The changes set forth herein are incorporated into Solicitation SP0600-10-R-0419.
PART I
1. Page 3, Section 1 SUPPLIES TO BE FURNISHED (ELECTRICITY), (c) has hereby been updated.
a. The number of accounts for NAS Kingsville has hereby been reduced to 23.
b. NAS Kingsville Nueces has hereby been added to the solicitation. NAS Kingsville Nueces has three accounts.
c. The number of accounts for CBP has hereby been reduced to 258.
d. ICE has hereby been added to the solicitation. ICE has 38 accounts.

3. Page 5, Special Notes, Note 9 has hereby been deleted and replaced with:
It is anticipated that the ERCOT market will transition from a zonal market structure to a nodal and/or trading hub market structure on December 1, 2010. Upon the implementation of the transition, any new or increased ERCOT or PUCT fees/charges that arise as a direct result of the zonal to nodal market change will be classified as “new” charges and shall fall under the Electricity Regulatory Changes clause (excluding energy charges).
4. Page 5, Special Notes, Note 11 has hereby been updated.
FOR ALL NAVY ACCOUNTS, DYESS AFB AND MCRC GALVESTON ONLY. The Transaction Fee shall be a single price, which encompasses the entire installation for the entire delivery period. Except for the NAS Kingsville accounts located in the NEUCES territory.
NAS Kingsville line items 4812p, 4812ab, and 4812ac will be solicited as NAS Kingsville Nueces. NAS Kingsville and NAS Kingsville Nueces can be awarded separately.

FOR FORT HOOD ONLY: Clause DFARS 252.232-7003 ELECTRONIC SUBMISSION OF PAYMENT REQUESTS AND RECEIVING REPORTS as incorporated by reference in Part II, Section 8, Clause DFARS 252.212-7001 (Nov 2009) CONTRACT TERMS AND CONDITIONS REQUIRED TO IMPLEMENT STATUTES OR EXECUTIVE ORDERS APPLICABLE TO DEFENSE ACQUISITIONS OF COMMERCIAL ITEMS is applicable for Fort Hood.
6. Page 12, Section 10 ELECTRICITY PRICING FOR QUANTITIES OUTSIDE ESTABLISHED LOAD BANDWIDTH (ADDER TO THE AVERAGE MARKET PRICE), Note 1 has hereby been deleted and replaced with the following:
NOTE 1: This clause is only applicable to Fort Hood, Army Reserves, Air Force Space Command, and AAFES. Bandwidth calculations shall be calculated on an installation basis.

7. Page 14, Section 1 INSTRUCTIONS TO OFFERORS (ELECTRICITY). The following sections have hereby been amended to read as follows:
Paragraph (b)(2)(vi)(E):
(E) Proposals submitted electronically through a single e-mail must be no more than 10 MB. DLA ENERGY’s mail server will reject messages larger than 10 MB.
Paragraph (b)(3)(ii)
(ii) A brief description of the sources of working capital for the offeror’s power marketing activities, in addition;
- Offeror or its Parent Company, with an Investment Grade credit rating from at least two of the three rating agencies (S&P, Moody’s and Fitch) as stated on Attachment I, shall provide documentation of the ratings.
NOTE: Investment Grade is defined as at or above BBB-(S&P/Fitch) or Baa3 (Moody’s). If the Offeror, its Parent Company is rated by more than two rating agencies and the ratings are split, the lowest two ratings will be used.
-Offeror or whose Parent Company, is not rated by at least two of the three credit rating agencies (S&P, Moody’s or Fitch) as having an Investment-Grade credit rating, shall provide a standby irrevocable letter of credit, prior to award, from a federally-insured financial institution for a sum not less than 1 million dollars available to the offeror for the entire term of the contract performance period, for all awards greater than ten million dollars.

(d) COMPTROLLER GENERAL EXAMINATION OF RECORD The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)
(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c) and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items.
Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—
