About this file
This is a Performance Bond document related to a City of Meriden, Connecticut contract opportunity (B027-15) for the procurement of Sodium Bisulfite for use at the Water Pollution Control Facility. The performance bond serves as a surety instrument ensuring that the selected contractor will faithfully perform and complete the contract in accordance with its terms and conditions. The bond requires the contractor and surety to be jointly and severally bound to the owner for a specified dollar amount, with the surety waiving notice of any alterations, defaults, or extensions of time made by the owner. The document establishes the framework for contract performance and remedies in the event of contractor default.
The performance bond establishes key terms and conditions governing the contractor's obligations and the surety's liability. If the contractor defaults under the contract, the owner may either require the contractor to remedy the default or may obtain competitive bids for contract completion, with the surety responsible for funding the cost of completion less the remaining contract balance, not to exceed the bond amount. The bond includes a two-year statute of limitations for any legal action against the bond, measured from the date final payment under the contract is due. Rights of action under the bond are limited exclusively to the named owner and its successors, with no third-party beneficiaries permitted. The document is a standard form requiring signatures from the contractor principal, surety, and witnesses, with blanks for insertion of specific contract details, dates, dollar amounts, and project descriptions.
