Requirements
The Government seeks a Contractor to fulfill 100% of installation electrical energy requirements, maximizing the consumption of electricity generated from new renewable energy resources. Renewable energy will be generated by a new off-site Renewable Energy Generation System (REGS). Installations are listed below. Annual quantities of renewable energy delivered by the Contractor shall be
In Potomac Electric Power Company (PEPCO) service territory:
Joint Base Anacostia-Bolling, National Naval Medical Center Bethesda, Naval Maritime Intelligence Center, Washington Navy Yard, United States Naval Observatory, NSA North Potomac Carderock.
In Baltimore Gas and Electric (BGE) service territory:
U.S. Naval Academy Annapolis.
Contractor shall be expected to annually supply renewable energy in the amount of 249,333,334 kWh in total to Bases in PEPCO service territory and 68,000,000 kWh in total to the Base located in BGE service territory. Such quantities will result in meeting offsite renewable facility annual supply requirements of at least 187,000,000 kWh within PEPCO and 51,000,000 kWh BGE service territories (reference C.8). NOTE:
where the annual supply requirements are equal to 75% of the Expected Annual Production (reference C.4.1).

3. Page 6, the definition for “Blended Contract Unit Price” is hereby updated as follows:
“Blended Contract Unit Price” means the total price in any given year of CLIN 0001/0005 Renewable Energy (with RECS), CLIN 0002/0006 Firm Fixed Price Transaction Fee, and CLIN 0003/0007, the estimated sum of Other Market Charges. The blended price reflects the Firm Fixed Commodity Price for the RESA, the Firm Fixed Price Transaction Fee, and Other Market Charges. These prices are calculated in Section J, Attachment 2, Production and Pricing Worksheet.
4. Page 8, the definition for “Maximum Contract Unit Price” is hereby updated as follows:
“Maximum Contract Unit Price” in the first Contract year is equal to $0.07765 per kWh for Potomac Electric Power Company (PEPCO), $0.07940 per kWh for Baltimore Gas and Electric (BGE) and in subsequent years is equal to the value of $0.07765 and $0.07940 respective to each UDC escalated annually at 2% for that same term (see Attachment 2 for a Table of Maximum Contract Unit Price values).

6. Page 12, B.1.2 Other Market Charges, the following paragraph is updated as follows:
Other Market Charges, as shown in Section B.1.3 incurred by the offeror for delivery of energy under either the FFP Renewable Energy CLINs that are separate from the FFP shall be firm fixed at the same price for the first 2 years and will be passed through directly to the Government for years 3-20. Offeror will be required to cooperate with the Government to fix certain market based pass-through costs for the purpose of minimizing costs and/or volatility.

STATE RENEWABLE PORTFOLIO STANDARD OBLIGATIONS SATISFIED THROUGH A
REDUCTION IN RENEWABLE ATTRIBUTES, the following paragraph is updated as follows:
The Government will entertain innovative approaches by the Contractor for the RPS compliance by utilizing the REGS Environmental Attributes to satisfy this requirement. Contractors are encouraged to submit an alternative to avoid the pass-through cost. The price shall be firm fixed at the same price for the first 2 years and will be passed through directly to the Government for years 3-20.

8. Page 17, C.3 Minimum Purchase guarantee by Government is hereby updated to remove the following:
The Government shall purchase annually beginning on the Commercial Operation Date a minimum of 238,000,000 kWh of renewable electricity that is comprised of a minimum of 187,000,000 kWh for the Pepco Installations and 51,000,000 kWh for the BGE Installation. If the Government does not purchase the minimum requirement for either or both Pepco and BGE as a result of a non-Force Majeure event and provided that the Government’s inability to consume the Minimum Purchase Guarantee was not due to the Contractor’s inability to deliver the energy to the Point of Delivery, then the Government shall pay the Contractor an amount equal to the Pepco shortfall, if any (187,000,000 kWh), or the BGE shortfall, if any (51,000,000 KWh), multiplied by the Contract Unit Price. Reference Section J, Attachment 2 “Minimum

Purchase Guarantee Worksheet”. This guarantee is contingent on the Contractor meeting the requirements of C.4 Minimum Guarantee by Contractor.
9. Page 16, C.4.2 Production that Exceeds the Minimum Annual Production is hereby updated to remove the following:
Contractor will offer any renewable energy produced in excess of the Minimum Annual Production to the Government and the Government shall purchase said energy under the terms and conditions of that Contract Year provided that the Government requires the energy. at the time it is offered.
Any renewable energy in excess of the Navy’s total requirement can be sold into the marketplace.

(a) In accordance with sections 744 and 745 of Division E, Title VII, of the Consolidated and Further Continuing Appropriations Act, 2015 (Pub. L. 113-235), none of the funds made available by this or any other Act may be used to enter into a contract with any corporation that---
(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless the agency has considered suspension or debarment of the corporation and made a determination that this further action is not necessary to protect the interests of the Government: or
(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless the agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.
(b) The Offeror represents that—

Section L
12. Page 85, Note 2 has hereby been added to L.5.4 Volume IV: Factor 4— Price Proposal as follows:
Note 2: Wage rates will apply to the 1 year construction period of this procurement. The solicitation will be amended to incorporate the formal wage determinations as a mandatory requirement after issuance of the NOITA when it is determined which county’s wage rates will apply.
13. Page 86, L.5.4.3 Organization (b) has been updated as follows:
(b) Section 1 – Schedule B-1 Include a completed copy of the Production and Pricing Worksheet, Attachment 2. The proposed dollars per kWh price shall be carried out to the fifth decimal place. Proposals that exceed the Contract Maximum Values as stipulated in Attachment 2 Production and Pricing Worksheet will not be accepted. Any Pricing and Production Worksheets submitted where the formulas have been manipulated will be found unacceptable.

14. Page 89, M.1.4.1a Subfactor 1: Renewable Energy Production is hereby updated as follows:
An offeror’s proposed Minimum Production Guarantee must meet or exceed a minimum of 187,000,000 kWh for the Pepco Installations and/or 51,000,000 kWh for the BGE Installation of renewable electricity in every contract year post acceptance, with the exception of the construction period.
15. Page 90, M.1.7 Factor 4 – Price is hereby updated as follows:
The Government will evaluate all information provided in support of each CLINs offered price to determine if the costs reflect a clear understanding of the Government’s requirements; are consistent with the various elements of the offer’s proposed scope of work and are neither excessive nor insufficient for the work effort to be accomplished. The calculated Blended Contract Unit Price in Columns I and J of Attachment 2 must be within the Government’s setting of its acceptable first year rate of $0.07765/kWh for Pepco accounts and $.07940/kWh for the U.S. Naval Academy Annapolis BGE account, or less. The Government desires to minimize the Average Present Value of the Blended Contract Unit Price and will, in part, use the Average Present Value for evaluation purposes.
Other Changes
16. The RFP is hereby modified to incorporate the following additional information:
• A list of the registered Pre-Proposal Event attendees.
• A copy of the presentations given during the Pre-Proposal Event.
• Requests for Information (RFI Group 1) submitted to the RFP requirements, along with the
Government’s response.
