About this file
This is a Narrative Response form (Attachment 3) for RFO 25-1042, a Business Solutions Analyst Consulting Services opportunity issued by the State of California. The document serves as a submission template requiring respondents to provide their company name, SB/DVBE certification number, and Secretary of State Business Entity Number. The form addresses three primary narrative requirements that bidders must complete as part of their response package.
The form requires respondents to disclose their use of Generative Artificial Intelligence (GenAI) technology, mandating written notification if the bidder intends to provide GenAI as a deliverable or utilize GenAI—including from third parties—to complete any portion of a deliverable that materially impacts State system functionality, risk exposure, or contract performance as defined in State Administrative Manual 4986.2. Failure to disclose GenAI usage may result in bid disqualification, and the State reserves the right to incorporate special GenAI provisions into the final contract or reject bids presenting unacceptable risk. Additionally, respondents must indicate whether they conducted business outside the United States within the past three years, with affirmative responses requiring submission of the Darfur Contracting Act Form. The form provides checkboxes for yes/no responses to these requirements, establishing clear compliance expectations for all bidders.

NARRATIVE RESPONSE
Instructions: Respondent must complete each line item outlined below:
RESPONDENT NAME: SB/DVBE Cert. #
NARRATIVE QUESTIONS:
1. GENERATIVE ARTIFICIAL INTELLIGENCE (GenAI) REQUIREMENTS
The State of California seeks to realize the potential benefits of GenAI, through the development and deployment of GenAI, while balancing the risks of these technologies.
Bidder must notify the State in writing if it:
1. Intends to provide GenAI as a deliverable to the State; or
2. Intends to utilize GenAi, including GenAI from third parties, to complete all or a portion of any deliverable that materially impacts:
- Functionality of a State system,
- Risk to the State, or
- Contract performance. For avoidance of doubt, the term “materially impacts” shall have the meaning set forth in State Administrative Manual (SAM) 4986.2
Failure to report GenAI to the State may result in disqualification. The State reserves the right to seek any and all relief it may be entitled to as a result of such non-disclosure. Upon notification by a Bidder of GenAI as required, the State reserves the right to incorporate GenAI Special Provision into the final contract or reject bids that present an unacceptable level of risk to the State.
Government Code 11549.64 defines “Generative Artificial Intelligence” (GenAI) as an artificial intelligence system that can generate derived synthetic content, including text, images, video, and audio that emulates that structure and characteristics of the system’s training data.
