About this file

This is a Protest Decision document from the South Carolina Department of Transportation (SCDOT) regarding a sole source procurement for Pavement Data Collection Services. On January 2, 2020, SCDOT published an Intent to Award without Competition to Cyclomedia Technology, Inc. for pavement data collection services under Solicitation No. 5400019180. Pathway Services, Inc. filed a formal protest on January 9, 2020, challenging the sole source designation and asserting that competition existed for these services. Following the protest, SCDOT notified the Chief Procurement Officer on January 14, 2020 that it agreed with Pathway Services' position.

The Chief Procurement Officer granted Pathway Services' protest on January 21, 2020, and cancelled the award to Cyclomedia Technology, Inc. The procurement was remanded to the South Carolina Department of Transportation to be resolicited in accordance with the SC Consolidated Procurement Code. This decision is final and conclusive unless fraudulent, though either party may request further administrative review by the Procurement Review Panel within ten days of the decision posting. Any such request for further review must be submitted in writing and accompanied by a $250 filing fee, unless a waiver is requested based on financial hardship.
