AMENDMENT NOTES

The purpose of this amendment is to make the following changes to the solicitation:

1. To extend the response date to 1 Jun 2020 10:00AM CST.

2. Revise the attached statement of work.

3. Delete CLINs 0004 – 0005. This will be a one-year contract only.

4. Add Attachment 6, Past Performance Questionnaire

5. Add Attachment 7, Multi-Metal Paint Stripper Evaluation Form.

6. Add Narrative:

PAST PERFORMANCE PROPOSAL AND EVALUATION INFORMATION. The government will conduct a performance risk assessment and the assessment will be used to assist in determining responsibility in accordance with (IAW) FAR 9.104.1 based upon the past performance of offerors and proposed subcontractors as it relates to probability of successfully performing the solicitation requirements. Offeror shall submit completed past performance questionnaires (Attachment No. 2 Past Performance Questionnaire) for RELEVANT PAST PERFORMANCE ON THREE (3) CONTRACTS performed within the past three (3) years prior to closing of this solicitation. For services, contractor shall have performed under each contract for a minimum of one (1) year within the past three (3) years. Each contract cited may be ongoing or complete provided it meets the one year performance criteria. For equipment or supplies, contractor shall have completed each contract within the past three (3) years. If offeror proposes use of major subcontractor(s) in performance of resultant contract, provide a description of the work to be performed (supplies or services) by each major subcontractor and the information specified above for each subcontractor identified as relevant to the work to be performed by the subcontractor. A significant or major subcontractor is that subcontractor expected to provide over 20 percent of the work effort or critical hardware, software, or services.

"Relevant past performance" is defined as performance similar in nature and in scope to work required by this acquisition. The government will screen contract information provided by offeror and will remove from consideration those contract references that are clearly unrelated to the type of effort sought. The government will consider this information in its evaluation of performance risk for offeror and proposed the government will make a reasonable effort to consider information on the contracts cited for offeror and for each major subcontractor.

a. The government reserves the right to evaluate fewer than three (3) contracts for any contractor should we be unsuccessful in obtaining required information from sources cited. In that case, contractor (or subcontractor) will be evaluated on the information available.

b. Should the government receive information on more than three (3) contracts, selection of those to be considered in evaluation will be based on the criteria stated previously. The government reserves the right to consider information from other sources in its evaluation.

c. The Government may utilize Federal awardee Performance and Integrity Information System (FAPIIS) and System for Award Management (SAM) to determine responsibility.

7. Revise FAR Clause 52.212-2 to include award evaluation criteria:

52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

A single contract award is anticipated to the contractor whose quote represents a technically acceptable product and otherwise provides, in the Government’s judgment, the most advantageous and realistic quote considering both non-price and price factors. The following factors shall be used to evaluate the offers:

1) Technical

2) Paint Stripping Test Requirements

3) Price

Technical Compliance Information: The offeror shall provide technical information sufficient to determine if their product complies with paragraph 2 of the Description/Work Statement/Specifications (SOW). Technical Evaluation will be on a MET / NOT MET basis.

Any Offeror’s proposal assessed as NOT TECHNICALLY ACCEPABLE will be notified that their proposal will no longer be considered for award.

Paint Stripping Test Requirements: Products that meet all technical requirements in section 2 of the SOW will require additional testing performed by ANAD Engineering and Chemistry Laboratory. Samples will be requested and tested using the criteria in paragraph 3 of the SOW.

The testing evaluation is a scored and weighted series of analysis and will be documented on Attachment 7, Multi-Metal Paint Stripper Evaluation Form.

Price: Price will be evaluated on reasonableness.

Technical are slightly more important than Paint Stripping Test Requirements. When combined, Technical and Paint Stripping Test Requirements are significantly more important than price.

If there is a company that meets all Technical requirements, Paint Stripping Test Requirements and quotes a reasonable price, the Government reserves the right to make an award without discussions.

While Price is not the most important factor, the closer the Offerors' evaluations are in those factors other than Price, the more important Price becomes in the decision. Notwithstanding the relative order of importance of the three evaluation factors as stated herein, Price may be controlling when:

(1) Proposals are otherwise considered approximately equal in Technical Capability and Delivery;

or

(2) An otherwise superior proposal is unaffordable; or

(3) The advantages of a higher rated, higher priced proposal are not considered to be worth the price premium.

(b) Affordability- Price can also play a role in the Government evaluation of the affordability of an Offeror's proposal. An Offeror may not receive an award if his proposal is unaffordable, even though the proposal is judged to be the best value to the Government.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of clause)

8. Delete FAR Clause 52.217-8 and 52.217-9.

9. Decrease CLIN0001 quantity from 80,000 to 11,000.

All other terms and conditions remain unchanged.
