:00 a.m. - 5:00 p.m. Non-workdays include Saturdays, Sundays and Federal holidays. All Project support required by the Contractor shall be scheduled during the Project staff working hours. Working hours which extend past this, on weekends, and on federal holidays or which are proposed to be different from that suggested above shall be coordinated and approved by the Contracting Officer’s Representative (COR). Work extensions during capacity testing and recovery are expected to extend past normal working hours. Notification of any proposed changes of the schedule of regular work hours, overtime work hours, and shifts of work crews and personnel at the site shall be coordinated with the COR.
2.16 Availability And Use Of Utility Services. All utilities provided by the Government shall be at no cost. The location of all power lines and all temporary connections for electricity shall be coordinated with the COR. Care shall be exercised in conserving all Government-furnished utilities. Extension cords shall be Contractor-furnished.
2.17 Contractor's Temporary Construction Power Connections. All temporary circuits and devices required for construction shall be provided, connected, and maintained and removed prior to final acceptance. Ground fault protection shall be provided for all circuits used and shall be Contractor-furnished. 480V AC, 3-phase, ungrounded, 40A, delta receptacles are located on the project. The Contractor may use these 480V receptacles to provide power to a Contractor furnished load center for construction activities. The Contractor must provide cannon plug
2.18 Portable Toilets
Toilet facilities will not be available for Contractor's use. The Contractor shall provide and maintain portable toilets for use by the Contractor's staff. Toilet(s) shall be placed at the location directed by the Contracting Officer. To prevent overturning by high winds, all portable toilets shall be anchored down.
2.19 Housekeeping
Daily clean-up of all rubbish and waste materials is required. Adequate disposal containers should be placed strategically around the site. Debris shall be removed on a regular basis and disposed of as required by Federal, State, and Local requirements.
2.20 Telephone
The project telephone system will not be available to the Contractor. Cellular phones may be used.
2.21 Project Location
The Fort Peck Project is located at Fort Peck, MT. The nearest airport is at Glasgow, MT. From Glasgow take Highway 24 to Fort Peck (approximately 20 miles) then lower Yellowstone Road to the Powerhouse (approximately

4.0 Definitions. The following definitions and descriptions apply wherever the word(s) or phrase(s) is/are stated in this PWS:
Acceptable Level of Performance (ALP): The maximum percent defective, the maximum number of defects per hundred units, or the number of defects in a lot considered satisfactory on the average. The allowable leeway or variance from a standard before the government will reject the specific service.
Contracting Officer’s Representative (COR): means an individual designated an authorized in writing by the Contracting Officer to perform specific technical or administrative functions.
Performance-Based Contract (FAR 2.101): Structuring all aspects of an acquisition around the purpose of the work to be performed with the contract requirements set forth in clear, specific, and objective terms with measurable outcomes as opposed to either the manner by which the work is to be performed or broad and imprecise.
Performance Requirements Summary (PRS): The PRS shows contract requirements, the component requirements related to each contract requirement, the price of each work requirement as a percentage of the associated contract requirement (Fixed Price Contracts), the standard of performance, and the acceptable level of performance (ALP) for each work requirement.

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.

Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract.
