About this file
This is a Commodity Supplemental document for the State of Maryland's Invitation for Bid (IFB) 2276 for Heated Pantographs, effective July 2024. The document outlines additional procurement requirements and specifications applicable to this solicitation. The solicitation does not include mercury-containing products and encourages bidders to offer environmentally preferable products (EPPs) to the greatest extent practicable. Award will be made by line item to the responsive and responsible vendor offering the lowest price, as determined by the Procurement Officer to be in the State's best interest. Delivery must be made FOB Destination to specified locations on or before the date specified in the bid, with all materials required to conform to federal and state laws, regulations, and solicitation specifications. The State reserves the right to reject defective materials or those failing to meet specifications, and the contractor must promptly replace rejected materials or be liable for excess replacement costs.
Pricing escalation is not applicable to this contract. Unit prices quoted by the contractor will be used to calculate compensation for any authorized extra work or credits for omitted work, with such prices including all labor, materials, removal, overhead, profit, and insurance. The State is exempt from federal excise taxes and Maryland sales and use taxes, though this exemption does not apply when the contractor furnishes and installs materials in construction or improvement of real property. All materials, equipment, and services must comply with the Federal Noise Control Act of 1972, applicable Occupational Safety and Health Act standards, and EPA requirements. Contractors are entitled to recover reasonable compensation for goods shipped in accordance with authorized orders that meet all contract requirements but are returned by the agency for reasons other than contractor failure. Additionally, the State reserves the right to request quarterly sales data on recycled content, third-party sustainability certifications, and other environmental attributes of products sold under this price agreement.
