c. For offers submitted by e-mail in accordance with L-0004 L2.11-4 E-MAIL PROPOSALS (DLA ENERGY OCT 2010). The e-mail address is BulkFuelsBidCustodian@dla.mil.
d. The Bulk Offer Entry Tool (OET). Use of the Bulk OET is optional for this solicitation. The current version of the Bulk OET does not replace the Bulk Fuels Offer Submission Package (OSP) in its entirety. Use of the Bulk OET will allow your offer to be imported directly into the Bulk Bid Evaluation Model (BEM). You will still need to complete those portions of the OSP as indicated by the Contracting Officer in the instructions included with the solicitation. In order to utilize the Bulk OET, you must first establish a Bulk OET account using the DLA Accounts Management and Provisioning System (AMPS). You can access AMPS at https://amps.dla.mil/oim where you can either create a new AMPS account or log in using your existing account (you will be asked to provide your CAGE code when creating a new AMPS account). Once you have established an account in AMPS, you will need to request the following role: “OET Prod – Vendor Offer Submission Role OET-100.” To select this role, you will first choose ‘Energy Applications’ then ‘Energy OET’ under the Browse Roles by Application tab. When applying for this role, please include your company name and the purchase programs you typically offer under in the notes or comments section of the application. Also, when applying for Bulk OET – you MUST include every CAGE code you intend to use to submit offers in the ‘notes’ section of the initial role request. Once your role has been approved, you will be provided with a user name and password that can be used to log into the Bulk Fuels OET at: https://offerwizard.dla.mil/bulkoet/bulkoet.html. If you experience difficulty in establishing an account, you can contact the DLA Energy Bulk Technical Team at DESC.BTechTeam@dla.mil for assistance.
4. Offerors are advised to complete and submit, as your offer, the original plus 1 copy of all forms contained in the accompanying Offer Submission Package in accordance with FAR 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS (BULK)(TAILORED)(DLA ENERGY JUL 2013). Copies of all documents submitted must be the same as the original. Offer must be signed by an authorized negotiator. [K-0007 K33.01 AUTHORIZED NEGOTIATORS (DLA ENERGY APR 2007) in the Offer Submission Package].
5. 52.211-9073 DETERMINATION OF QUANTITY (DLA ENERGY) (NOV 2011) – DLAD has been incorporated. All offerors are advised to review this clause for understanding of how quantities will be determined under any resultant contract.
6. NOTICE TO SMALL BUSINESS CONCERNS: Prior to offering on the requirements solicited in this Request for Proposal (RFP), you are requested to review FAR 52.219-7 NOTICE OF PARTIAL SMALL BUSINESS SET-ASIDE (DEVIATION) (JUN 2013) (DEVIATION NUMBER 2011-D0001); FAR 52.212-5 CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS – COMMERCIAL ITEMS (JAN 2014); and 52.212-1 INSTRUCTIONS TO OFFERORS – COMMERCIAL ITEMS (BULK) (TAILORED) (DLA ENERGY) (JUL 2013) to ensure an understanding of the criteria for qualifying for the socioeconomic programs set forth herein. The contact for questions regarding Small Business Affairs is Mr. Gregory Thevenin, (703) 767-9465 or (800) 523-2601.
7. NOTICE TO POTENTIAL SMALL BUSINESS OFFERORS: Based on an agreement between the DLA Energy and the Small Business Administration (SBA), SBA processes Certificate of Competency (COC) referrals prior to DLA Energy’s determination that a small business concern is an apparently successful offeror. Because of the multi-step nature of the evaluation process, delaying the COC referral of a non-responsible small business concern until it has been determined to be an apparently successful offeror could result in late awards, and significantly impact DLA Energy's support of the Military Services’ fuel requirements.
8. Dealers (non-manufacturers) must obtain a firm supply commitment letter in accordance with L-0001 L2.07 EVIDENCE OF RESPONSIBILITY (DLA ENERGY JAN 1998) (see Addendum Package).
9. NOTICE: Any award to a contractor, who, at the time of award, was suspended, debarred, or ineligible for receipt of contracts with Government agencies or in receipt of a notice of proposed debarment from any Government agency, is voidable at the option of the Government.
10. Registrations, representations, and certifications currently maintained electronically at the ORCA website (http://orca.bpn.gov), Centralized Contractor Registration (CCR) database (http://www.ccr.gov), and the Excluded Parties List System (EPLS)(https://epls.gov) have been switched to SYSTEM FOR AWARD MANAGEMENT (SAM) at www.sam.gov or by dialing (866) 606-8220. [SEE FAR 52.204-13 SYSTEM FOR AWARD MANAGEMENT (JUL 2013) FOR ADDITIONAL INFORMATION].
11. ACCELERATED / PREPAYMENT TERMS: Offerors are encouraged to propose alternate payment terms, to include prepayment or accelerated payment (less than Net 30 days), which will be considered during negotiations. Alternate payment terms will not be included as an evaluation factor/sub-factor in determining best value awards.
12. The following Rocky Mountain, West Coast and Offshore JP8, JP4, JP5, Jet A, Jet A 1 and F76 requirements will escalate with their respective region's economic price adjustment (EPA) formula provided in 52.216-9069 ECONOMIC PRICE ADJUSTMENT - PUBLISHED MARKET PRICE DOMESTIC BULK (NOV 2011). Offerors should specify the respective commodity EPA escalator(s) to which their offer price is tied. FOB Origin offers will be evaluated solely to the EPA escalator(s) specified.
13. The ordering period is Date of Award through September 30, 2016 – See F-0002 F1.08, DELIVERY AND CONTRACT PERIODS FOR PIPELINE AND TANK TRUCK DELIVERIES (DOMESTIC BULK) (DLA ENERGY NOV 2011), F-0003 F1.08-1, DELIVERY AND CONTRACT PERIODS FOR TANK TRUCK DELIVERIES (DOMESTIC BULK) (DLA ENERGY JAN 2012), and F-0004 F1.08-3, DELIVERY AND CONTRACT PERIODS FOR TANKER AND BARGE DELIVERIES (DOMESTIC BULK) (DLA ENERGY JAN 2012).
14 The delivery period for all items is October 1, 2015 through September 30, 2016 with a thirty-day carryover - See I-0007 I86.12, DELIVERY - ORDER LIMITATIONS - SCOPE OF CONTRACT (BULK) (DLA ENERGY NOV 2011).
15. ADDITIVES: For each line item, the schedule identifies additive requirements for the receipt mode for product offered on an FOB origin basis. Any product offered via common carrier pipeline shall not contain FSII or SDA, unless specified otherwise in the schedule. Product offered on an FOB destination basis to an end user by any receipt mode is required to have all additives required by the product specification. The product specification also identifies the additive levels required in all product(s).
16. For line items of which a portion is set-aside for Small Businesses or 8(a) firms, the volume is denoted after the "SA Quantity" or "8A Quantity" subheading on the Quantity line. This quantity is a portion of the total requirement stated for that line item and not in addition thereto.
17. Section 1: A. Origin Offer Card on page 2 of the OFFER SUBMISSION PACKAGE (OSP-2) must be used for FOB origin offers. B. Destination Offer Card on page 2 of the OFFER SUBMISSION PACKAGE (OSP-2) must be used for FOB destination offers.
18. Unless otherwise stated for the given modes of transportation under each line item, the receipt percentage (%) will be 100%.
19. All volumes are stated in U.S. Gallons (USG).
20. FOR JP5 AND F76: FOB destination tanker offers are not acceptable. FOR Jet A: FOB destination tanker offers and FOB destination ocean-going barge offers are not acceptable, except for those locations specifically identified in the solicitation schedule. An “ocean-going barge” is defined as a vessel transiting via ocean channels. Minimum and maximum parcel sizes and port restrictions are identified in the schedule. All Barge offers are restricted to FOB destination.
21. FOR JP4 and JET B: Except for the requirement at Eielson AFB, offers for either JP4 or Jet B with additives will be accepted. Offers of Jet B with additives will be evaluated against JP4 offers. Only offers for JP4 shall be evaluated at Eielson.
22. Contractors in the LA Basin are encouraged to provide Jet A and JP-5 directly into the Kinder Morgan pipeline via Watson Station or ATSC terminal vice DFSP Carson.
23. Any products offered via common carrier pipeline shall not contain FSII unless specified otherwise.
24. DLA Energy/MSC tankers are not equipped with vapor recovery systems.
25. For M-0008 M41.04 EVALUATION OF OFFERS INVOLVING OTHER THAN F.O.B. TANKER (BULK) (DLA ENERGY JUL 2010), tank truck rates used in the BEM are those in effect at the time of receipt of initial offers including the fuel surcharge in effect at that time. The applicable surcharge, now based on mileage instead of percent of line haul cost, will be provided via amendment after receipt of initial offers. Offerors wanting to review information on weekly rate changes resulting from fuel surcharges may do so at the Surface Deployment and Distribution Command website at: http://www.sddc.army.mil/Public/Global%20Cargo%20Distribution/Domestic/Fuel?Summary=fullcontent <http://www.sddc.army.mil/Public/Global%20Cargo%20Distribution/Domestic/Fuel?Summary=fullcontent> .
26. Destination transportation rates are firm and fixed for the life of the resultant contract.
27. For deliveries in California, Oregon and Washington, all JP-5 will have a minimum Flash Point of 62.5 degrees C.
