PROVISIONS

TECHNICAL PROVISIONS

1. GENERAL: The intent and purpose of this Project is to provide dredging of approximately

12,054 linear feet of channel, generally 50 feet (ft) wide, and to -4 ft MLW in accordance with the approved Plans and Specifications and all requirements of the Contract Documents. The Work includes mobilization/demobilization, the mechanical and/or hydraulic removal of sediment as shown on the Plans and Specifications, acquisition and construction of temporary staging areas, the construction of necessary retention ponds and/or return water control structures, dewatering of sediment, loading sediment into Contractor provided sealed trucks, the transportation to and disposal of the dredged sediment at the Sarasota County Landfill facility, all erosion and turbidity control, turbidity monitoring and reporting, and final site cleanup (including any temporary staging areas) and restoration of any work area utilized in performance of the Work.

The Work to be performed is within relatively shallow, tidal segments of Phillippi Creek. Total Bid Price represents Contractor’s price to complete the Work as described in the Contract Documents. This includes, but is not limited to, utility and drainage structure conflicts that may require locating, modifying, extending or moving either existing utilities, drainage structures or the proposed work. The Contractor shall have no claim for additional compensation for utility or drainage structure conflicts encountered.

The estimated in-situ volume of sediment to be removed is approximately 63,827 cubic yards and is separated into volumes for each dredge segment in Table 1 below. The estimated amounts may be used to calculate a unit price in any contract modifications issued for an adjusted horizontal footprint of dredge area. The estimated volume shall not be used as a basis of payment for Lump Sum bid items. For excavation and dredging, the estimated volume is based on in-situ conditions and does not include any allowance for overdepth dredging, debris removal or material swell. The Contractor recognizes the potential for significant difference between the estimated in-situ material volume and the actual volume of material removed for final disposal. The Contractor is in agreement that no claim for delay or additional cost will be submitted to the County for any increase in the volume of material for final disposal.

Contractor shall determine the most cost-effective method of excavation or dredging (mechanical or hydraulic) and utilize load-out sites, temporary staging areas, and/or a confined staging area consistent with conditions in the Contract and Controlling Documents. Bid prices shall include the cost of Best Management Practices for pollution prevention including erosion, sediment and turbidity control.

If unable to obtain regulatory authorization within the required timeframe, the Contractor shall be required to dispose of dredge material at the Sarasota County Landfill. The Contractor shall not submit any claim for delay or additional costs incurred for not being able to use the alternative site and having to dispose of the material at the County Landfill. The Contractor shall be responsible for any severance fees imposed by the Florida Department of Environmental Protection.

Work completed by the Contractor, relative to this item, shall be included to the contract lump sum price for Bid Item 3.

8. QUANTITIES: The County has performed a pre-dredge survey which is included in the Contract Drawings. This pre-dredge survey was used to calculate the estimated quantity of material to be dredged (see Pricing Table Notes). This quantity is considered an estimate and is not the basis for payment to the Contractor. Payment for this Work shall NOT be based on the volume of material (cubic yards) removed from the Work area. The Contractor shall be compensated solely based on the lump sum bid price. Contractor shall make an assessment of this and any other relevant information necessary, in the judgment of the Contractor, in determining the expected volume to be removed. The Contractor recognizes the potential for significant difference between the estimated in-situ material volume and the actual volume of material removed for final disposal. The Contractor is in agreement that no claim for delay or additional cost will be submitted to the County for any increase in the volume of material for final disposal. The County will also perform a post-construction survey of the work area for verification and Final Acceptance and invoicing.

9. CHARACTER OF MATERIALS: The sediment testing and laboratory data for the Project are located in Soils Report Section . The results represent conditions at the time of the investigation. Debris may exist within limits of the Work and the Contractor shall make an interpretation of this information in determining the character of materials to be dredged. It should be expected that some large and small debris that are not indicated in the sediment testing or Contract Drawings may exist within the limits of the Work. Types of debris that may be encountered include but not limited to stumps, rocks, rock fragments, roots, logs, trash, vegetation, etc. All classifications of soils, both visual and laboratory, are in accordance with the Unified Soils Classification System, compatible with ASTM D-2487.

This information is provided by the County for use by the Contractor, however, Contractor is responsible for conducting its own investigation of the character and type of material expected to be encounter during the Work.

10. DREDGING SURVEYS: The County will furnish survey control data for the dredge area prior to any dredging activity. The County will be responsible for pre-, stake-out, and post-construction survey work under this Contract for the terms of acceptance and completion of Work. Cross-sections will be prepared showing dredge surface and design template. The Contractor will be notified when survey work is to be completed, and will be permitted to accompany the survey party at any time. The Contractor, at their own expense, is authorized to perform verification or supporting surveys, within the Project limits, during the bidding or execution of the Work.

11. CROSS-SECTION: The Contractor shall dredge and excavate the Project area to a depth of -4 feet MLW and a channel bottom width of generally 50 feet (as described on the plans). No excavation shall be performed closer than 10 feet from any seawalls, docks, boat-lifts or any other structure.

Work completed by the Contractor, relative to this item, shall be included to the contract lump sum price for Bid Item 2.

12. ROCK EXCAVATION: For purposes of this Contract, “rock” applies to any naturally occurring bed of hard cemented material, which cannot be excavated with the equipment used for dredging bottom sand and silt under this Contract. It is defined as material that is so hard or tightly cemented that a drop punch or other mechanical means is necessary to break up the material prior to it being removed by the dredging equipment. However, the Contractor shall be prepared to complete the Work while dealing with rock fragments, rock pieces, etc. within the dredge material.

The intent of this Contract is “maintenance dredging” to restore conveyance capacity of the Creek. Should rock be encountered, the County may direct the Contractor to allow the material to remain or to excavate to a lesser width or depth, thus minimizing the removal of rock material. The primary consideration in such cases will be the effect on navigation. Any rock excavation work must have County approval to proceed, at an agreed upon price and at the issuance of a change order.

13. NAVIGATION AIDS: The Contractor shall not be responsible for installing, replacing, or otherwise altering existing navigational aids as part of this project. The Contractor shall be responsible for notifying the USCG of the project start date in a timely manner to support Contractor’s schedule and shall coordinate with the USCG for the completion of this activity.

Work completed by the Contractor, relative to this item, shall be included to the contract lump sum price for Bid Item 1.

14. TURBIDITY CONTROL The Contractor shall furnish all labor, materials, and equipment, and perform all activities required to maintain turbidity control. Turbidity control shall be used as required by the Project permits and Section XVIII of the contract documents. The Contractor shall ensure turbidity control devices (i.e., turbidity curtains) will be maintained and remain in place for the duration of the Work. The Contractor will be responsible for ensuring that turbidity control devices are inspected daily and maintained in good working order so that there are no violations. Contractor shall clean out and properly dispose of any debris that may accumulate in all turbidity control devices on a weekly basis and after every rain event. Work completed by the Contractor, relative to this item, shall be included to the contract lump sum price for Bid Item 2.

15. TURBIDITY: The Contractor shall furnish all labor, materials, and equipment, and perform all activities required to obtain, analyze, and report the results of turbidity monitoring.

Monitoring of turbidity will be conducted using a device (turbidity meter) that meets the required specifications for conducting such tests as provided in the Project permits and Section XVIII of the contract documents. Upon request, the Contractor will make available to the County a copy of the operating instructions and standards used in calibrating equipment used in collecting samples for turbidity. Work completed by the Contractor, relative to this item, shall be included to the contract lump sum price for Bid Item 2.

16. TURBIDITY MONITORING REQUIREMENTS: Sampling shall be conducted in accordance with techniques and procedures described in Section XVIII of the contract documents. Samples obtained for turbidity analysis shall be analyzed within 30 minutes of collection. Samples shall be taken with equipment that does not allow contamination by water from any other depth. The Contractor will immediately notify the County of any turbidity samples that exceed permit limits. A report of all turbidity samples and results shall be submitted weekly to the County.

17. TURBIDITY TESTS: The Contractor will maintain a certification, attesting to the accuracy of testing equipment and procedures. A duplicate of the standard used to calibrate the testing instrument as well as a complete set of operating instructions for the turbidity testing equipment will be made available at the County’s request. The Contractor will use this standard throughout the project to maintain the calibration of the equipment. Whenever there is doubt as to the adequacy of the testing or validity of the results, the County may request that additional tests be performed. The Contractor shall be responsible for any costs associated with requested additional testing and the County will withhold these costs from the next pay request submitted by the Contractor.

18. SIGNAGE:

a. Temporary signs concerning manatees shall be posted prior to and during all construction/dredging activities. A sign measuring at least three feet by four feet which reads “Caution: Manatee Area” shall be posted in a location prominently visible to water related construction crews. A second sign shall be posted if vessels are associated with the construction and shall be placed visible to the vessel operator. The second sign shall be at least 8 1/2 inches by 11 inches and read:

Caution: Manatee Habitat. Idle speed is required if operating a vessel in the construction area. All equipment must be shutdown if a manatee comes within 50 feet of the operation. Any collision with and/or injury to a manatee shall be reported immediately to the FWC Hotline at 1-888-504-FWCC (1-888-504- 3922). The U.S. Fish and Wildlife Service should also be contacted in Jacksonville (1-904-232-2580) for North Florida or in Vero Beach (1-772-562- 3909) for South Florida.
