About this file
This document is Amendment Two to Request for Proposals (RFP) #31701-03585 for Prepaid Debit Card Services issued by the Tennessee Department of Finance and Administration. The RFP seeks a contractor to provide prepaid debit card services for multiple state agency programs, including child support payments, unemployment insurance benefits, retirement system payments, education account payments, and state payroll. The contract is set for a five-year term, effective August 1, 2025, with key response dates including a May 20, 2025 deadline for written questions and a June 27, 2025 response deadline. The state plans to complete technical response evaluations by July 16, 2025, open and score cost proposals on July 17, 2025, and release a Notice of Intent to Award on July 22, 2025.
The amendment includes responses to potential bidders' questions, addressing technical details such as HIPAA compliance, reference requirements, customer service standards, and data security protocols. The state requires detailed technical and security specifications, including annual SOC 2 Type 2 examinations, penetration testing, and strict data protection measures. While no specific budget is mentioned, the contract appears to be structured so that the state incurs no direct costs, with potential revenue generated through cardholder fees for specific services. The RFP emphasizes comprehensive service requirements, including card functionality, customer support, reporting, and strict compliance with state enterprise information security policies.

1. 6.6 Pro Forma (Mandatory Terms & Conditions)
On page 20 of the Mandatory Terms & Conditions section of the RFP, it asks for the respondent to comply with the HIPAA Act.
Would our processor, Galileo, be able to fulfill the HIPAA requirements? For context, we don’t hold the data but our processor holds PHI data.
Since the Contract will be between the State and the Contractor the Contractor would be responsible for compliance with the terms and conditions of this Contract; it is up to the Contractor as the independent contractor to best decide how to fulfil the obligations of the Contract. The HIPAA Compliance term only applies if applicable and a separate Business Associate Agreement is not required at this time.
See RFP 31701-03585 Release 2 for revised language.
2. 6.6 Pro Forma (Mandatory Terms & Conditions)

See State’s response to question #1.
3. 6.4 Reference Questionnaire
On page 34 of the RFP, it asks for the respondent to provide references that fit the following:
• two (2) contracts Respondent currently services that are similar in size and scope to the services required by this RFP; and
• three (3) completed contracts that are similar in size and scope to the services required by this RFP.
Would our Bank’s (redacted) references work?
We are the program manager and redacted is our issuing partner, so would bank partner references count towards this requirement? If not, would the State modify this requirement to include both program manager and bank partner references?
No, Bank’s reference will not fulfill this requirement.
The State will not agree to revise this requirement.
4. 6.4 Reference Questionnaire
Would the State accept the Prime Vendor as the point of contact for #1 and #2 of the Reference Questionnaire? Additionally, would the State accept the Prime Vendor to arrange for contact with our references to validate the fully completed questionnaire for confidentiality concerns?
No, the State will not accept the Prime Vendor as the point of contact for #1 and #2.
No, the State will not accept the Prime Vendor to arrange for contacts on the references.
For confidentiality, see RFP 31701- 03585 Release 2, Section 4.8 Disclosure of Response to Contents.

7. 6.6 Pro Forma (Scope and Services)

No, the State will not modify this requirement.
8. 2. RFP

Shakuntala Smith If the contractor cannot or will not agree to abide by the State’s EISP, then we can use the conditional language below:
The Contractor shall implement and maintain privacy and security controls that follow the guidelines set forth in NIST 800-53, “Security and Privacy Controls for Federal Information Systems and Organizations,” as amended from time to time. Contractor shall meet annually, or as otherwise agreed, with the State to review the implementation of this Section. A “System Security Plan (SSP)” is required whether a vendor has FedRAMP, ISO27001, or SOC 2 Type II.
Mary Anne Queen No comments Q44 except that if the contractor cannot agree to the State’s EISP, it is my understanding that the Comptroller Audit Requirements would have to be revised since they specify EISP.
Revised.
