SUMMARY OF CHANGES
SECTION SF 30 - BLOCK 14 CONTINUATION PAGE
The following have been added by full text:
QUESTIONS & ANSWERS (2ND SET)
Q.1 Reference Page 114 labor categories listed - there are 9 labor categories listed. Are all 9 labor categories currently being supported by one of the three current contracts being re-competed under this solicitation?
*A.1-There are 10 labor categories:
1) Warehouse Specialist
2) QA Technician (not covered by SCA)
3) Secretary III
4) Material Expediter
5) Procurement Technician (not covered by SCA)
6) Supply Technician
7) Facilities Planner (not covered by SCA)
8) Facilities Engineer Technician (not covered by SCA)
9) Drafter/Cad Operator IV
10) Data Entry Specialist (not covered by SCA)
No, all labor categories are not currently being supported by all three current contractors. Please refer to solicitation amendment 0001, questions and answers.
** Information above supersedes Amendment 0001, Q48, A48 as Data Entry Specialist was not included in the list as exempted from SCA. Data Entry Specialist is another position exempted from SCA.**
Q.2 Reference Page 114 labor categories listed - if all 9 labor categories are NOT currently being supported, please identify those labor categories where no incumbent personnel currently reside.
A.2-There are ten (10) labor categories as described in A.1 above. Incumbent personnel are currently in place, but due to change in requirement their labor categories have changed in accordance with the SCA and according to their job description. There is a total of 76 FTES currently in place (please see attached list of FTE’s anniversary date who are currently employed).
Q.3 Reference VOL 2 (Technical) requirements - the solicitation calls out Part 4 and Part 5 as well Attachment (Technical Exhibit) 1 and Attachment (Technical Exhibit) 2 for the Logistics Division and its 3 Branches. Are we required to list and address every section in Part 4, Part 5, Attachment 1 and Attachment 2 in our technical response?
A.3-Please refer to Solicitation instructions in Addendum 52.212-1 and Solicitation Amendment 0001, “Questions and Answers” list and all other revisions. Also refer to this solicitation amendment 0002 and all revisions as well.
Q.4 If so, the 25 page limit will be challenging given there are Section Part 4 (4.1-4.17), Part 5 (5.1-5.5). Technical Exhibit 1 and Technical Exhibit 2 are the labor distribution by Branch, the work hours and labor categories while Technical Exhibit 2 is the labor descriptions. How detailed (in depth) is the Government looking for bidders to address TE1 and TE2?
A.4- Please refer to instructions in solicitation addendum 52.212-1, Factor 1. Technical Capability narrative paragraph, plus subfactor 1a. and 1b. Also, please refer to Solicitation Amendment 0001 “Questions and Answers” and all revisions in addition to this solicitation amendment 0002 and all revisions. Government cannot advise offerors how detailed (in depth) offerors should address technical factors TE1 and TE2. The 25 page limit stands.
Q.5 Reference: WD 15-5253 Rev 5 – EO 13706 – The Area Wage Determination establishes the requirement for Sick Leave for SCA based positions. Accounting for the 56 hours of annual paid sick leave, per FTE, the number of Productive Hours available per SCA position would be 1,864 instead of a standard 1,920 per year. Will the Government require 1,920 hours of performance per SCA position? Or will the Government update SCA positions in the Price Schedule to account for 1,864 annual productive hours?
A.5-The requirement will not be changed. The hours listed on the solicitation will be left as is.
Q.6 Reference: Option 1 – CLINS: SF 1449 Continuation Sheet – The Period of Performance for Option 1 occurs during a leap year. As such, will the Government update the Price Schedule to account for the extra day of performance?
A.6- The requirement will not be changed. The hours listed on the solicitation will be left as is.
Q.7 Reference: Volume 4 – Price – Will the Government require a cost narrative to accompany the Pricing submitted in Volume 4?
A.7-Please refer to solicitation instructions in Addendum 52.212-1 Factor 3. Price (Volume 4).
Q.8 Reference: Volume 4 – Price – Will the Government require a complete supporting cost file in Excel to show the Government how pricing was developed for each year of performance within Volume 4?
A.8- Please refer to solicitation instructions in Addendum 52.212-1 Factor 3.Price (Volume 4).
Q.9 Reference: Volume 4 – Price – Should the Government require back up supporting pricing from Offerors, and in the event subcontractor pricing is used, will the Government require subcontractors to provide un-sanitized pricing for review?
A.9- Please refer to solicitation instructions in Addendum 52.212-1 Factor 3.Price (Volume 4).
Q.10 Reference: Volume 4 – Price – Does the Government have a preference for how pricing should be rounded within Contractor extended prices? To the nearest whole Dollar or to the nearest one-hundredth decimal?
A.10 Nearest cent, nearest penny, or nearest hundredth decimal (i.e. $1.35).
Q.11-How will the Government address potential increases in wage determination hourly rates during the period of performance?
A.11-Please refer to FAR 52.222-41 Service Contract Labor Standards and 52.222-43 Fair Labor Standards Act and Service Contract Labor Standards-Price Adjustment (Multiple Year And Option Contracts).
Q.12-Question 20 and Question 25 provided answers that addressed the Past Performance - List of References. Per 52.212-1 requires that bidders provide: Company Name, Contract Value, Period of Performance, Point of Contact and Phone Number. There is no requirement for the bidders to provide a narrative discussion (per the Q&A). How will the Government determine list of references provided are relevant to the work being solicited for under W81K00-18-R-0012?
A.12- Amendment 0002 has been accomplished to correct this oversight. Addendum 52.212-1 was changed to require the number of FTEs and labor categories on the list of references (a sample is provided in Amendment 0002).
Q.13-Is a company allowed to bid as a subcontractor to more than one prime?
A.13- The Government does not get involved in prime/subcontractor relationships.
Q.14-Page 162 of 188 references the type of contract being awarded as: The Government contemplates award of a FIRM FIXED PRICE contract resulting from this solicitation. Item No 0001AA on the SF 1449 states "Payment will only be made according to actual hours worked." Shouldn't this be a Time and Materials contract as referenced below?
FAR 16.601 Time-and-materials contracts. A time-and-materials contract provides for acquiring supplies or services on the basis of– (1) Direct labor hours at specified fixed hourly rates that include wages, overhead, general and administrative expenses, and profit; and (2) Actual cost for materials.
A.14-This is a firm fixed price contract for a fixed number of hours at a fixed unit price. The government will not pay for unworked hours but this does not make it a time and materials contract. The contract type is firm fixed price and will not be changed.
Q.15- Will the contracting office provide the incumbent contractor's effective dates? Knowledge of the incumbent effective dates is necessary during the bidding process to ensure full costs are being accounted for since pay will be for actual hours worked therefore, the contractor cannot bill if the employee does not work. If an employee is eligible for 4 weeks of vacation based on their effective date the contractor will lose money if they do not account for the additional vacation costs in their bid. We respectively request the effective dates for each incumbent employee to properly bid the tasks.
A.15-Yes, it has been provided in Amendment 0002.
Q.16- Will the contracting office provide more specifics on the number of training holidays that occur per year since those days are also a loss of hours worked and affect the pricing? Below is the wording on training holidays in the
PWS.
“1.9 TRAINING HOLIDAYS. Throughout the year, the MTF observes several training holidays and they vary by fiscal year (FY). Upon notification of designated training holidays for the fiscal year and/or no later than 15 November of the contract year, the Contracting Officers Representative (COR) will provide the information to the Contractor. The COR will identify and inform the contractor of those departments and/or divisions that will be operational on the specified training holiday and the contractor shall provide names of employees who will work in departments and/or divisions that will be operational on the specified training holiday.”
A.16-Training Holidays occur before or after a major holiday such as the Friday after Thanksgiving, a day before Christmas, and a day before New Years Day. The contractor shall provide names of employees who will work in departments and/or divisions to ensure government oversight during Training Holidays and also names of those employees taking leave during Training Holidays.
Q.17-We understand that this requirement is a consolidation of 3 current contracts. Please advise which current contract is associated with which branch.
A.17-The current contracts are not set up per branch.
Q.18-Please provide a breakdown on the number of employees on the 3 current contracts.
A.18-List is provided in Amendment 0002.
Q.19-As per the night pay shift differential CLIN, hours worked between 1800 - 0600 receives a pay differential.
Please advise if there should be a pay differential for Warehouse Specialists starting work at 0530. If yes, please add a CLIN for Warehouse Specialist Night Diff.
A.19-The night differential CLIN has been removed completely from the solicitation and PWS. The changes made here in this paragraph supersedes previous information regarding night differential.
Q.20-Please advise if there is a hazardous pay differential. If yes, please advise the percent differential and the labor categories it applies to on the contract.
A.20- No, there is no hazardous pay differential.
Q.21-Can we utilize a subcontractor that has graduated from the 8(a) program?
A.21-The Government does not get involved in prime/subcontractor relationships.
Q.22-Can we utilize our major subcontractor's past performance in our proposal?
A. Yes.
Q.23-Has there been any change in the work scope from the current 3 contracts. If yes, please provide the changes.
A. No, the scope is the same.
Q.24-In order to comply with Reg. 29 CFR 4.173, please provide the employment start dates for all the workforce currently working on the 3 contracts.
A.24-List of current employee’s anniversary dates is included in Amendment 0002.
Q.25-As per the answer to question 63, there are 12 positions vacant on the contract. a. Please provide the labor category and number of personnel for each labor category that are vacant. b. Is the workload manageable with 70 FTEs on a 82 FTEs job?
A.25- As per new hires and updated information, there are currently 76 FTES and six (6) vacancies. This information is provided in the list of employee’s anniversary dates included in Amendment 0002. 82 FTE positions are required for the current requirement. This information regarding current number of FTEs in place supersedes previous information.
Q.26-We needed some clarity on Subfactor 2b. We understand that for Subfactor 2a, 3 PPQs need to be submitted between the Prime and Subcontractor; but for Subfactor 2b do we need to provide minimum 3 and maximum 5 customer point of contacts for each contract we submit for the PPQ, or do we need to submit minimum 3 and maximum 5 relevant contracts between the Prime and Subcontractor.
A.26-Both, 3 to 5 POCs and relevant experience (these could be the same references used for PPQ). Please refer again to instructions in solicitation addendum 52.212-1 Factor 2 Past Performance, 2b. Also, please see solicitation amendment 0002, Addendum to 52.212-1 Factor 2 Past Performance 2b. In addition, a sample is provided in Amendment 0002.
Q.27-For vendors who have a teaming arrangement in place. Will the government evaluate the past performance as 1 teaming entity or as prime/subcontractor?
A.27-Past performance will be evaluated for the teaming arrangement.
Q.28-Please clarify the meaning of Training Holidays listed in Section 1.9.
A.28- Please refer to Solicitation PWS Part 2, 2.1 Definitions, p. Training Holiday and Q.16, A.16 above.
Q.29-Please provide historical data on Training Holidays for previous years.
A.29-Please see A.16.
Q.30-If the contractors are not required to attend the training as per Section 1.9, are they expected to report to work?
A.30-Section 1.9 in PWS does not refer to training. Please refer to Q.28, A.28 and Q.16, A.16.
Q.31-Is there a government mandated percentage for night shift differential pay?
A.31-Night differential has been deleted completely from the solicitation.
Q.32-As per Section 4.3, "Contractor shall be responsible for providing safety equipment that is not provided by government as noted on Part 3, paragraph 3.1 (f) Safety Equipment. Safety steel toe shoes shall be provided by contractor to those employees working in areas that require safety steel toe shoes." but as per Section 4.4, "Government will provide protective gear, except for safety shoes as per OSHA requirement." Please advise the exact personal protective equipment that the contractors need to provide on the contract.
A.32-Contractor will be expected to provide Safety steel toe shoes (total of 69) for those employees working in safety/ hazardous areas (described in attachment 2/Technical Exhibit 2-Position Description).
Q.33-Will the government consider Key Personnel past performance as past performance for the Prime?
A.33-This question is unclear to the Government. Past performance will be evaluated for any teaming arrangement.
Q.34-Sections 5 refers to Attachments/Exhibits 1-Work Data and 2-Position Descriptions. In order to comply with the requirement of responding to each paragraph of Sections 4 and 5, must the contractor also address each of the paragraphs in the referenced attachments/exhibits?
Q.34-Please refer to Addendum 52.212-1 Factor 1. Technical Capability (Volume 2).
Q.35-The solicitation states this is a FFP contract; however, the solicitation also states, that “payment will only be made according to actual hours worked.” The latter seems to indicate that this is a Time and Materials (T&M) contract. Please clarify the nature of this contract as the solicitation language appears to conflict – creating an ambiguity.
A.35. Please refer to Q.14, A.14.
Q.36-In addition to the SF 1449, is the contractor required to provide a cost buildup for each CLIN?
A.36-Please refer to Solicitation instructions (and amendments) in Addendum 52.212-1, Factor 3. Price (Volume 4).
Q.37-The included Wage Determination requires three weeks of paid vacation after five years of service on the contract. Given that the current Logistics Support Services contract has been running for at least six years, can the Government provide what percentage of the contract staff has been working there for over five years (this information is critical for pricing, and if unanswered, gives the incumbent contractor an unfair advantage)?
Q.37. List is being provided in Amendment 0002 for all FTEs anniversary dates.
Q.38-The government asks for pre-employment health examinations - Can the government please specify what examinations must be included? (PWS 1.16).
A.38-The PWS has been revised in regards to paragraph 1.16 to provide instructions regarding immunizations requirements and how to obtain certificate clearance from Occupational Health Department. Also, “BAMC In- Processing Requirements” form is provided in Amendment 0002 which lists those immunization requirements.
Q.39-Will the government please specify which labor categories require safety steel toe shoes?
A.39-The labor categories that require steel toe shoes are described in the attachment 2/Exhibit 2. Position Description for each individual labor category. All positions requiring steel toe shoes are the Warehouse Specialist, Material Expediters, Quality Assurance Technicians, and Facilities Engineer Technicians. Total of 69 FTEs are required to wear steel toe shoes. This information supersedes previous information provided regarding steel toe shoes.
Q.40-Given the incumbent contract has been running for about six (6), a significant number of the incumbents may have been on the contract for over five years or will be over five (5) very soon after the start of the Administrative Support Services contract – Will the government please provide the anniversary dates of employment of all service employees?
A.40. List is provided in Amendment 0002.
Q.41-The Wage determination states a night time differential of 10% applies to Air Traffic Controllers. Does this same 10% night time differential apply to Material Coordinators for CLIN 1001AF?
A.41-There are no Material Coordinators listed in this solicitation. In regards to night differential, please refer to Q19, A19.
Q.42-Past Performance volume question: In order to demonstrate relevancy, is it acceptable to list the number and labor categories of personnel staffed in our submitted past performance references?
A.42-Yes. Also, please refer to Q12, A12 above.
Q.43-Reference: Immunization Requirements. Question: Must contract employees be immunized prior to starting work, or do we have a certain amount of time to get their immunizations in place?
A.43-Yes, contract employees must be immunized prior to starting work. Also please see changes to PWS paragraph 1.16 in Amendment 0002.
Q.44-Can the Government confirm if there is a requirement for a Program Manager and/or Alternate Program Manager - to manage the 82 contractors staffed on this contract?
A.44-It is up to offeror how they want to manage 82 FTEs and where they want to allocate this cost.
Q.45-Will the Government provide office space for the Program Manager and Alternate Program Manager?
A.45-Please refer to Amendment 0001 regarding this question. It is posted in the FBO site.
Q.46-Should the cost of the Program Manager and Alternate Program Manager should be priced as part of the contractor's overhead?
A.46- Please refer to Amendment 0001 regarding this question. It is posted in the FBO site. Also refer to Q44, A44 above.
Q.47-To ensure compliance with clause 52.22-17 Nondisplacement of Qualified Workers, can the government provide the anniversary dates of employment of each service employee under the contract?
A.47-Yes, list is provided in Amendment 0002.
Q.48-Does a HAZMAT differential apply to Material Expeditors? What is the differential percentage we should apply?
A.48-No, HAZMAT differential does not apply to Material Expediters.
Q.49-Page 66 “52.222-17 Nondisplacement of Qualified Workers Clause. To ensure all bidders submit reasonable prices that take into account the legally-mandated vacation time and benefits amounts that are due to qualified incumbent workers, can the Government please provide bidders with a list of qualified incumbent workers by labor category, quantity and anniversary dates of employment, so bidders can calculate their legally-mandated vacation and benefits, which are based upon the number of years they have worked in their current positions? The longer qualified incumbents have worked, the more vacation they are allotted by Department of Labor, so there is an impact on cost.
A.49- List is provided in Amendment 0002.
Q.50-Page 80, Liability Insurance. Although work is being performed in the facilities of a medical center, the nature of the work is warehouse, logistics and administrative only, without any labor categories of medical workers or health care providers. Can the insurance we provide be general liability insurance only, or do we still have to obtain a separate medical liability policy just for this contract? The Government’s decision in regard to this question has an impact on cost for all bidders.
A.50-Correct, general liability insurance can be provided. Clause 52.237-7 Indemnification and Medical Liability Insurance has been removed from solicitation as it pertains to non-personal healthcare services.
Q.51-Page 101, Section 1.13. Will information about Common Access Cards (CAC) in this section be changed to provide information about the DBIDS system instead, or are the CAC cards still used?
A.51-CAC Cards are still being used.
Q.52-Page 109, Section 4.9. The PWS states “Contractor shall maintain at least 95% fill rate as per attachment 1 ‘Workload Data.’” Different agencies and commands calculate fill rate using different mathematical methodologies.
In this case, by “95% fill rate,” does the Government mean at all times a minimum of 95% of 82 positions must be filled, which translates to 78 out of 82 positions? Or is there a different mathematical formula that should be applied to ensure compliance with the fill rate?
A.52-Correct, contractor shall maintain at a minimum 78 positions filled at all times.
Q.53-Attachment 4 - Performance Requirement Summary Matrix. For those Acceptable Quality Levels that reference non-percentage numbers, do those apply to an individual contractor employee, or apply across the full pool of employees? e.g., Under Personnel Appearance, “No more than 2 violations per month.” Is that no more than a total of 2 violations in a month across the pool employees, or does it refer to 2 violations in a month for any one employee?
A.53-This applies to each individual contractor employee.
Q.54-When evaluating a winning bidder’s price proposal for reasonableness, will the Government check to ensure the bidder included legally-mandated costs in their bid, specifically Worker’s Compensation, Federal Unemployment Tax (FUTA), State Unemployment Tax (SUTA) and the Health and Welfare amounts that get applied to hourly SCA wage determinations? We ask this because have found that some unscrupulous contractors are cheating the Lowest Priced Technically Acceptable (LPTA) system and winning contract awards by submitting bids that lack mandatory cost elements we all have to pay like FUTA, SUTA, etc., which means their bids are artificially low, unreasonable, and put them at risk of defaulting on the contract.
A.54-Please refer to Solicitation Addendum 52.212-2 regarding proposal evaluations in Factor 3. Pricing.
Q.55-Based on our conversation with select incumbent staff, it appears that a significant portion of contracting staff has been on the contract for five years or more. Can the Government confirm the incumbent staff seniority dates?
(Not having this knowledge gives incumbent contractors a significant price advantage, which may be unfair to other bidders).
A.55-Yes, a copy of the incumbent staff seniority dates list is provided in Amendment 0002.
Q.56-How much travel for pickups and deliveries does the Government anticipate under performance of this contract?
A.56-Three of the Material Expediters working in Supply Chain Management Branch will be assigned to drive 80% of the time and this will be on a rotational basis. For those Material Expediters working with Asset Management Branch, all usually will be driving 40% of the time as there is constant movement of shipping and storage, delivery etc. All Material Expediters should have a valid driver’s license class “C” and liability insurance as required by the state of Texas.
Q.57-PWS 3.5 states that the Government will provide initial testing at no cost, but the Contractor shall provide follow-up testing or reimburse the Government for such services performed within the MTF. Will this initial testing be completed as part of the in-processing and does this include any new hires throughout the life of the contract?
A.57-There is no PWS 3.5 paragraph. The Government is unclear on this question.
Q.58-Will there be a 254 be issued?
A.58-No, the work is unclassified; therefore form 254 will not be required.
