I-2 ADDED 52.204-27 Prohibition on a ByteDance Covered Application (Jun 2023) JUN/2023
(a) Definitions. As used in this clause
Covered application means the social networking service TikTok or any successor application or service developed or provided by
ByteDance Limited or an entity owned by ByteDance Limited.
Information technology, as defined in 40 U.S.C. 11101(6)
(1) Means any equipment or interconnected system or subsystem of equipment, used in the automatic acquisition, storage, analysis, evaluation, manipulation, management, movement, control, display, switching, interchange, transmission, or reception of data or information by the executive agency, if the equipment is used by the executive agency directly or is used by a contractor under a contract with the executive agency that requires the use

(ii) Of that equipment to a significant extent in the performance of a service or the furnishing of a product;
(2) Includes computers, ancillary equipment (including imaging peripherals, input, output, and storage devices necessary for security and surveillance), peripheral equipment designed to be controlled by the central processing unit of a computer, software, firmware and similar procedures, services (including support services), and related resources; but

(b) Prohibition. Section 102 of Division R of the Consolidated Appropriations Act, 2023 (Pub. L. 117-328), the No TikTok on Government
Devices Act, and its implementing guidance under Office of Management and Budget (OMB) Memorandum M-23-13, dated February 27, 2023, No
TikTok on Government Devices Implementation Guidance, collectively prohibit the presence or use of a covered application on executive agency information technology, including certain equipment used by Federal contractors. The Contractor is prohibited from having or using a covered application on any information technology owned or managed by the Government, or on any information technology used or provided by the Contractor under this contract, including equipment provided by the Contractors employees; however, this prohibition does not apply if the Contracting Officer provides written notification to the Contractor that an exception has been granted in accordance with OMB Memorandum M-23-13.

SECTION M - EVALUATION FACTORS FOR AWARD
M.1. EVALUATION CRITERIA FOR RANGE PRICING
(a) The total evaluated price will include the following:
(1) Basic CLINs 0011 through 0013, 0021 through 0023, 0031 through 0033, 0041 through 0043, 0051 through 0053 and 0061 through 0063.
(2) Option CLIN N/A
(3) Transportation costs if FOB Origin
(4) FAT costs, if applicable
(b) For CLINs with range pricing, the Government will calculate a weighted average unit price for each CLIN by multiplying the unit prices proposed for each quantity range by the below weighting percentages. The total evaluated price of each such CLIN will be based on multiplying the weighted average unit price by the yearly estimated CLIN quantities specified in Section B of this solicitation.
CLINS: All CLINs Listed Above
Quantity Range Weighting Applied to Unit Price
From 1 EA to 40 EA 30 %
From 41 EA to 99 EA 30 %
From 100 EA to 150 EA 20 %
From 151 EA to 200 EA 20 %
Total 100%
Offerors should note that the pricing of all offers will be carefully reviewed to detect offers that are unbalanced from range to range
(i.e. one or more ranges have pricing that is significantly over or understated as indicated by the application of cost or price analysis techniques). Unbalanced offers may be determined unacceptable. See FAR 15.404-1(g) for more information on unbalanced offers.
M.2 METHOD OF PRICE EVALUATION
(a) The unit price for each year will be multiplied by the estimated annual requirement for the corresponding year, and the results for each year added together to produce the evaluated price for the total maximum quantity. Based on this method of evaluation, award will be made to the responsible offeror whose offer represents the lowest evaluated price, or, if applicable, represents the Best Value to the Government as outlined elsewhere in this solicitation.
(b) If this solicitation contains quantities to be shipped FOB Origin, transportation cost will be evaluated as specified in paragraph
M.3 EVALUATION OF TRANSPORTATION COSTS in this Section, and award will be made to the responsible offeror whose offer represents the lowest evaluated price including transportation costs, or, if applicable, represents the Best Value to the Government as outlined elsewhere in this solicitation.
M.3 CONTRACTOR RESPONSIBILITY AND ELIGIBILITY FOR AWARD
