52.204-16 COMMERCIAL AND GOVERNMENT ENTITY CODE REPORTING (AUG 2020)
(a) Definition. As used in this provision--
Commercial and Government Entity (CAGE) code means—
(1) An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Commercial and Government Entity (CAGE) Branch to identify a commercial or government entity by unique location; or
(2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support and Procurement Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Commercial and Government Entity (CAGE) Branch records and maintains in the CAGE master file. This type of code is known as a NATO CAGE (NCAGE) code.
(b) The Offeror shall provide its CAGE code with its offer with its name and location address or otherwise include it prominently in its proposal. The CAGE code must be for that name and location address. Insert the word "CAGE" before the number. The CAGE code is required prior to award.
(c) CAGE codes may be obtained via--
(1) Registration in the System for Award Management (SAM) at www.sam.gov. If the Offeror is located in the United States or its outlying areas and does not already have a CAGE code assigned, the DLA Commercial and Government Entity (CAGE) Branch will assign a CAGE code as a part of the SAM registration process. SAM registrants located outside the United States and its outlying areas shall obtain a NCAGE code prior to registration in SAM (see paragraph (c)(3) of this provision).
http://www.sam.gov/
(2) The DLA Commercial and Government Entity (CAGE) Branch. If registration in SAM is not required for the subject procurement, and the Offeror does not otherwise register in SAM, an Offeror located in the United States or its outlying areas may request that a CAGE code be assigned by submitting a request at https://cage.dla.mil.
(3) The appropriate country codification bureau. Entities located outside the United States and its outlying areas may obtain an NCAGE code by contacting the Codification Bureau in the foreign entity's country if that country is a member of NATO or a sponsored nation. NCAGE codes may be obtained from the NSPA at https://eportal.nspa.nato.int/AC135Public/scage/CageList.aspx if the foreign entity's country is not a member of NATO or a sponsored nation. Points of contact for codification bureaus, as well as additional information on obtaining NCAGE codes, are available at http://www.nato.int/structur/AC/135/main/links/contacts.htm.
(d) Additional guidance for establishing and maintaining CAGE codes is available at https://cage.dla.mil.
(e) When a CAGE code is required for the immediate owner and/or the highest-level owner by Federal Acquisition Regulation (FAR) 52.204-17 or 52.212-3(p), the Offeror shall obtain the respective CAGE code from that entity to supply the CAGE code to the Government.
(f) Do not delay submission of the offer pending receipt of a CAGE code.
(g) If the solicitation includes FAR clause 52.204-2, Security Requirements, a subcontractor requiring access to classified information under a contract shall be identified with a CAGE code on the DD Form 254. The Contractor shall require a subcontractor requiring access to classified information to provide its CAGE code with its name and location address or otherwise include it prominently in the proposal. Each location of subcontractor performance listed on the DD Form 254 is required to reflect a corresponding unique CAGE code for each listed location unless the work is being performed at a Government facility, in which case the agency location code shall be used. 52.212-2 EVALUATION – COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
(a) The Government intends to award a single contract with Firm Fixed Price (FFP) Contract Line Item Numbers (CLINs) to the responsible Quoter whose quote, conforming to the Request for Quotation (RFQ) solicitation, provides the Lowest Priced and Technically Acceptable offer to the Government, all evaluation factors considered.
There are no trade agreements and the Buy American Act is not applicable to this requirement.
The evaluation factors are provided below:
(a) Evaluation Process and Criteria of the technical submittal submittal package
Offers will be evaluated using the following factors, to select the offer that provides the Government with a technically acceptable offer at the lowest price:
(1) Factor 1 – Internet Services Technical Specification Sheet (Attachment 1)
(2) Factor 2 – Price (Fill-in price on SF1449)
(b) The evaluation criteria are as follows:
(1) Factor 1 – Internet Services Technical Specification
The quote will be evaluated to determine if the quoter has submitted the internet speed and volume available listed in Attachment (1) Technical Specification Sheet the Technical Documentation Certification; the technical documentation shall include the following:
(1) Speed of Internet – 150 Mbps (Uplink and Downlink)
(2) Volume of internet service – Unlimited
This factor will be evaluated as Pass/Fail as stated in Table 1 below.
https://www.sam.gov/
Table 1 - Technical Acceptable/Unacceptable Adjectival Ratings
Rating Description Acceptable Quote clearly meets the minimum technical requirements of the RFQ Unacceptable Quote does not clearly meet the minimum technical requirements of the RFQ
Basis of Evaluation:
The Quoter whose proposal submission who has earned an Acceptable rating for each of the service locations and each category of technical specification while also having the lowest price will be then considered for award pending a contracting officer’s determination of responsibility of the subject Quoter. Only Quoters whose technical submittal package is complete and rated Acceptable overal all wil be moved into the Price Evaluation phase per Factor 2.
(2) Factor 2 – Price
Only quotes that have been rated Overall ‘Acceptable’ in Factor 1 – Internet Services Technical Specification Sheet shall be further evaluated for Factor 2 – Price. An adjectival rating will not be assigned to the Price factor; rather, Price will be evaluated for completeness and fair and reasonable determination in accordance with FAR 13.106-3(a). The Quoter shall provide this SF-1449 signed by the authprized business agent with the pricing in United States Dollars filled in for each Contract Line Item (CLIN) and the total of all CLINS including the option CLINs will be evaluated as the whole price. Quoters are advised to offer your best and final price in this one-time quote.
1. Completeness: All price information/data required in the RFQ has been submitted. All CLINs listed in the CLIN technical spreadsheet as stated in the RFQ shall be priced in United States Dollars.
2. Reasonableness: Price is fully justified and supported and is considered fair under current market conditions. Reasonableness may be determined by comparison with the Government estimate, comparison with other Quotes received, or any other applicable price analysis technique outlined in FAR 13. The Contracting Officer must determine the Quoter’s price to be fair and reasonable in order for the Quote to be eligible for award.
The government reserves the right to determine which Quotes show the capability to meet the requirements of this RFQ. The government reserves the right to eliminate from further consideration those Quotes which are considered unacceptable and not capable of being made acceptable without major rewrite or revision. The Government plans to award without discussions.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s) at a future time.
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

The Contractor shall provide this information directly to the office designated in this contract to receive that information (hereafter: “designated office”') by 30 (the Contracting Officer shall insert date, days after award, days before first request, the date specified for receipt of offers if the provision at 52.232-38 is utilized, or “concurrent with first request” as prescribed by the head of the agency; if not prescribed, insert “no later than 15 days prior to submission of the first request for payment”). If not otherwise specified in this contract, the payment office is the designated office for receipt of the Contractor's EFT information. If more than one designated office is named for the contract, the Contractor shall provide a separate notice to each office. In the event that the EFT information changes, the Contractor shall be responsible for providing the updated information to the designated office(s).
(2) If the Contractor provides EFT information applicable to multiple contracts, the Contractor shall specifically state the applicability of this EFT information in terms acceptable to the designated office. However, EFT information supplied to a designated office shall be applicable only to contracts that identify that designated office as the office to receive EFT information for that contract.

The prompt payment terms of the contract regarding notice of an improper invoice and delays in accrual of interest penalties apply.
(2) If the EFT information changes after submission of correct EFT information, the Government shall begin using the changed EFT information no later than 30 days after its receipt by the designated office to the extent payment is made by EFT. However, the Contractor may request that no further payments be made until the updated EFT information is implemented by the payment office. If such suspension would result in a late payment under the prompt payment terms of this contract, the Contractor's request for suspension shall extend the due date for payment by the number of days of the suspension.
(e) Liability for uncompleted or erroneous transfers. (1) If an uncompleted or erroneous transfer occurs because the Government used the Contractor's EFT information incorrectly, the Government remains responsible for--
(i) Making a correct payment;
(ii) Paying any prompt payment penalty due; and
(iii) Recovering any erroneously directed funds.
(2) If an uncompleted or erroneous transfer occurs because the Contractor's EFT information was incorrect, or was revised within 30 days of Government release of the EFT payment transaction instruction to the Federal Reserve System, and--

(ii) If the funds remain under the control of the payment office, the Government shall not make payment and the provisions of paragraph (d) shall apply.
(f) EFT and prompt payment. A payment shall be deemed to have been made in a timely manner in accordance with the prompt payment terms of this contract if, in the EFT payment transaction instruction released to the Federal Reserve System, the date specified for settlement of the payment is on or before the prompt payment due date, provided the specified payment date is a valid date under the rules of the Federal Reserve System.

In all respects, the requirements of this clause shall apply to the assignee as if it were the Contractor. EFT information that shows the ultimate recipient of the transfer to be other than the Contractor, in the absence of a proper assignment of claims acceptable to the Government, is incorrect EFT information within the meaning of paragraph (d) of this clause.
(h) Liability for change of EFT information by financial agent. The Government is not liable for errors resulting from changes to EFT information provided by the Contractor's financial agent.
(i) Payment information. The payment or disbursing office shall forward to the Contractor available payment information that is suitable for transmission as of the date of release of the EFT instruction to the Federal Reserve System. The Government may request the Contractor to designate a desired format and method(s) for delivery of payment information from a list of formats and methods the payment office is capable of executing. However, the Government does not guarantee that any particular format or method of delivery is available at any particular payment office and retains the latitude to use the format and delivery method most convenient to the Government. If the Government makes payment by check in accordance with paragraph (a) of this clause, the Government shall mail the payment information to the remittance address in the contract.
(j) EFT information. The Contractor shall provide the following information to the designated office.
