Commercial and Government Entity (CAGE) code means--

(1) An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Commercial and Government Entity (CAGE) Branch to identify a commercial or government entity;

or

(2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support and Procurement Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Commercial and Government Entity (CAGE) Branch records and maintains in the CAGE master file. This type of code is known as a NATO CAGE (NCAGE) code.

Predecessor means an entity that is replaced by a successor and includes any predecessors of the predecessor.

Successor means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger). The term “successor” does not include new offices/divisions of the same company or a company that only changes its name. The extent of the responsibility of the successor for the liabilities of the predecessor may vary, depending on State law and specific circumstances.

(b) The Offeror represents that it [____] is or [____] is not a successor to a predecessor that held a Federal contract or grant within the last three years.

(c) If the Offeror has indicated “is” in paragraph (b) of this provision, enter the following information for all predecessors that held a Federal contract or grant within the last three years (if more than one predecessor, list in reverse chronological order):

Predecessor CAGE code: ____ (or mark “Unknown”).

Predecessor legal name: ____.

(Do not use a “doing business as” name).

52.209-5 CERTIFICATION REGARDING RESPONSIBILITY MATTERS (OCT 2015)

(a)(1) The Offeror certifies, to the best of its knowledge and belief, that-

(i) The Offeror and/or any of its Principals-

(A) Are ( ) are not ( ) presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(B) Have ( ) have not ( ), within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks “have”, the offeror shall also see 52.209-7, if included in this solicitation); and

(C) Are ( ) are not ( ) presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in paragraph (a)(1)(i)(B) of this provision.;

and

(D) Have , have not , within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,500 for which the liability remains unsatisfied.

(1) Federal taxes are considered delinquent if both of the following criteria apply:

(i) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(ii) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(2) Examples. (i) The taxpayer has received a statutory notice of deficiency, under I.R.C. Sec. 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. Sec. 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(iii) The taxpayer has entered into an installment agreement pursuant to I.R.C. Sec. 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(iv) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).

(ii) The Offeror has ( ) has not ( ), within a three-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.

(2) Principal, for the purposes of this certification, means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager;

head of a division or business segment; and similar positions).

(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.

(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the certification will be considered in connection with a determination of the Offeror's responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.

(d) Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a) of this provision. The knowledge and information of an Offeror is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.

(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If it is later determined that the Offeror knowingly rendered an erroneous certification, in addition to other remedies available to the Government, the Contracting Officer may terminate the contract resulting from this solicitation for default.

52.209-7 INFORMATION REGARDING RESPONSIBILITY MATTERS (JULY 2013)

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The Government anticipates making one award from this solicitation. The following factors shall be used to evaluate offers:

(1) Award will be made based on the best overall (i.e., best value) proposal that is determined to be the most beneficial to the Government, with appropriate consideration given to the four (4) evaluation factors: The four (4) evaluation factors: Technical, Cost/Price, Past Performance and Small Business Participation.

To receive consideration for award, a rating of no less than “Acceptable” must be achieved for the Technical factor (to include all sub-factors). All non-priced factors combined are approximately equal in importance to cost/price. In the case of equal ratings, cost/price will be the deciding factor for award.

Offerors are cautioned that the award may not necessarily be made to the offeror with the lowest priced offer.

(2) Technical. Offerors shall include a Technical Proposal which demonstrates the ability to provide the full requirement of the Solicitation’s Statement of Work (SOW). Offeror’s Technical Proposals shall be clear, concise, and include all the information required by this SOW in sufficient detail for effective evaluation. The Technical Proposal should not simply rephrase or restate the Government’s requirements and specifications; but, rather shall provide convincing rationale to address how the offeror intends to meet these requirements and specifications. Phrases such as “will comply” or “standard techniques will be employed” in response to the Government’s specifications and requirements found in the SOW should be avoided. Technical Proposals shall include but not be limited to the following:

a. Narrative detailing how the Offeror will meet the requirements and specifications of the SOW and the Offeror’s ability to install the RADOME and associated equipment.

2. Provide a detailed graphical representation of each parameter (frequency vs parameter) as illustrated in paragraphs 3.8.5 to 3.8.15 and/or as described in each of the said paragraphs (See Paragraph 3.8.4.1 in the SOW).

3. Include a two (2) dimensional graphical representation of the total RF power loss (insertion loss and scattering loss) due to reflection, absorption, and scattering identified and presented by the Offeror, expressed as one way total RF power loss (dB) vs. frequency (MHz/GHz) for angles of incidence between 0 and 60 degrees at 5 degree increments for the proposed RADOME design. The Offeror’s Technical Proposal shall clearly show the RADOME design characteristics of insertion loss for the frequency range: 1.0 – 40.0 GHz.

Indicate the use of and type of estimations, worst or best case assumptions, analytical and/or measurement techniques used as supporting data, and methods for obtaining the insertion loss data included in response to this specification (See Paragraph 3.8.5 and 3.8.6 in the SOW).

4. Include a graphical representation of the expected antenna beam deflection/boresight error level for the proposed RADOME design. The data shall clearly show azimuth antenna beam deflection/boresight error expressed as error (mrad/degree) vs. scan angle expected in the proposed RADOME design for the frequency range 1.0 – 40.0 GHz (See Paragraph 3.8.7 in the SOW).

5. Change in the beamwidth degradation/error relative to free space shall be detailed and expressed in percentage (%) of variation. Indicate the use of estimations, worst or best case assumptions, analytical and/or measurement techniques used as supporting data and methods for obtaining the antenna beamwidth degradation/beamwidth error data included in response to this specification (See Paragraph 3.8.8 in the SOW).

6. Provide comments and additional media representation regarding the null depth change expressed in dB relative to a -30 dB null depth (See Paragraph

3.8.8 in the SOW).

7. Provide comments and additional media representation regarding the degradation of antenna sidelobes relative to a -25 dB sidelobe level expressed in dB (See Paragraph 3.8.10 in the SOW).

8. Provide the Cross Polarization Ratio expressed in dB (See Paragraph 3.8.11).

9. Include a graphical representation of the total Voltage Standing Wave Ratio (VSWR) due to characteristic impedance mismatches. The Offeror’s Technical Proposal shall clearly show the RADOME design characteristics of reflected RF Power in a 2 dimensional reflected power percentage vs. frequency graph for the frequency range of: 1.0 – 40.0 GHz (See Paragraph 3.8.12).

10. Provide two separate performance criteria to demonstrate the hydrophobicity of the RADOME’s hydrophobic coating.

Performance criteria A shall be described as the contact angle which is defined as the angle (degrees) between the tangent to the water drop surface at its contact point, to the surface

Performance criteria B shall be provided in the form of a 2 dimensional graph showing attenuation (dB) vs. frequency with a constant rainfall rate. The frequency range shall be 1.0 GHz to 40.0 GHz. The constant rainfall rate shall be held constant at 20 mm/hr (See Paragraph 3.8.12).

11. Include a value in degrees Kelvin for the RADOME noise temperature (See Paragraph 3.8.14).

Offerors are cautioned that “parroting” of the Technical requirements of the SOW with a statement of intent to perform does not reflect an understanding of the requirement or capability to perform. Offerors are responsible for including sufficient details to permit a complete and accurate evaluation of each proposal. Proprietary information shall be clearly marked.

Technical proposals will be evaluated on a pass/fail basis. To receive consideration for award, a rating of no less than “Acceptable” must be achieved for the Technical factors. Exceeding the technical requirements will not result in a more favorable evaluation since the overall technical evaluation will be Acceptable/Unacceptable.

(3) Past Performance. Past Performance will be a valid discriminator among the proposals received.

Offerors must submit three (3) examples of past performance in providing a turnkey Radome solution. The examples shall have been performed within the past three (3) years for the same or similar scope of work required in this solicitation. Past performance examples will be evaluated for recency, relevance, quality of performance.

(a) Recency of the offeror's past performance. Recency is generally expressed as a time period during which past performance references are considered relevant, and is critical to establishing the relevancy of past performance information

(b) Relevance is defined as fulfilling the same or similar requirement for the same or similar services under the same or similar circumstances. An example which is considered to be ideally on-point is one which satisfied the same technical requirement for the same quantity, provided to a Government customer, and within the same delivery timeframe as required under this solicitation. It is not required to submit examples which are ideally on-point; however, offerors should strive to provide those examples which are as relevant as possible.

(c) Quality is evaluated as overall customer satisfaction, including but not limited to:

performance of the services/supplies provided; timeliness of delivery; willingness to negotiate and accommodate changes; cost control; processing of warranty claims, performance of maintenance agreements; availability of general customer support
