About this file
This document is a Modified Provision for a state contract involving 3M Company and the State of Arizona, specifically addressing modifications to a solicitation for traffic control sign materials and related products. The modifications appear to be part of a contract negotiation process, with revisions made to various sections including Scope of Work, Warranty on Products, Contract Administration and Operation, Delivery Time, and Insurance Requirements.
The contract covers traffic sign making materials with specific warranty requirements for different types of sheeting, films, and inks. 3M provides detailed warranty information for various product lines, including Type I, Type III, Type IV, and Type XI materials, with warranted life periods ranging from 12 months to 10 years depending on the specific product. The document outlines pricing terms requiring 3M to maintain the best pricing through quarterly reporting, with provisions for adjusting contract pricing if better pricing is identified. Delivery time has been modified to 45 ARO (After Receipt of Order), and 3M has agreed to provide a 30-day cancellation or non-renewal notice for self-insurance coverage. The contract appears to be focused on providing high-quality traffic sign materials with comprehensive warranty and pricing protections for the State of Arizona.

SECTION 2.0 : Contract Administration and Operation, page 11
2.1.1. That price-plus-discount equivalence (“Contractor’s Best Pricing”) is intended to be irrespective of whether or not those other sales have special purchase terms, conditions, rebates or allowances.
2.1.2. If Contractor’s Best Pricing for equivalent services, items of equipment and materials is better than the Contract Pricing, then Contractor agrees to adjust the Contract Pricing to match the Contractor’s Best Pricing for all sales related to the Contractor made after the date when the Contractor’s Best Pricing was first better than the Contract Pricing.
2.1.3. For clarification of intent, that date is intended to be the date when the difference first occurred, which might have been before the difference was first identified. If it was before, then Supplier agrees to charge at less than the Contract Pricing until the extended difference that would have been realized (i.e., if the Contractor’s Best Pricing had been applied when it should have been) has been settled.
Modified provision
3M will maintain Contractor's Best Pricing through the current quarterly reporting requirements. Discussions will focus on State of Arizona and Poly Sub usage and contract needs. Any discrepancies will be addressed and any pricing issues will be closed out immediately. Additionally, at yearly renewal a review of Best pricing will be conducted.
SECTION 2-C Page 36 Delivery Time. Unless stated otherwise in the Commercial Document generally or in the applicable Order particularly, Contractor shall make delivery within 2 (two) business days after receiving each Order.
