1. The changes set forth herein are incorporated into Solicitation SPE600-15-R-0409.

Summary of requirements

2. Page 3, requirement, has hereby been updated as follows:

Minimum Annual Production by Contractor shall be:

• 187,000,000 kWh in total to Bases in PEPCO service territory, and

• 51,000,000 kWh in total to the Base located in BGE service territory

Contractor shall be expected to annually supply renewable energy in the amount of 249,333,334 kWh in total to Bases in PEPCO service territory and 68,000,000 kWh in total to the Base located in BGE service territory.

Such quantities will result in meeting offsite renewable facility annual supply requirements of at least 187,000,000 kWh within PEPCO and 51,000,000 kWh BGE service territories (reference C.8). NOTE: where the annual supply requirements are equal to 75% of the Expected Annual Production (reference C.4.1).

3. Page 8, definitions, “New Renewable Generation” has been hereby updated as follows:

“New Renewable Generation” means a renewable generation resource must not be or ever have been previously placed in service at the time that the Notice of Intent to Award is issued from which the Department of Navy is the first off-taker of electrons upon project Commercial Operation Date. In the case where the proposed facility is part of a larger facility, only the new capacity generation would qualify and the proposed facility must be sub-metered such that the energy produced and delivered to the Government can be verified.

Section B

4. Page 12, B.1.2 CLIN Description, Firm Fixed Price Transaction Fee has been hereby updated as follows:

Offeror’s shall propose a transaction fee per kWh for all energy generated, supplied, and delivered through PJM. The price offered for these CLINs shall be the same for the entire term. For any conventionally generated electricity, offeror shall comply with C.17.

5. Page 17, C.4.1 Minimum Annual Production has been hereby updated as follows:

Minimum Annual Production is equal to the lesser of 75% of the Contractor’s Expected Annual Production or the Minimum Purchase Guarantee by the Government and the Contractor shall comply with this requirement at all times.

6. Page 18 and 19, C.8 Offsite Renewable Facility has been hereby updated as follows:

The Contractor shall secure a facility outside of the Installations to construct, operate, and maintain a REGS for the purpose of generating renewable energy capable of annual renewable energy production of at least 187,000,000 kWh distributed to Installations within Pepco and 51,000,000kWh distributed to the Installation served by BGE. To be eligible for consideration, the proposed facility must not be or ever have been previously placed in service at the time that the Notice of Intent to Award is issued must allow for the Department of Navy to be the first off-taker of electrons upon project Commercial Operation Date. In the case where the proposed facility is part of a larger facility, the proposed facility must be sub-metered such that the energy produced and delivered to the Government can be verified.

7. Page 27, G.2 Funding has been hereby removed and “Reserved” for future.

8. Page 29, G.6 Annual Reconciliation has been hereby updated as follows:

In the event the Contractor does not produce from the REGS the lesser of 75% of the Contractor’s Expected Annual Production or the Minimum Purchase Guarantee by the Government, or the Contractor fails to deliver the necessary conventionally generated energy, then the Contractor will be subject to cure processes under C.4.6. in default. Any renewable energy in excess of the Navy’s total requirement can be sold into the marketplace.

Section L

10. Page 79, L.4.1.6 has been hereby added as follows:

Assumptions will be considered by the Government solely for evaluation purposes. Unless identified as an exception in accordance with the Solicitation Section L.4.2.10, and accepted as such by the Contracting Officer, assumptions will not be deemed to be a part of any resultant contract and will not form the basis for any pricing adjustments.

Section M

11. Page 89, M.1.4.1 has been hereby updated as follows:

The Government will rate each subfactor independently and on a UDC basis. Each subfactor will be rated independently, and Only those offerors with Acceptable ratings or higher within a UDC offering for each subfactor, will be considered for award for that UDC. The offeror’s technical solution will be rated separately from the risk associated with its technical approach. The technical rating evaluates the quality of the offeror’s technical solution for meeting the Government’s requirement. The risk rating considers the risk associated with the technical approach in meeting the requirement and assesses the degree to which the offeror’s proposed technical approach for the requirements of the solicitation may cause disruption of schedule, increased costs, degradation of performance, the need for increased Government oversight, or the likelihood of unsuccessful contract performance.
