About this file

This is a Statement of Work (SOW) template for the Commonwealth of Massachusetts under the statewide contract PRF76: Management Consultants, Program Coordinators and Planners Services. The document outlines technical assistance services to be provided to Seasonal Communities (SCs) designated under 760 CMR 76.00 throughout Massachusetts, with geographic focus areas including Berkshire County, Barnstable County/Cape Cod, Dukes and Nantucket Counties/the Islands, Franklin County, and Essex County (specifically Hawley, Monroe, and Rockport). The consultant(s) will provide implementation-oriented support to municipalities that have accepted SC designation, are considering acceptance, or are pursuing designation. Anticipated services include start-up planning and community needs assessment, outreach and public engagement, technical assistance across SC tools (zoning implementation, housing trusts, workforce housing strategies, tax tools, grant funding navigation), referrals to specialized resources, and regular feedback to the Housing and Livelihood Commission (HLC). The engagement carries a contract term extending through September 30, 2029, with an expectation of regular in-person field presence combined with remote support.

The engagement is structured as a fixed-price project with a total budget of $175,000.00 for the duration of services. Travel reimbursement is allowed at approved state rates, with budget details attached. Funding is contingent upon appropriation by the Massachusetts Legislature or Federal Government for the years in which services are delivered. The Department reserves the right to terminate the engagement without cause and without penalty upon prior written notice, or for material breach, failure to perform, elimination of appropriation, or unforeseen public emergency. The consultant will not provide legal advice, make official HLC determinations, speak on behalf of HLC, or replace municipal counsel or other specialized professional services. Priority for services will be given to municipalities that have already accepted the SC designation, with assistance to other communities provided based on demand and fund availability.

HLC seeks one or more qualified Consultants to provide implementation-oriented technical assistance (TA) to Seasonal Communities (SCs) that 1) have accepted their SC designation and are working towards implementation; 2) have not yet accepted their SC designation but are considering acceptance; and 3) have not been designated a SC but are interested in pursuing designation. The Consultant(s) will provide planning and process support, help communities assess options and organize implementation steps, and connect communities to additional resources when needed. The work is expected to include regular and in-person field presence in SCs, particularly in the Berkshires, Cape Cod, and the Islands, together with remote support as appropriate. The Consultant(s) will not provide legal advice, make official HLC determinations, speak on behalf of HLC, or replace municipal counsel or other specialized professional services.

The Consultant(s) will provide service to municipalities on HLC's list of designated SCs, including municipalities that have already accepted the designation pursuant to 760 CMR 76.00: Seasonal Communities, 76.03: Municipal Acceptance or Denial of a Seasonal Communities Designation, municipalities considering whether to accept the designation, and municipalities that are considering requesting to be designated as a SC.

The field regions of focus by the Consultant are: a) Berkshire County; b) Barnstable County/Cape Cod; c) Dukes and Nantucket Counties/the Islands; d) Franklin County; and e) Essex County, specifically the municipalities of Hawley, Monroe, and Rockport. While not all meetings require the selected Consultant to be in the field, there is an expectation that Consultant will be available for in person meetings or presentations as described in the RFQ.

Priority for services will be given to municipalities that have already accepted the SC Designation. Designated communities needing TA to accept the designation, and communities not yet designated but who wish to be designated and accept the designation may be given assistance based on demand for TA and availability of funds to provide services.

Anticipated services may include but not be limited to:

1. Start-up work planning, community needs assessment, and coordination with HLC and regional partners;

2. Outreach, education, public engagement, office hours, and one-on-one technical assistance;

3. Planning and process assistance across SC tools, including but not limited to 1) zoning implementation, 2) housing trusts and occupancy restrictions, 3) workforce and artist housing strategies, 4) housing needs assessments, 5) residential property tax tools, 6) grant funding navigation, 7) related planning and engagement, and other SC specific tools;

4. Referrals and coordination with municipal counsel, regional planning agencies, and other specialized resources when needs fall outside the Consultant’s scope; and

5. Regular feedback to HLC regarding recurring questions, implementation barriers, promising practices, and areas where additional guidance may be useful.
