Will the government allow offerers who do not currently possess an active DSS clearance to obtain one during the phase-in/transition period? In our experience having received a clearance previously should streamline the process to have it reinstated once there is a new DD-254 is issued.

Solicitation pg 75 of 78 4th paragraph A DSS clearance is required at proposal submission per Sections L (Page 61) and M (Page 75) of the solicitation.

Will Government please consider changing the verbiage requiring a DSS clearance from:

"…in order to be eligible for award, the apparent successful offeror will be required to have a Defense Security Service (DSS) approved facility clearance at the time of proposal submission."

to

"…in order to be eligible for award, the apparent successful offeror will be eligable to obtain a Defense Security Service (DSS) approved facility clearance at the time of proposal submission."

This would allow for a wider pool of offerors to propose on this opportunity and would increase competition. It has been our experience with Security Clearances, that a company cannot get a clearance reinstated or issued originally until we hold an actual contract requiring same.

The Government cannot accommodate this request. If a clearance for an offeror is not pursued until phase-in, it could impact the start of full performance if approval is denied or approval is not completed within the phase-in timeframe.

Will the government issue offeror a provisional DD-254 to allow offerors the ability to start the process of having their clearance restored in preperation for this opportunity?

Solicitation pg 75 of 78 4th paragraph As identified above, the facility clearance is required at proposal submission.

Offeror X currently does not have DCAA approved indirect rates.

We do calculate our rates based on DCAA guidelines however but have not asked DCAA for approved rates yet.

Reading the instruction below from the RFP, it appears but not certain, that may be a requirement we don’t have.

TAB 4 - ACCOUNTING

SYSTEM VERIFICATION

Solicitation sections L (Tab 4 - pages 60-61) and M (page 75) identify that an approved accounting system is required to be eligible for award. Offerors shall provide documentation and DCAA points of contact with its proposal submission. If an offeror submits its DCAA office information along with a completed pre-award accounting system adequacy checklist (SF 1408), the government will contact DCAA for its accounting system decision. Please note that the accounting system audit can take varying amounts of time depending on the office and complexity of the system. If DCAA does not provide timely documentation of the approved accounting system to DLA, the offeror would not be eligible for award consideration. Lack of DCAA review or DCAA determination would not be considered government caused delay and in no way would delay DLA's award timeline. The offeror is responsible for having a timely approved accounting system. Offerors are strongly encouraged to discuss and coordinate the need with their requisite DCAA office in advance of proposal submission.

Can the partner (versus the prime) have the DD254? Attachment J.7

It is unclear what type of arrangement is anticipated. The prime contractor must have the approved facility clearance and verify the subcontractor has its clearance before any applicable work is subcontracted. If the offeror is referencing an 8(a) joint venture agreement, then the joint venture itself must have the facility clearance. In addition, the joint venture cannot rely on its venturers’ clearances in accordance with 32 CFR Part 2004, Directive No 1 and in DoD Manual 5220.22, Volume 2, Section 4.8.c.(6) Joint Ventures. Specifically, 4.8.c.(6)(c) and 4.8.c.(6)(e). The Joint Venture is a separate legal entity from its members and the Government has a relationship to the Joint Venture and not its individual members.
