Question: If there are no changes to our proposal, do we need to resubmit any documents or just acknowledge the amendment and extend the validity of the current proposal?
Answer: If there are no changes, offers must, at a minimum extend the validity of their current proposal.
If submitting changes to a proposal, offerors must identify the changes (e.g. track changes, change pages, etc).
Question: Is the Government aware of the German Law ‐ Transfer of Business in Germany (TUPE / § 613a BGB) and that any successful offeror will likely be legally bound to continue to pay current salaries of the incumbent personnel?
Answer: Yes; however, the Government expects offers to have considered this issue with the submittal of their proposals.
Question: Will the Government publish the Incumbent salaries, as they do when US law (CBA and SCA) mandate a salary, so that the offeror may develop reasonable pricing?
Answer: No, the Government will not publish the incumbent salaries. The risk of performance, which includes salary negotiations rests with the contractor.
Question: If the government will not publish these legally mandated salaries, will they support an Economic Adjustment for the FFP CLINs post award, if the current salaries are above the Market Based salaries that an offeror used to develop their pricing?
Answer: No, the Government will not entertain an Economic Adjustment post award. The risk of performance rests with the contractor to include salary negotiations of the proposed staff.
