(a) Definitions. As used in this clause-- Internal confidentiality agreement or statement means a confidentiality agreement or any other written statement that the contractor requires any of its employees or subcontractors to sign regarding nondisclosure of contractor information, except that it does not include confidentiality agreements arising out of civil litigation or confidentiality agreements that contractor employees or subcontractors sign at the behest of a Federal agency.

(c) The Contractor shall notify current employees and subcontractors that prohibitions and restrictions of any preexisting internal confidentiality agreements or statements covered by this clause, to the extent that such prohibitions and restrictions are inconsistent with the prohibitions of this clause, are no longer in effect.
(d) The prohibition in paragraph (b) of this clause does not contravene requirements applicable to Standard Form 312 (Classified Information Nondisclosure Agreement), Form 4414 (Sensitive Compartmented Information Nondisclosure Agreement), or any other form issued by a Federal department or agency governing the nondisclosure of classified information.

As a result of this RFQ, the Government intends to award a Firm Fixed Price service contract to the small business whose quote conforms to the solicitation requirements and represents the best value IAW FAR Part 12, Acquisition of Commercial Items & Part 13, Simplified Acquisition Procedures. In determining which quote represents the best value, the Government intends to take the folowing action:
1. Quotes will be sorted according to price. The lowest priced quote will be evaluated first.
2. The Government will evaluate the offerors experience. In order to demonstrate adequate experience, interested parties should identify three (3) successful projects where they overhauled barriers comparable to DSC-501 or conducted repairs of a similar magnitude. Technicians shall provide proof of training on Delta Scientific systems.
3. The Government will evaluate the offerors Past Performance. The government may gather past performance information using any reasonable method to include, but not limited to, the use of Government and/or commercial databases (i.e. CPARS, FAPIIS).
If in the Governement’s opinion, the lowest priced offeror has submitted acceptable experience and agreeable past performance, the Government may determine that the particular offerors’ quote represents the best value without reviewing the technical or past performance of any other offeror. If, on the other hand, the Government discovers technical or past performance information that represents a significant concern, the Government may decide to evaluate the next lowest priced offeror’s technical and past performance, and so on until a quote is identified which in the Government’s opinion, represents the best value.
You must be registered at SAM.gov, return a signed copy of the solicitation, and acknowledge all amendments. Email quotes and related documents to Christina.Shorkey.1@us.af.mil and Nicholas.Bastiani.1@us.af.mil
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
