Amendment 0006
1. The solicitation is hereby amended to extend the due date for proposals to March 21, 2014 at 3:00 PM Ft. Belvoir Local Time
2. The solicitation is hereby amended to incorporate the following provision in its full text:
52-222.17 – NONDISPLACEMENT OF QUALIFIED WORKERS (JAN 2013)
(a) “Service employee,” as used in this clause, means any person engaged in the performance of a service contract other than any person employed in a bona fide executive, administrative, or professional capacity, as those terms are defined in 29 CFR part
541. The term “service employee” includes all such persons regardless of any contractual relationship that may be alleged to exist between a contractor or subcontractor and such persons.
(b) The Contractor and its subcontractors shall, except as otherwise provided herein, in good faith offer those service employees employed under the predecessor contract whose employment will be terminated as a result of award of this contract or the expiration of the contract under which the service employees were hired, a right of first refusal of employment under this contract in positions for which the service employees are qualified.
(1) The Contractor and its subcontractors shall determine the number of service employees necessary for efficient performance of this contract and may elect to employ fewer employees than the predecessor Contractor employed in connection with performance of the work.
(2) Except as provided in paragraph (c) of this clause, there shall be no employment opening under this contract, and the Contractor and any subcontractors shall not offer employment under this contract, to any person prior to having complied fully with this obligation.
(i) The successor Contractor and its subcontractors shall make a bona fide express offer of employment to each service employee as provided herein and shall state the time within which the service employee must accept such offer, but in no case shall the period within which the service employee must accept the offer of employment be less than 10 days.
(ii) The successor Contractor and its subcontractors shall decide any question concerning a service employee’s qualifications based upon the individual’s education and employment history, with particular emphasis on the employee’s experience on the predecessor contract, and the Contractor may utilize employment screening processes only when such processes are provided for by the contracting agency, are conditions of the service contract, and are consistent with Executive Order 13495.
(iii) Where the successor Contractor does not initially offer employment to all the predecessor contract service employees, the obligation to offer employment shall continue for 90 days after the successor contractor’s first date of performance on the contract.
(iv) An offer of employment will be presumed to be bona fide even if it is not for a position similar to the one the employee previously held, but is one for which the employee is qualified, and even if it is subject to different employment terms and conditions, including changes to pay or benefits. (See 29 CFR 9.12 for a detailed description of a bona fide offer of employment).
3. The solicitation is hereby amended to incorporate the following provision by reference: FAR 52.225-1 Buy American Act – Supplies (FEB 2009). A copy of the provision’s text is available upon request.
4. The solicitation is hereby amended to incorporate the attached questions and answers.
5. All other terms and conditions of the solicitation remain unchanged.
Q: Is the staked area for the IBCT retail and bulk hard set or is there any leeway as long as we stay within 5 acres? The reason we are asking this is, being confined to the boxed in area that is staked now could make the entire site very inefficient and difficult to design. If the 5 acres could run deeper and thinner we could produce a more efficient design.
A: --It is hard set
Q: Is the bulk JP8 to be used for ground support vehicles or aircraft?
A: Both however there will a conversion from JP-8 to Jet A
Q: During the site visit, attendees were not allowed to take photographs but were told that photographs would be distributed to us. When can we expect these?
A: Each pre-proposal attendee received the photos via e-mail.
Q: With the very minimal changes to the PWS and the absence of Q&As, we are only a little over two weeks away from the due date. Can we expect the Q&As soon and will DLA-E consider an extension of the due date?
A: See amendment 0006.
Q: Will the bulk JP8 tanks at the IBCT facility need to have internal floating roofs?
A: --Best commercial practice
Q: Will the Contractor be responsible to perform maintenance, other than operator level maintenance, at the GOCO facilities of Dona Anna, Oro Grande, McGregor, and Biggs AAF?
A: --Operator level maintenance at the GOCOs
Q: Several plans are outlined in the PWS but not all of them have an expected turn in time. What plans are essential to be turned in with the proposal?
A: --Plans are required within 60 days after contract award
Q: What Plans are due 30 days or 60 days after award?
A: --Contract Compliance Plans is due at contract award and all others 30 within 30 days of contract award
Q: What Plans are due with the submittal and will they affect the page count of the proposal?
A: --None
Q: Will aircraft refuelers be “Flightline Use Only” vehicles or is there an over-the-road requirement also?
A: --Flightline only
Q: Will the Government require a 35%, 60%, and 95% construction design review?
A: --YES
Q: Will tracked vehicles be using the retail service station at the IBCT?
A: --NO
Q: Will there be a list of vehicles sent out using the IBCT retail service station?
A: --YES
Q: Will there be a need for bulk loading of DF2 at the IBCT retail facility?
A: --No
Q: What type of vehicles, refuelers, will be loaded at the fillstands at the IBCT bulk facility?
A: --HEMMT, TPW, Truck tankers 5000 - 8000 gal
Q: Will there be design reviews for the IBCT bulk and retail facilities?
A: --YES
Q: Will the IBCT retail facility require fencing?
A: --YES
Q: Will the containment basin at the IBCT bulk be required to connect to an oil/water separator?
A: --YES
Q: Will the above-ground tanks at the IBCT retail be required to be double wall per the EA?
A: --YES
Q: Please supply utilities information as is built now.
A: --Ft Bliss DPW/APC will provide utilities up to the lease property
Q: Reference PWS Appendix D for IBCT COCO Retail. The matrix shows 1-each 12,000 gallon tank for GUR; is this to mean the minimum number of tanks required? The annual throughput is 500,000 gallons which means approximately one and one-half fuel drops per week just for this product at this location. Paragraph C.5.1.3 states “….the Service Provider shall maintain a tank in ready-to-issue mode for bulk and retail dispensing 24/7.” Since we cannot issue and receive simultaneously from/to the same tank, the retail dispensers would frequently be cut off during these fuel drops if a single tank is installed. Please clarify the matrix information if it is to mean minimum amount of storage, minimum or actual # & capacity of tank(s), or something else. The remaining products of DS2 and E85 would not be as adversely affected since based on throughput, receipts will be less than 7.5 annually.
A: --YES
Q: Nothing to-date in either PWS addressed how the initial fuel delivery into the COCO will be provided and accounted for, so that testing and acceptance can occur. Will DLA provide the initial fuel deliveries for this purpose? If not it will be impossible for the government to conduct the initial acceptance verification of the facility.
A: --YES
Q: Will the daily fuels usage be captured from each site via a dial-in from a central facility computer such as at Biggs AAF? If so, is this by existing government-provided computer or Service Provider (SP) computer?
A: YES, (Service Provider computer) Q: Also, this added requirement lists four locations for fuel delivery by the service provider.
Will this number of locations increase later and if it does so, will the SP be allowed to come back to DLA as a changed condition for increased vehicle and fuel costs associated with adding more locations?
A: --If the number of locations changes during contract performance, the requirement will be altered using a change order; an equitable adjustment may be negotiated at that time if appropriate.
Q: Reference Offeror Submission Package (OSP) B-0001: CLINs 0001, 0008, 0015 and 0022 have split the COCO pricing between the Retail and Bulk by asking for a price for each which is atypical from previous OSPs for COCO services. Certain infrastructure and even personnel are a “total facility” cost and are not easily broken out as such; general just a single price. Please consider changing to a single price per period.
A: --Offered prices need only show the “total price” for the COCO portion of the solicitation to be considered complete.
Q: Reference Offeror Submission Package (OSP) B-0001: There is currently no place or instructions for adding the additional costs in equipment and labor that are generated by adding fuel deliveries for DS2 and JP8 into the revised PWS. Please clarify if we are to just fold these costs into the COCO pricing, or some other location.
A: --This is a part of the COCO requirement, and should be included in the COCO pricing.
Q: PWS C 5.1.4.2 states “No petroleum product shall be received or issued until product quality determinations have confirmed conformance with specifications.” Please verify that this means conformance with MIL STD 3004C tests only and not the more in-depth analyses performed by APC New Cumberland. Given the small number of tanks and the time delay between when taken, shipped to and then tested by the New Cumberland Lab, it would be many days that a tank would be on hold awaiting results. In many cases there may be a single tank per fuel so this is not feasible.
A: --Receiving/Issuing must be IAW MIL STD 3004C, or latest version.
Q: Neither PWS has addressed what the Service Provider is to deliver with regard to computer systems for accounting of the DLA product. Will daily inventory accounting be via government computers or Service Provider computers? If using existing, government-provided computer, from which location (i.e., Biggs AAF)? If the inventory accounting services are provided by the SP, using the SP’s own computer hardware, please provide the specifications of equipment needed to run such programs as the government’s FMD, FuelMaster, EBS, etc.
A: --It will be via Service Provider computers. The Service Provider is responsible to provide a computers and computer hardware with input and upload to the FES via a high speed web/internet, Fuels Manager Defense (FMD) processing tools. At a minimum, BSM-E applications require the Contractor to provide and have on-site high speed internet access with a static Internet Protocol (IP) address, electronic mail (e-mail) with individual user accounts, the current version of Adobe Acrobat, and Microsoft Office XP with DLA Energy-mandated service packs. Also, the Service Provider shall provide requisite hardware capable of processing all applicable inventory and accounting transactions through DLA Energy-provided applications or software.
The Government will provide the software IAW Contract Provision I119.04
Q: Please provide a copy of the Environmental Assessment for this site.
A: --Provided Via Amendment 0005
Q: Please provide any geotechnical information available (i.e., borings data, specific soils type and cross-sections, any known water levels, etc.) from the site or from the closest recent nearby construction.
A: --Prior to contract award
Q: As above, does the design need to include accommodations for tracked vehicles to use this facility (i.e., up to 70+ tons)?
A: --No Track vehicles
Q: Please confirm that 7-foot high fencing is required around the facility per UFC 3-460-01 Design: Petroleum Fuel Facilities paragraph 2-6.2.
A: --Fencing is required facility per UFC 3-460-01 Design

A: --Canopies at the service islands and bulk loading racks are required
Q: Is an emergency generator required here?
A: --Yes
Q: What are the Service Provider’s responsibilities for placing and disposal of spill materials (kits) at the COCO location; i.e., is the Service Provider required to provide 24/7 available materials to the customer, or is the Service Provider only responsible for spills and materials caused by the Service Provider?
A: --It is the responsibility of the Service Provider to provide disposal of spill materials (kits) for customers at the COCO location
Q: If the Service Provider is to place spill materials outside and readily available at all manned/unmanned facilities, who is responsible for pilferage and/or disposal of used materials?
A: --It is the responsibility of the Service Provider to provide disposal of spill materials (kits) for customers at manned/unmanned facilities locations
Q: Will the government allow (or actually perform) recovery and turn-in of waste fuel and/or small amounts of contaminated water disposal such as from the COCO filter/separator drawoffs, drain box/OWS captures of spills, etc.? Even though it is waste, it is generated from government-owned product.
A: --Yes: however, it has to be coordinated with the contract COR, DLA Energy and Installation Environmental Division.
Q: Are drawings, plot plans, and/or layouts required with the technical proposal?
A: --Normally drawings, plot plans, and/or layouts are turn in with proposal Q: Reference PWS paragraph C.4.0 – APPLICABLE DIRECTIVES for “validated best commercial practices” and Appendix C listing of listing of directives. If API 650 tanks are used, do these tanks need to only meet the requirements of API 650, or API 650 and the UFC?
A: --Need to meet all of the requirements listed in UFC, API 650, and API 650 for best commercial practice

Q: Please confirm that all fuel samples will be sent to the APC New Cumberland Lab for testing, and that only Type C testing per MIL-STD-3004C is required to be conducted by the Service Provider.
A: --Service Provider is responsible to for sending all fuel samples to the APC New Cumberland Lab for testing, and only Type C testing per MIL-STD-3004C or latest version is required to be conducted by the Service Provider.
Q: Reference PWS C 5.1.4.2 – SAMPLING: this paragraph states “The packing, marking, shipping, and the associated costs shall be the responsibility of the Service Provider, except that direct shipping costs are eligible for reimbursement from the Contracting Officer.” Please clarify that this statement means costs associated with shipment of samples from Bliss to the designated testing lab (i.e., New Cumberland, PA) via approved HM shipping method such as FedEx or
UPS.
A: --The Service Provider is responsible for the costs associated with shipment of samples from Ft Bliss to a designated testing lab (i.e., New Cumberland, PA) via approved HM shipping method such as FedEx or UPS, except direct shipping.
Q: Are there required levels of security clearance for operations of the Service Provider’s employees at any of the sites, including flight line entry at BAAF?
A: --Service Provider personnel shall successfully complete a background investigation which includes, as a minimum, a National Agency Check (NAC), submit documentation to the appropriate government office, and shall comply with DOD 5200.2-R.
Q: Please clarify that the service provider is required to provide all computer systems used for processing to the EBS; that is, are we correct that no government computers will be provided?
A: --No government computer will be provided. The Service Provider is responsible to provide all computers need for processing EBS/FMD transaction, invoices, etc.
Q: If the contractor is to provide all computer hardware systems, what are the required specs?
A: --Service Provider is responsible to provide all computer systems hardware.

A: --Government is responsible to provide the required software for Fuels Manager Defense, as well as all subsequent updates.
Q: Will all product inventory and all sites be accounted for as/under one DODAAC?
A: --Yes
Q: Reference PWS C.6.1 – SERVICE PROVIDER PLANS list the same ten plans referenced in PWS C.5.3.1 and these are all due within 60 days after award; this differs somewhat with a discussion at the Site visit on Thursday the 31st. Please clarify that C.6.1 is correct.
A: --The plans are due within 60 and 30 days after contract award, as follows: Within 60 days:
Service Provider Plan, Contract Compliance Plan and Environmental Compliance and spill Control Plan. All other plans are due within 30 days.
Q: Reference PWS C.6.10 – AVIATION OPERATIONS PLAN description includes a lengthy section on hot refueling. Since that mission is to be removed until a later date, will this paragraph be revised to delete those references?
A: --Solicitation has been amended to remove mission until later. However the paragraph will not be removed from the PWS.
Q: Reference PWS Appendix F – PERFORMANCE REQUIREMENT SUMMARY TABLE shows N/A in the INCENTIVE column for each task, implying there is neither a cost charge nor credit for either failing to meet or exceeding the standard; Note 5 also states that the incentive is zero. However, Notes 3 and 4 provide for either a 2%-to-5% charge-off or credit based on falling short of or exceeding the standard. If there is no incentive (Note 5), for clarification purposes will Notes 3 & 4 be removed/struckthrough when the revised PWS is published?
A: --The PWS has been amended Note 4 and 5 deleted (Refer to Appendix F)
Q: Will the Service Provider be expected to comply with DLA policy P-10 Segregation of Duties for establishing manning needs for the locations? If yes, this does not align with the purpose of Best Commercial Practices, as it is possible that a Service Provider could perform the services listed in this policy with fewer personnel at each site than P-10 requires.
A: --Service Provider shall comply with DLA policy P-10, Segregation of Duties; which goes according to best commercial practice, segregation of duty without compromising safety of personnel or mission.
Q: Reference Solicitation page 74 – B. TECHNICAL/MANAGEMENT PROPOSAL (1): “The complete technical proposal, excluding cover letter, table of contents, and any equipment sale/lease agreements, will not exceed 50 pages.” Since this proposal must cover several diverse elements (COCO, GOCO, Alongside Refueling, and Bulk Issue) as well as maintenance operations, request that also any drawings, plot plans, equipment description cut sheet extracts, and similar items be excluded from the page count.
A: --Rather than exempt particular documents from the page count, DLA Energy hereby raises the page limit on the technical proposal to 70 pages.
Q: The Draft Lease provided with the solicitation in Paragraph 8 – Cost of Utilities requires the Service Provider to pay the cost of utilities and other services, yet these are typically borne by the Government in a MOA. Is this still valid, or will the utilities be provided at no cost?
A: --The Service Provider is responsible for the COCO and the Government is responsible for the utilities for the utilities at the GOCO.
Q: Please confirm no “tracked” vehicles will be entering the site.
A: --No Track Vehicles
Q: Please verify if the current, local, Davis-Bacon wage rates apply to this solicitation.
A: --The period of performance on the contract does not begin until the IBCT Bulk/Retail Facility is accepted by the Government; the contract is for fuel management services, therefore there is no Davis – Bacon wage determination that applies to this solicitation.
Q: Please advise if the Buy American Act applies to this contract / solicitation for materials being used in construction. Appendix C Applicable Directives C.1, references the FAR, but no specific clauses.
A: --Due to an oversight, FAR Provision 52.225-1 Buy American Act – Supplies was not incorporated by reference to the solicitation. It is incorporated via Amendment 0006
