About this file

This Addendum #1 document, issued by KUA (Kissimmee Utility Authority) on July 16, 2026, provides clarifications and modifications to RFP 26-036-JG for Conduit Installation Services in Florida. The addendum addresses 22 questions from prospective bidders regarding contract scope, award structure, material provision, and technical requirements. Key clarifications include: work is issued on an as-needed basis at KUA's discretion; KUA reserves the right to award to a single or multiple contractors; KUA generally provides stick pipe while contractors provide rolled pipe; emergency response work is possible with oral orders followed by written work orders within 24 hours; and evaluation quantities in Exhibit A are for pricing evaluation purposes only and do not represent guaranteed annual volumes. The addendum confirms that proposals may be submitted as a single PDF document (except for the required Excel-format Exhibit A Pricing Sheet), with a two-page maximum for the letter of transmittal and no page limits for other sections. A revised Exhibit A Price Sheet is provided with updated amounts and corrected units of measure, which must be used for bid submissions.

Pricing terms allow contractors to invoice permit and right-of-way utilization fees at zero percent markup with receipts provided. The contract includes a 100% Performance Bond requirement based on projected maximum outstanding work balance rather than annual aggregate or contract not-to-exceed value. Price adjustments during renewal years (2-5) are subject to negotiation and KUA approval, with contractors required to identify their proposed price adjustment index in their proposal. Contractors must hold Osceola County underground-contractor registration prior to final contract execution; KUA will consider proposals from unregistered contractors but registration is mandatory before notice-to-proceed. The FEMA Reimbursement Rider is included to address potential FEMA reimbursement, and federal labor standards would apply only if federal funding or FEMA reimbursement is sought. Certification by a licensed Florida surveyor is required for as-built bore logs and as-builts using NAD83 Florida State Plane East coordinates in US survey feet. All bidders must acknowledge receipt of this addendum by signing and returning the form with their bid response.

TO: All Proposers FROM: Jennifer Grieves, Buyer DATE: July 16, 2026 RE: RFP 26-036-JG, Conduit Installation Services

ADDENDUM #1

Bidders are hereby notified that this addendum shall be made a part of the above-named Request for Proposal and agreement documents. The items listed below are issued to add, modify, and/or clarify the solicitation document and agreement documents. The items shall have the same force and effect as the original bidding and agreement documents, and cost involved shall be included in the bid pricing.

Bids, to be submitted, shall confirm with the addition and revision listed herein.

Return this sheet with your bid response.

I. QUESTIONS

Q1. Does this contract provide consistent work or is it on an as needed basis? How is work issued to the chosen contractor? Is the primary objective to only install conduit or is the wire, equipment, and switching also part of the work?

A1. Work is on an as needed basis and is issued at KUA discretion per operational needs. Work is issued based on pricing, availability, and performance. This work is for conduit installation only.

Q2. Will KUA award this contract to a single contractor or to multiple contractors?

A2. KUA reserves the right to award to a single Contractor or multiple Contractors, as determined to be in the best interest of KUA and in accordance with the solicitation.

Q3. Are contractors expected to provide all conduit materials or will certain projects be owner-furnished material?

A3. Generally, KUA provides the stick pipe, and contractor provides rolled pipe. There may be occasions where KUA asks the contractor to provide stick pipe too.

P a g e 2 | 6

Q4. Is emergency response work anticipated under this contract and, if so, what are the expected response times?

A4. Emergency response work is possible in rare cases. Emergency work may be ordered orally and followed up within twenty-four (24) hours by a written work order.

Q5. Will KUA provide estimated annual quantities for the major bid items included in Exhibit A?

A5. Please refer to the evaluation quantities provided in the Exhibit A Price Sheet. These quantities are provided for evaluation purposes only and do not represent guaranteed annual quantities.

Q6. Are permit and right-of-way utilization fees (County/City/FDOT) included in the unit prices, or reimbursed as a pass-through? TP.4 assigns permitting to the contractor but does not address fee reimbursement. (Ref:

TP.4).

A6. Contractor may invoice at zero percent markup for permitting fees by providing a receipt with their job invoice. Contractor should include estimated permit fee with any work estimates provided.

Q7. Because the FEMA Reimbursement Rider applies, will Davis-Bacon / Contract Work Hours prevailing wages be required for work under this contract, or only in the event of a federally declared disaster activation?

(Ref: FEMA Rider §14).

A7. The FEMA Reimbursement Rider is included to address the potential for FEMA reimbursement should it become applicable. This contract is not federally funded. If federal funding or FEMA reimbursement is sought for work performed under this contract, any applicable federal requirements, including labor standards, would apply only to the extent required by the applicable funding source and governing laws and regulations at that time.

Q8. Please confirm the proposal may be uploaded as a single PDF for the Tabs (cover letter through Tab F) with Exhibit A as a separate Excel file, and confirm there is no page limit other than the 2-page cover letter. (Ref:

§3; Tab G; §3.1.A).

A8. Proposal may be submitted as a single PDF document except for Exhibit A Pricing Sheet that is required to be submitted in Excel format. The letter of transmittal shall be no longer than two (2) pages. There are no other page limits.

P a g e 3 | 6

Q9. For the 50 price points, will the evaluated price be calculated from the Tab 1 extended totals only, or do the Tab 2 cost-plus percentages also factor into the scored price? The instructions make Tabs 1–2 mandatory but only state that Tab 3 is excluded from scoring. (Ref: §7; Tab G).

A9. Evaluation committee members may consider cost-plus percentages in their evaluation of pricing at their discretion.

Q10. For certified as-built bore logs and as-builts, please confirm the required GIS format and coordinate system (e.g., NAD83 Florida State Plane East, US survey feet) and whether a licensed surveyor seal is required. (Ref: TP.22; TP.3.2).

A10. Provide coordinates in X, Y (or Northing, Easting) format, NAD83 Florida State Plane East, US survey feet. Certification by a licensed Florida surveyor is required.

Q11. For renewal years 2–5, what index (e.g., CPI, PPI, ENR) will govern negotiated price escalation, and will any adjustment be capped? (Ref: §16;

Tab G).

A11. The Contractor shall identify the proposed price adjustment index in its proposal. Any request for a price adjustment during a renewal term must be supported by documentation demonstrating the change in the proposed index. Price adjustments are subject to negotiation and KUA's approval. If the parties are unable to reach mutually acceptable pricing for a renewal term, KUA reserves the right not to renew the Contract.

Q12. Is the $100,000 County/City continuation bond for roadway soft-dig work (TP.3.1) required of the prime contractor even when subsurface excavation is performed by a qualified, County-registered subcontractor?

(Ref: TP.3.1).

A12. Unless you have documentation from the authorized signatory approval officer of the City/County stating that it is not required; then it is required. If you have this documentation, then you should provide it with your proposal.

Q13. Please confirm that HDPE (SDR-13.5 per A.2) and restrained-joint conduit (Bore-Gard/Can-Loc per A.3) are the only contractor-furnished conduit, and that "or-equal" HDPE/RJ products meeting the Appendix A specifications are acceptable. (Ref: A.2–A.3; §31).

A13. This may be discussed during the Contract negotiation phase.

P a g e 4 | 6

Q14. Must the contractor hold Osceola County underground-contractor registration at proposal submission, or is registration required only prior to notice-to-proceed? (Ref: TP.7.9–7.11).

A14. KUA will consider proposals from Contractors that do not currently have this registration. However, proof of registration would be required prior to final Contract execution. Failure to obtain this registration would disqualify a Contractor.

Q15. For the Traffic Control (MOT) per-day line items (55–67), please confirm whether off-duty law enforcement and certified flagging are included in those day rates or compensated separately as project-specific MOT. (Ref: TP.4.5; Items 55–69).

A15. Per Exhibit "A" complex or project specific MOT shall be identified under a separate bid line item. In this case you would provide receipts and it would be cost plus via the subcontractor services markup.

Q16. Please confirm KUA furnishes, at no cost to the contractor, all items in Appendix A (Sch-40/Sch-80/galvanized conduit, PVC/galvanized elbows, meter sockets, hand-holes/boxes, and the 6" bollard pipe). Where are these picked up (KUA warehouse location), and what lead time should be assumed? (Ref: Appendix A; TP.18).

A16. Yes. KUA will furnish the items identified in Appendix A at no cost to the Contractor. These materials will be available for pickup at KUA's warehouse. Pickup scheduling and lead times will be coordinated with the successful Contractor after award based on material availability and project requirements.

Q17. Is professional liability / SUE-related insurance required for the Subsurface Utility Engineering (QL-B / SUE Manager) line items, beyond the Service Tier B schedule? (Ref: §39–40; TP.4.11).

A17. Yes. If you subcontract for this, then we will need to see proof of insurance held by your sub.

Q18. Are the Tab 1 "Evaluation Amount" quantities representative of KUA's expected annual work mix, and can KUA share the historical annual spend or volume under any predecessor conduit-installation contract? (Ref: Tab G; §6).

A18. No. The evaluation quantities are provided for evaluation purposes only and are intended to reflect the anticipated relative frequency of use of the listed items. They do not represent expected annual quantities or guaranteed volumes. KUA will not provide historical annual spend or quantities.

P a g e 5 | 6

Q19. Does KUA intend to award a single contractor or multiple contractors under this RFP? If multiple, approximately how many primary/secondary positions are anticipated? (Ref: §5 Split Award).

A19. KUA reserves the right to award to one or more Contractors, as determined to be in the best interest of KUA and in accordance with the solicitation. The number of awards, including any primary or secondary awards, has not been predetermined and will be at KUA's sole discretion.

Q20. Is the 100% Performance Bond required as an annual aggregate, per purchase order, or per the contract's not-to-exceed value? Given there is no guaranteed amount, please clarify the bonded value and renewal expectation. (Ref: Cover Page; §40).

A20. The Performance Bond is not required as an annual aggregate or based on the Contract’s not-to-exceed value. Instead, a 100% Performance Bond will be required based on the projected maximum outstanding work balance. The required bond must be submitted to and accepted by KUA prior to start of any new work.

Q21. Please provide the current pricing for Item Nos. 1 through 167, in full or in part, as applicable, in the file "RFP 26036JG Exhibit A Price Sheet.xlsx". Thank you.

A21. Regarding the requested pricing for Item Nos. 1 through 167 from the file "RFP 26036JG Exhibit A Price Sheet.xlsx," KUA will process this request in accordance with applicable public records requirements. Any available records will be provided following review. For future public records requests, please contact Records@kua.com.

Q22. 1) Item 81 please confirm the evaluation amount of 20,500 sf is the correct data entry quantity that is to be priced. 2) Is KUA able to provide technical specifications for missile boring similar to the HDD specifications TP.3.1 ? 3) Ambiguous unit of measure (items 78, 79, 82, 83): "Excavate & Haul Off Existing Asphalt/Concrete," "Seed and Mulch," and "Sand or Dirt" are listed as "Per Foot" instead of "Per Sq. Foot" - restoration work is normally measured by area. Is there a standard trench width is assumed (and what width), or whether this is a unit-of-measure error.

A22. Please use revised price sheet.

II. REVISED SOLICITATION DOCUMENTS
