SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS
The following have been modified:
SECTION L
L.1. GENERAL IINSTRUCTIONS
a. This section provides general guidance for preparing proposals as well as specific instructions on the format and content of the proposal. The Offeror's proposal must include all data and information requested and must be submitted in accordance with these instructions.
The Offeror shall not submit additional proposal information that is not specifically requested by this Solicitation. Such additional proposal information will not be considered during the evaluation process. The Offeror’s proposal shall be compliant with these submission instructions (Section L). Non-conformance with the instructions provided may result in an Offeror being found non-responsive and may result in an unfavorable proposal evaluation.
b. Offerors shall assume that the Government has no prior knowledge of their facilities and experience. The Government will base its evaluation only on the information presented in the Offeror’s proposal. The Government will not assume the Offerors will do anything that is not expressly stated in their proposal.
c. In presenting material in their proposal, Offerors are advised that quality of information is more important than quantity. The proposal shall be clear, concise, and shall include sufficient detail for effective evaluation and for substantiating the validity of stated assertions.
Elaborate brochures or presentations, binding, detailed art work and other documents beyond what is sufficient to present a complete and effective proposal, are unnecessary and are not desired. The proposal shall be specific, detailed and complete as to clearly and convincingly demonstrate that the Offeror has a thorough understanding of the requirements and associated risks, and is able, willing, and competent to devote the resources necessary to meet the requirements and has valid and practical solutions for all requirements.
d. The proposal should not simply rephrase or restate the Government's requirements, but rather, shall provide convincing rationale to address how the Offeror intends to meet the Abrams ED/TT requirements. Paraphrasing the Statement of Work (SOW), the System Requirements Document (SRD) or parts thereof is inadequate, as are phrases such as “standard procedures will be employed” or “well-known techniques will be used.” Mere reiteration of the requirement or standard reference material is discouraged and may be considered inadequate and non-compliant. It is the Offeror’s responsibility to present enough information to be meaningfully evaluated without discussions.
OFFERORS ARE HEREBY ON NOTICE THAT A FAILURE TO SUBMIT ALL THE
REQUIRED DOCUMENTATION IN EXACTLY THE MANNER (TIMELINESS AND
FORMAT) SPECIFIED IN THE SOLICITATION MAY CONSTITUTE A BASIS FOR
THE GOVERNMENT TO REJECT A PROPOSAL AS NON-COMPLIANT AND
THEREFORE UNACCEPTABLE, AT THE SOLE DISCRETION OF THE PCO.

e. The Government intends to evaluate proposals and award a contract without conducting discussions with Offerors. However, in the event the PCO concludes that conducting discussions is in the best interests of the Government, the PCO will establish a competitive range before entering into discussions. Therefore, the Offeror’s initial proposal should contain the Offeror’s best terms from a price and non-price standpoint.
f. The Government intends to award a contract resulting from this solicitation to the responsible Offeror whose proposal represents the best value to the Government in accordance with established criteria in Section M or equivalent solicitation criteria. The Government will uitize the subjective trade-off analysis in determining the best value.
g. Offerors shall ensure that each proposal Volume submitted contains only the information relevant to that specific, individual Volume. The Offerors are cautioned that each Volume of the proposal is evaluated as stand-alone against the criteria set forth in the Proposal Submission Instructions and Evaluation Criteria and if the data is not contained in the appropriate volume of the proposal, it will not be evaluated.

Offerors shall assume that any data they have previously submitted in response to another solicitation, whether submitted to the ACC-ORL or another agency, should be assumed to be unavailable during this proposal evaluation and source selection process. Offerors proposal data shall not be incorporated into the proposal by referring to another proposal or other source.
i. The Government requests that the proposal be valid for at least 180 calendar days from the proposal due date. Files shall not contain classified information. Offerors are cautioned that in order for their proposal to be eligible for award, the proposal shall be in compliance with the terms and conditions set forth in this solicitation.
j. If an Offeror believes that the requirements and/or instructions in the RFP contain an error, omission, or are otherwise unsound, the Offeror shall immediately notify the Contract Specialist and PCO in writing (email is acceptable) with supporting rationale.
k. Offerors shall identify the intellectual property rights and technical data rights included in their proposal submission IAW DFARS Subparts 252.227-7013 and 7014 via completion of solicitation provision DFARS Subpart 252.227-7017.

Table 1 is for Technical Data associated with noncommercial products and noncommercial Computer Software, Table 2 is for Technical Data associated with commercial products and commercial Computer Software, and Table 3 is for Contract Administration (cost, financial, schedule) information and data that does not fall within the DFARS definitions of Technical Data or Computer Software. Offerors are required to fill in the remaining portions of each Data Rights Attachment table in accordance with the instructions provided by the Government.
Assertions shall be made for Technical or Computer Software to be Furnished with Restrictions.
If the offered rights are more restrictive than the desired rights, offerors can list the cost to grant the desired rights or enter the phrase “Decline” to indicate a refusal to grant the desired rights at any cost.
l. To be eligible for award, the Offeror must also adhere to the directions and submit the following information under Volume V, Contracting Information. Large Business Offerors Only shall provide a Small Business Subcontracting Plan meeting the requirements of FAR 52.219-9 and DFARS 252.219-7003 (or DFARS 252.219-7004 if the Offeror has a Comprehensive Small Business Subcontracting Plan). The Small Business Subcontracting Plan is a requirement for award to a Large Business and will be incorporated into any resultant contract. The Small Business Subcontracting Plan shall reflect and be consistent with the commitments stipulated in the Offeror’s proposed Small Business Participation Plan.
m. Proposals shall not contain classified information and Proprietary information shall be clearly marked.
n. Determination of Contractor Responsibility. The Government may use information other than that provided by the Offeror to make a determination that the Offeror is a Responsible Prospective Contract as per FAR 9.104. Such information is obtained from sources outside the proposal and may include the Defense Contract Audit Agency (DCAA), the Defense Contract Management Agency (DCMA), or various Government databases, in addition to other means.
The extent to which the Government uses the financial information in the determination of contractor responsibility is at the sole discretion of the Contracting Officer.
