About this file

This document is an Indian Health Service Buy Indian Act Indian Economic Enterprise Representation Form required for solicitation responses.

The form serves as a self-certification mechanism for offerors to declare whether they meet the definition of an "Indian Economic Enterprise" (IEE) under 25 U.S.C. 47 and HHSAR 326.601. Offerors must meet the IEE definition at three critical junctures: when submitting an offer, at the time of contract award, and throughout the entire contract performance period. Any change in eligibility status during these periods requires immediate written notification to the Contracting Officer. The form applies to Sources Sought Notices, Requests for Information (RFI), and formal solicitations. Successful offerors claiming IEE status must be registered with the System of Award Management (SAM) and may be subject to eligibility documentation requirements and protest procedures. The form includes a representation section where offerors check whether they do or do not meet the IEE definition with Indian Ownership, and requires completion of fields identifying the Federally Recognized Tribal Entity, business name, 51% owner name, Unique Entity Identifier (UEI) number, and a certifying signature. False or misleading information submitted in support of a Buy Indian Act set-aside contract award constitutes a violation under 18 U.S.C. 1001, while false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287.
