The Procurement Official will be the single point of contact. All inquiries and questions must be directed to only the Procurement Official. Oral communications are discouraged and will not be binding to Energy Safety. Respondents should only rely on written statements issued by the Procurement Official.
7. METHOD OF AWARD
A multiple phase process will be used to review and assess offers to this RFO. Energy Safety will compare offers for the presence or absence of required information in conformance with mailto:tatianna.grant@energysafety.ca.gov the submission requirements. It is the Respondent’s responsibility to provide all required data and information necessary for Energy Safety to determine and verify the Respondent’s ability to perform the tasks and activities defined in Attachment 1, Sample Agreement, Exhibit A, Statement of Work.
Energy Safety may reject any offer found to be non-responsive at any stage of review. Shortly after the submission deadline, Energy Safety will review each offer for initial administrative responsiveness to the RFO requirements. Initial administrative responsiveness is an offer received by the due date and time and completeness of all required documentation.
Offers that appear to meet the initial RFO requirements and contain the required documentation will be submitted for evaluation. Refer to Attachment 7 – Assessment Plan for review requirements. Offers passing the Administrative Assessment and Technical Assessment will have their costs assessed. Award will be made to the Respondent with the highest score.
In the event of a tie, a coin toss will be a permissible tiebreaker. Such event will be conducted by the Procurement Official and observed by an Energy Safety employee as witness.
8. DRAFTS
If Energy Safety determines that offers from all Respondents contain material deviations, Energy Safety may declare the offers to be draft offers. If offers are declared drafts, Energy Safety will issue an addendum to this RFO, and confidential discussions may be held with the Respondents who wish to continue in the offer process. Notifying the Respondent of defects is intended to minimize the risk that the final offers will be non-compliant; however, Energy Safety will not provide any warranty that all defects in the draft offers have been detected.
Notification of defects in the draft offer will not preclude rejection of the final offer, if undiscovered defects contained in the declared draft offer are later found in the final offer. Oral statements made by either party during confidential discussions will not be binding.
9. NEGOTIATIONS
Energy Safety may elect to enter into negotiations pursuant to Public Contract Code section 6611 if conditions exist. Should Energy Safety elect to negotiate, the process will be described in writing and provided to the parties involved prior to commencement of negotiations.
10. RESPONSIBLE RESPONDENT
Energy Safety will review all offers that are responsive to all RFO requirements and deemed responsible. Responsibility is defined as a Respondent who possesses the experience, facilities, reputation, financial resources, and is fully capable of performing the services being requested.
Energy Safety may require Respondents to submit evidence of their qualifications. This includes, but is not limited to, the necessary number of personnel with the skills required, equipment of appropriate type and sufficient quantity, financial resources sufficient to complete performance under the Agreement, and experience in similar endeavors. If such information is required, the Respondent will be notified to submit the required information. If Energy Safety determines the Respondent is not responsible, the offer will be rejected.
11. RESPONDENT INSTRUCTIONS
The instructions include the Respondent’s and Energy Safety’s rights and responsibilities for the solicitation process, unless otherwise specified in this solicitation. Respondent instructions are located at the following link: Bidder Instructions (rev 11/09/2011).
12. ADDENDUM
If the RFO is revised by an addendum, the Respondent is required to meet all requirements of the most current addendum, including using any updated forms.
The RFO document is not required to be submitted with the offer. This language supersedes GSPD-451, Bidder Instructions (rev 11/09/2011) section 3.b., Solicitation Addendum.
13. RESPONDENT QUESTIONS
This RFO and all its attachments address all requirements that Respondents must meet to be eligible for consideration. Respondents must carefully read the entire RFO, ask appropriate questions in a timely manner, and make sure all procedures and requirements of the RFO are accurately followed and addressed.
If a Respondent discovers any ambiguity, conflict, restrictive requirements or specifications, discrepancy, omission, or other errors in the RFO, the Respondent will immediately notify the Procurement Official of such error, in writing, and request clarification or modification of the document.
All questions, comments, and concerns should be immediately directed to the Procurement Official or backup Procurement Official, in writing, no later than the date and time indicated in Section 2, Key Action Dates. If a Respondent submits a question after the scheduled date(s), Energy Safety may attempt to answer the question but does not guarantee that the answer will be provided prior to the offer submission due date.
Note: Answers to all questions will be posted via addendum and sent to all potential Respondents via email.
14. DESIGNATION OF REQUIREMENTS
A deviation, if not material, may be waived by Energy Safety. A deviation from a requirement is material if the deficient offer is not in substantial accord with the RFO requirements and provides an advantage to one Respondent over other Respondents, or has a potentially significant effect on the delivery, quantity or quality of items proposed, amount paid to the Contractor, or on the cost to Energy Safety. Material deviations cannot be waived.
The words “should” or “may” in the RFO indicate desirable attributes or conditions but are non-mandatory in nature. Deviation from, or omission of, such a desirable feature, even if material, will not in itself cause rejection of the offer.
http://www.documents.dgs.ca.gov/dgs/FMC/GS/PD/DGSPD%20451.pdf
15. VALIDATION OF REQUIREMENTS
Energy Safety will check each offer to determine its compliance with the solicitation requirements. If an offer fails to meet solicitation requirements, Energy Safety will determine whether the deviation is material. A material deviation will be cause for rejection of the offer.
16. CLARIFYING INFORMATION
During the assessment and selection process, Energy Safety may ask the Respondent to clarify conflicting information in their offer when compliance with the solicitation requirements cannot be determined. Clarifications provided by the Respondent may not change the original offer submission. Missing or non-compliant offer information is not grounds for Energy Safety to request clarification. Clarification will not be requested if the offer is non-compliant with other mandatory requirements.
Failure to submit the requested written information within the timeframe provided by Energy Safety will be grounds to reject the offer.
17. EXECUTIVE ORDER N-6-22 – RUSSIA SANCTIONS
On March 4, 2022, Governor Gavin Newsom issued Executive Order N-6-22 (EO) regarding Economic Sanctions against Russia and Russian entities and individuals. “Economic Sanctions” refers to sanctions imposed by the United States government in offer to Russia’s actions in Ukraine, as well as any sanctions imposed under state law. By submitting a proposal, Respondent represents that it is not a target of Economic Sanctions. Should Energy Safety determine Respondent is a target of Economic Sanctions or is conducting prohibited transactions with sanctioned individuals or entities, that shall be grounds for rejection of the Respondent’s proposal any time prior to agreement execution, or, if determined after agreement execution, shall be grounds for termination by Energy Safety.
18. TAX DELINQUENCY
Pursuant to the Public Contract Code section 10295.4, prior to executing any agreement or renewal for non-IT goods or services, the awarding department must verify that the Respondent is not on either of the prohibited lists below. Alteration of Energy Safety’s documents may result in rejection of the offer. Offers submitted referring to supplier attachments which include terms and conditions that conflict with Energy Safety’s solicitation will be considered non-responsive and such offers will be rejected.
