SP4705-15-R-0004, Amendment 0007
The purpose of this amendment is to revise Paragraphs C.1.0, C.1.24, C.1.2.26, and C.1.2.39 of the PWS and General Intent 1.5.9 and include Questions and Answers.
Accordingly,
1. C.1.0 is hereby replaced in its entirety with the below:
C.1.0 The government intends to award TWO Contracts as the result of this solicitation to the same offeror. One will become a Firm Fixed Price (FFP) “C” Contract, which includes recurring maintenance, repair, replacement and minor work services. The second contract will be an Indefinite Delivery Indefinite Quantity (IDIQ) Type “D” Contract for the alteration requirements and extraordinary repair work, which exceeds the scope of a service order for minor work of the covered facility that will be issued as individually priced Task Orders with separate statement of work that the contractor will develop and propose pricing for as requested by the government. The majority of the PWS addresses the FFP “C” contract efforts and describes the regular and reoccurring work required under the “C” contract. As the corrective maintenance, renovation, rehabilitation, and repair type projects are unknown and undefined until we have building damage that must be repaired or occupant requested changes, the government is including a SAMPLE project that is to be priced. This SAMPLE project may never actually be awarded as a Task Order, but is being used to allow the government to make an award decision on the basis of best overall value to the government, not lowest cost.
2. C.1.24 is hereby replaced in its entirety with the below:
C.1.24 INDEFINITE DELIVERY/INDEFINITE QUANTITY (IDIQ) WORK
Indefinite Delivery/Indefinite Quantity (IDIQ) is defined as alteration and extraordinary repair work ordered under a separate statement of work, which is above and beyond the scope of a minor work service order, and not otherwise included in the firm fixed-price portion of the contract. The Contractor will be paid a negotiated fixed price for each task order as specified in the procedures provided hereunder. Any work undertaken by the Contractor without a separate statement of work and a pre-approved cost estimate is considered to be within the firm fixed price portion of the contract. Accordingly, no separate invoices will be paid for work that has not been separately requested by the Contracting Officer in accordance with the procedures in this section governing IDIQ Delivery orders. All IDIQ work is limited to a maximum total cost of $80,000 (labor, equipment and material) per delivery orders (DO). The Contractor will be paid a negotiated fixed price for each TO as specified on the procedures provided herein. With the Contractors acceptance, IDIQ work in excess of $80,000 may be ordered.
3. C.1.2.26 is hereby replaced in its entirety with the below:
C.1.2.26 Indefinite Delivery/Indefinite Quantity (IDIQ) Work. IDIQ" is defined as alteration requirements and extraordinary repair work, which exceed the scope of a service order for minor work. Alteration and extraordinary repair work will be classified as an IDIQ when the total cost of the required work, including labor and materials, is beyond the scope of a service order for minor work, but less than $80,000. Work shall be completed within the time frames specified on each delivery order. IDIQ Work is included in the indefinite quantity portion of the contract.
4. C.1.2.39 is hereby replaced in its entirety with the below:
C.1.2.39 Repair. Repair is the restoration of a piece of equipment, a system, or a facility to such condition that it may be effectively and reliably utilized for its designated purpose, and is a result of ordinary use, operation, normal wear and tear and the passage of time. Repairs do not include work required due to extraordinary repair work situations. Repair may be overhaul, reprocessing, or replacement of constituent parts or materials that have deteriorated by action of the elements or usage and have not been corrected through maintenance, or replacement of the entire unit or system if beyond economical repair. All repair work is included in the firm fixed price portion of the contract.
General Intent
1.5.9 SPECIAL CONTRACT REQUIREMENTS: This is an Indefinite-Delivery/Indefinite-Quantity (ID/IQ) contract against which it is planned to award Firm Fixed Price (FFP) task orders. The appropriate CLINS will be established for each individual task order. The total amount of all orders placed from this solicitation shall not exceed $4,400,000.00. The guaranteed minimum amount is $5,000.00 or the proposed negotiated Firm Fixed price for the Base Year.
5. The following questions and answers are hereby incorporated:
Question 1. C.1.0: This clause defines the “C” contract as being for services defined as preventative and scheduled maintenance. However, further on in the PWS paragraphs C.1.2.3, Alterations, C.1.2.18, Extraordinary Repairs, C.1.2.30, Minor Work and C.1.2.39, Repairs all indicate that the first $2,000 of this type of repair is in fact part of the “C” contract. Please clarify.
Answer 1: All repairs with exception of extraordinary repair exceeding the scope of minor work are included in the FFP contract.
