Contract Summary

Addendum No. 3 is a revision notice issued by the Illinois State Toll Highway Authority (ISTHA) to Contract RR-25-2026 on January 21, 2026. The addendum modifies key contract dates and includes revised contract documents, special provisions, and drawings. The primary changes involve extensions to critical project timelines to accommodate utility relocation and construction sequencing on a state transportation infrastructure project.

The contract involves bridge reconstruction, bridge rehabilitation, construction of new pavement, milling and overlaying of existing pavement, guardrail removal and installation, earthwork, grading, erosion and sediment control, drainage, Intelligent Transportation System (ITS) infrastructure, and maintenance of traffic on the Reagan Memorial Tollway (I-88) between Mile Post 44.5 and Mile Post 54.4 in Whiteside County and Lee County, Illinois. The Notice to Proceed has been revised from March 23, 2026 to May 18, 2026, with project completion targeted for October 28, 2027. The bid opening deadline has been extended from January 29, 2026 to February 20, 2026, with sealed bids to be received electronically via BidBuy until 10:30 a.m. local time. Work restrictions prohibit activity at Howland Creek bridges (BN 1257 and BN 1258) and the IL 26 ramp bridge (BN 1235) prior to April 15, 2027. Bidders must be pre-qualified by the Illinois Department of Transportation and registered with the Illinois Department of Human Rights. Each bid requires a five percent bid guaranty. A 22 percent Disadvantaged Business Enterprise (DBE) goal applies to the contract, with provisions allowing bidders to demonstrate good faith efforts in meeting participation targets.

FOR CONTRACT RR-25-2026

ILLINOIS STATE TOLL HIGHWAY AUTHORITY

Date: 1/21/2026

PLAN HOLDER QUESTIONS

Question No 1:

On October 3, 2025, the United States Department of Transportation (“USDOT”) issued updated regulations that impact DBE certification. Under the new rules that USDOT states are effective immediately, the Illinois Unified Certification Program (“ILUCP”) is required to reevaluate the disadvantaged status of all currently certified DBE firms to determine whether they can be recertified under the new rule.

The Illinois UCP website found at https://webapps1.dot.illinois.gov/UCP/ExternalSearch/ no longer lists any DBE certified firms. Currently, there are no DBE certified firms to utilize in meeting any DBE goals.

Is the DBE requirement for this contract waived and no longer required due to the change in status of the DBE program by the USDOT?

Response No. 1:

The Illinois UCP website does now list DBE certified firms. There will be no change(s) to the DBE goal(s) for this contract.

Question No 2:

The RR-25-2026 DBE goal of 22% in this geographic area is very high. Tollway contract RR-15-5712 in 2016 at this same location performed a very similar scope of work and the DBE goal was 15%. A typical IDOT DBE goal in this area is 5% or less. Would the Tollway consider lowering the goal on this contract?

Response No. 2:

The DBE goals for this contract were set based upon review of the scope of the work involved, estimated availability of DBE firms for those scopes of work from the current disparity study, the location of the work and history with similar projects, and other factors. The special provisions provide for award of contracts to bidders who either meet the established DBE goals or demonstrate good faith efforts to do so. If a potential bidder cannot obtain sufficient DBE participation to meet the contract goals, the bidder must document its efforts via the DBE Form 2023 Demonstration of Good Faith Efforts. For further assistance, please refer to the DBE Special Provisions regarding the good faith efforts/waiver process.
