About this file

This is a Request for Quotes (RFQ) issued by the Commonwealth of Massachusetts Executive Office of Housing and Livable Communities (HLC) seeking qualified consultants to provide technical assistance to Seasonal Communities. The RFQ, posted on October 9, 2026, with responses due by October 30, 2026, aims to engage one or more bidders to support municipalities across five service areas: Berkshire County, Barnstable County/Cape Cod, Dukes and Nantucket Counties/the Islands, Franklin County, and Essex County. The anticipated scope of services includes start-up planning, community needs assessments, outreach and education, technical assistance across Seasonal Communities tools (including zoning implementation, housing trusts, workforce and artist housing strategies, housing needs assessments, property tax tools, and grant funding navigation), referrals to specialized resources, and regular feedback to HLC. The contract is anticipated to begin on or about November 1, 2026, with an initial term through June 30, 2027, and potential renewal or extension upon mutual agreement. The apparent successful bidder(s) will be posted by November 5, 2026, with contract award estimated for November 12, 2026. Bidders must be registered on the Massachusetts Statewide Contract PRF 76 (Management Consultants, Program Coordinators and Planners Services, Category 6) and submit complete responses via COMMBUYS, including a bidder response questionnaire, budget estimate, two project samples, and staff resumes.

An estimated $175,000 is available to provide technical assistance, with priority given to communities that have already accepted the Seasonal Communities designation and are moving into implementation. Bidders must demonstrate at least five years of experience in Massachusetts land use, zoning, municipal planning, community development, or related fields; knowledge of Massachusetts land use law and municipal zoning; experience with community planning and stakeholder engagement; capacity to provide in-person field services across proposed areas, including ferry travel and evening meetings; and strong project management and communication skills. Local knowledge of the Berkshires and Cape Cod/Islands is preferred but not required. Evaluation will be based on approach and responsiveness to scope, relevant experience and qualifications, capacity and ability to deliver, quality and value of proposed services, and cost and overall value. The lowest-cost proposal will not necessarily be selected. Bids from certified small businesses are highly desired if the contract spend is less than $250,000. All selected bidders must comply with state and federal confidentiality laws, data protection requirements, and environmental purchasing policies, and are prohibited from referencing HLC or the Commonwealth in promotional materials without prior written approval.

5. PURCHASING AGENCY

HLC oversees policy, funding and resources to help people in Massachusetts live affordably and safely. Through its community and business partners, HLC provides affordable housing options, technical assistance on land use and other implementing measures, capital grants, financial assistance, and other support to Massachusetts communities.

6. PURPOSE OF PROCUREMENT

Consistent with HLC guidance, and subject to HLC final approval, HLC seeks Bidders who can provide the following services. These are the minimum anticipated services, which the parties may agree to modify or expand in an amendment(s) to the SOW, Change Order, or Task Order.

Massachusetts General Laws chapter 23B, section 32 and 760 CMR 76.00 establishes the Seasonal

Communities framework, under which certain Massachusetts communities that experience substantial variation in seasonal employment and housing may be designated a “Seasonal

Community” (SC) and become eligible to receive distinctive tools and resources to address their unique needs. A municipality must formally accept its designation for it to become effective.

HLC seeks one or more qualified Consultants to provide implementation-oriented technical assistance (“TA”) to Seasonal Communities (“SC”s) that 1) have accepted their SC designation and are working towards implementation; 2) have not yet accepted their SC designation but are considering acceptance; and 3) have not been designated a SC but are interested in pursuing designation. The Consultant(s) will provide planning and process support, help communities assess options and organize implementation steps, and connect communities to additional resources when needed. The work is expected to include regular and in-person field presence in

SCs, particularly in the Berkshires, Cape Cod, and the Islands, together with remote support as appropriate. The Consultant(s) will not provide legal advice, make official HLC determinations, speak on behalf of HLC, or replace municipal counsel or other specialized professional services.

HLC may procure additional services or undertake new initiatives from the Bidder(s) to provide additional or related services under this RFQ. During this engagement, HLC may amend any

SOWs resulting from this procurement to address, among other things, items or issues not previously identified.

HLC is issuing this RFQ to purchase the following minimum anticipated required services, consistent with any HLC guidance or instructions that may be provided, which HLC may modify or expand, as outlined in this RFQ.

7. SERVICE AREAS

The Consultant(s) will provide service to municipalities on HLC's list of designated SCs’, including municipalities that have already accepted the designation pursuant to 760 CMR 76.00:

Seasonal Communities, 76.03: Municipal Acceptance or Denial of a Seasonal Communities

Designation, municipalities considering whether to accept the designation, and municipalities that are considering requesting to be designated as a SC.

The field regions of focus by the Consultant are: a) Berkshire County; b) Barnstable County/Cape

Cod; c) Dukes and Nantucket Counties/the Islands; d) Franklin County; and e) Essex County, specifically the municipalities of Hawley, Monroe, and Rockport.

Priority for of services will be given to municipalities that have already accepted the SC

Designation. Designated communities needing technical assistance to accept the designation, and communities not yet designated but who wish to be designated and accept the designation may be given assistance based on demand for TA and availability of funds to provide services.

8. ANTICIPATED SCOPE OF SERVICES

The selected Consultant(s) will provide flexible, implementation-oriented TA based on community demand, readiness, and HLC priorities. An estimated $175,000 is available to provide

TA and priority will be given to SCs that have accepted the designation and are moving into implementation. As capacity allows, services, not to exceed $175,000 in TA, may also support designated communities considering acceptance and other eligible communities seeking designation. Anticipated services may include but are not limited to:

1. Start-up work planning, community needs assessment, and coordination with HLC and regional partners;

2. Outreach, education, public engagement, office hours, and one-on-one technical assistance;

3. Planning and process assistance across SC tools, including but not limited to 1) zoning implementation, 2) housing trusts and occupancy restrictions, 3) workforce and artist housing strategies, 4) housing needs assessments, 5) residential property tax tools, 6) grant funding navigation, 7) related planning and engagement, and other SC specific tools;

4. Referrals and coordination with municipal counsel, regional planning agencies, and other specialized resources when needs fall outside the Consultant’s scope; and

5. Regular feedback to HLC regarding recurring questions, implementation barriers, promising practices, and areas where additional guidance may be useful.

9. MINIMUM BIDDER QUALIFICATIONS

Bidders must demonstrate qualifications appropriate to the proposed service area and staffing model, including:

1. At least five years of experience in Massachusetts land use, zoning, municipal planning, community development, housing, or a closely related field;

2. Demonstrated knowledge of Massachusetts land use law and municipal zoning, with the ability to explain legal frameworks accurately without providing legal advice;

5. Strong project management, plain-language communication, judgment, and follow-through. Local knowledge of the Berkshires and/or Cape Cod and the Islands is preferred.

10. ESTIMATED START DATE, CONTRACT TERM

It is anticipated that the selected Bidders would be required to begin performance on or about approximately November1, 2026, or immediately upon execution of a contract. HLC may elect to establish an alternative start date as needed.

The estimated term of the SOW entered into under this RFQ shall consist of an initial term from the start of the contract to terminate approximately June 30, 2027, and may be renewed or extended upon written agreement by the awarded Bidder(s) and HLC, subject to satisfactory Bidder performance, appropriation, the availability of funding, and the terms of the applicable Statewide

Contract. The initial term and all renewals or extensions shall be referred to collectively as the

“Term.”

11. BIDDER SUBMISSION REQUIREMENTS

All Bidder responses must be submitted via COMMBUYS. A complete bid will only be accepted when submitted via COMMBUYS. Email, hard copy, or other forms of submissions will not be accepted. A complete bid must include:

SC tools listed in Section 8.3; and

4. Resumes for all individuals who are likely to play a role in providing TA.

By submitting their response, the Bidder agrees to the terms of the RFQ. Bidder may not alter the

RFQ language. Modifications to the RFQ are prohibited and will be disregarded. In addition, by submitting their response, the Bidder affirms that there is no pending litigation involving the

Bidder or the services provided in the response that may impair or interfere with HLC’s right to use the services.

All materials submitted to HLC during this RFQ process become the property of HLC upon their receipt and will not be returned. Except as provided in the Massachusetts Public Records Law, all materials submitted to HLC may be subject to release as public records. In no event shall HLC, or any of their agents, representatives, Consultants, directors, officers, or employees, be liable to a Bidder for the disclosure of all or a portion of a response or related information submitted during this RFQ.

HLC may remove from further consideration non-responsive bids and bids that do not include all required items listed in this RFQ. Prior to such exclusion, HLC may request one or more clarification(s) from a Bidder. A Bidder’s response may be excluded for failure to meet HLC’s budgetary thresholds. HLC may select the Bidder or combination of Bidders that provides the best overall value to the Commonwealth. The lowest-cost proposal will not necessarily be selected.

HLC reserves the right to consider any previous experience the Bidder has had with any State agency, including, but not limited to, performance problems and compliance with applicable laws and contract provisions. Should this RFQ result in a contract with an annual spend amount of less than $250,000, bids from certified small businesses are highly desired, in accordance with ReOrg

Contracting,” and HLC will follow guidance provided by the Supplier Diversity Office in evaluating Bidder responses.

HLC may negotiate and execute contract amendments with the awarded Bidder(s) which HLC reasonably determines are within the scope of this RFQ and necessary to result in best value to the Commonwealth.
