DOCUMENT NOTE: This project is being solicited as a Request for Proposal (RFP), and not an Invitation for Bid. Throughout this Project Manual, you may see the terms “bid”, “bidder”, and “bidding”. These terms are synonymous with the terms “offer/proposal”, “offeror”, and “proposing”; respectively. The latter are the terms to be referred throughout this RFP solicitation

SUMMARY OF WORK

NOTE: Acronyms: Throughout this Project Summary document, acronyms may be used for the purpose of brevity. They are as follows:

- Contracting Officer is referred to as “Contracting Officer” or “CO”.

- Contracting Officer’s Representative is referred to as “Contracting Officer’s Representative” or

“COR”.

1.1 DESCRIPTION

A. The National Park Service intends to contract for the replacement of an existing heating and air conditioning system at the Beedle House, located at 411 South 8th Street within the Lincoln Home National Historic Site in Springfield Illinois. Generally, the work to be performed is for the removal of existing heating and air conditioning system and replaced with a new geothermal system, and DDC controls.

B. The Beedle House is located within a nationally significant historic neighborhood. The Contractor must take care not to disturb or change important resources that may be located within the project area.

C. The building will be inhabited for the duration of the project. The work schedule must reflect the need to accommodate the Park Service employees working in the space.

1.2 SUMMARY OF WORK

A. The work of this contract consists of the Contractor furnishing all labor, qualified supervision, products, equipment, materials, tools, supplies, incidentals, and other services and expertise necessary, to modify from a gas fired heating and air conditioning (HVAC) system to a geo-thermal field HVAC system. Remove existing gas meter and cap gas line, remove existing combustion air and vent piping and remove existing gas fired furnace, condensing unit and associated equipment. Design, furnish and install a geothermal well field, piping, manifolds, pumps and forced air equipment to complete a working geothermal system. Furnish and install digital controls that link with the parks existing network computer control system for the Beedle House.

1. Remove one gas fired furnace and one five ton condensing unit with line set.

Replace with one five ton geothermal unit with a bypass humidifier and whole home dehumidifier and DDC controls. Drill seven one hundred fifty foot wells in lot to the north of the Beedle House and directional bore piping to connect to the new geothermal unit located in the basement of the Beedle House.

a. The geothermal unit must be closed loop type, five ton, using a two stage unloading scroll compressor, with a cop of 4.7 and an EER of 32. Carrier model GT packaged closed loop geothermal unit, or approved equal.

b. The Dehumidifier unit must be whole home duct type with the capacity to remove 135 pints of water a day. Aprilaire Model 1770A or approved equal.

c. The humidifier must be whole home bypass type with water saving technology. Aprilaire Model 400 or approved equal.

d. DDC controls must be provided and installed by Alpha Controls & Services LLC, 4104 Charles Street, Rockford, IL 61108.

2. Existing ductwork shall be utilized where practical, additional ductwork required must be included in the offeror’s original proposal.

3. The wells for the geo-exchange loop field will be located in the open lot north of the Beedle House. Bore and install geo-exchange loop lines from the well head trench location in the vacant lot north of the Beedle House to the north basement area of the Beedle House at a minimum depth of seventy two (72) inches. The contractor shall setup in the vacant lot (refer to Site Map - Attachment 2) and directional bore under the fence and boardwalk through the north yard of the Beedle House to the mechanical room of the Beedle House where wall penetration will be made. The Contracting Officer’s Representative (COR) shall approve all wall penetrations in the foundation of the Beedle House.

4. All construction materials shall be new and unused. Any exceptions must be in writing; requested by the Contractor and approved by the Contracting Officer.

5. All work will comply with the local, federal, and state building codes and regulations.

6. Care must be taken to protect interior floor coverings and furnishing from any materials, equipment, and work performance, such as paint, stains, dust, lubricants, scratches, markings, etc…

7. The equipment being removed are to remain the property of the Park and are to be turned over to the COR upon their removal.

8. To the Government’s knowledge there are no asbestos-containing or lead-based substances in the areas where work is to be performed.

B. Any damages caused by Contractor in the performance of the contract, shall be replaced or repaired to the Government’s satisfaction at the Contractor’s expense, without cost to the Government. Any materials used to repair or replace damaged areas are to be approved by the COR prior to performing the repair or replacement.

C. All work will be performed under a single firm fixed price contract.

D. It is estimated that a contract for this project shall be awarded in July 2015 time frame.

All work is to be completed no later than ninety (90) calendar days from the CO’s issuance of the “Notice to Proceed” to the Contractor.

E. The Contractor will be responsible for the entire scope of this project; all work required by the project documents shall be accomplished even though minor items required may not be specifically mentioned in the aforementioned description.

1.3 LOCATION

A. The location of the work to be performed under this contract shall be at the Beedle House, located within the Lincoln Home National Historic Site at 411 South Eighth Street, Springfield IL, 62701.

1.4 JOB CONDITIONS AND CONTRACTOR’S USE OF PREMISES

A. Work Coordination

1. The Contractor shall coordinate all work schedules with the CO or COR prior to the start of work. Notify the COR at least five (5) working days prior to moving onto the work site to commence work. Before initiating any work, the Contractor shall meet with the COR to discuss, at a minimum: a sequence of procedures; parking; a means of access to premises and buildings; placement of dumpsters and haul routes; delivery of materials and use of approaches; use of corridors, stairways, elevators, and similar means of egress; communications, the location of partitions and barriers; eating spaces, and restroom for contractor’s employees, and any other incidentals to the project.

2. With the exception of inclement weather, Acts of God, and conditions experienced or events planned by the Park which would prevent the Contractor from performing, it is expected the Contractor shall be on the site performing each work day. If it becomes necessary for the Contractor to interrupt work activities, the Contractor shall submit a written request to the Contracting Officer at least three (3) working days in advance. Contractor must provide notification the day Contractor moves back to the work site after an interruption of work of two or more work days.

B. Public Access: The Contractor shall at all times conduct his operations to ensure the least inconvenience to, and heightened safety awareness for, Park employees and the public. The building will be occupied by Park employees and open to the public during construction. Contractor is to provide adequate barriers in work areas to protect persons from injury from construction operations.

C. Full Government Occupancy Requirement for Building: Government will occupy building that will be under construction during the entire contract period. Cooperate with Government during construction operations to minimize conflicts and facilitate Government usage. Perform the work so as not to interfere with the Government’s day-to-day operations. Maintain existing exits, unless otherwise indicated.

1. Do not close or obstruct walkways, corridors, sidewalks, streets, roads and other adjacent occupied or used facilities. Closures to sidewalks, streets, roads, or other access means will only be permitted when required and only upon written approval by the CO, and when proper directional signage and barriers are provided by the Contractor.

2. Keep driveways and entrances serving premises clear and available to

Government, Government’s employees, and emergency vehicles at all times. Do not use these areas for storage of materials.

3. Maintain existing building in a weather tight condition throughout construction period. Repair damage caused by construction operations.

Protect building and its occupants during construction period.

D. Work Restrictions: Work shall be performed between the standard hours of 7:00 a.m.

and 3:30 p.m. local time, Monday through Friday, excluding federal holidays, and except when otherwise indicated by the Contracting Officer. If desiring to work outside the standard hours, Contractor must submit a written request to the CO at least three (3) work days prior to the proposed performance of work. The written request should state the proposed performance of work, day/days, time/amount of work, and reason why authorization should be granted to perform work during non-standard hours. Work outside the standard hours is prohibited unless approved by the CO. Work during non-standard work hours shall be at no additional expense to the Government.

E. Preservation of Structures: Every precaution shall be taken to prevent damage to the structures and the surrounding areas. Should any damage be incurred as a result of the Contractor’s operations, it will be repaired and/or the damaged materials replaced, in kind, by the Contractor, to the satisfaction of the Contracting Officer at no additional expense to the Government.

F. Project Superintendent: Contractor must have a designated superintendent at the contract site at all times during work performance, to include work which may be performed by a subcontractor. The superintendent’s duties shall include the overall management of the project, coordination of the subcontractor’s work, and liaison with the CO and COR. The designated Project Superintendent, and any alternate, shall be thoroughly familiar with the scope of work, specifications, drawings, and terms and

conditions of the contract. No work shall be performed without the presence of the superintendent on the job site.

G. 24-Hour Point of Contact: Provide the CO and COR with a 24-hour number or numbers where the designated superintendent and an alternate can be contacted at any time.

H. Access to Sites: The sites for contract performance do have special access requirements and require coordination with the COR. Contractor shall have limited use of the site for construction operations. Limit use of the premises to the Beedle House where work is to be performed. Do not disturb portions of project site beyond area in which the work is indicated.

I. Storage Restrictions: A storage trailer which may be required for the Contractor’s operation shall be the responsibility of the Contractor. Contractor is to confine storage of materials to Contractor’s work vehicles or storage trailer.

1. Any type of storage trailer used must be portable and removed from the site at the end of each work day unless approved three business days prior by the CO.

2. Contractor is responsible for general maintenance of construction site and storage area(s) on a daily basis. This includes, but is not limited to, lawn mowing, ice and snow removal, and disposal of trash and debris.

3. Remove trailers and surplus stored materials at completion of each work day.

4. Contractor must provide suitable storage for all combustible and flammable materials. Type and location of storage to be approved, in advance, by the CO.

5. Schedule deliveries to minimize use of driveways and entrances, and to minimize space and time requirements for storage of materials and equipment on-site.

J. Construction Camp: Establishment of a camp within the Park will not be permitted.

K. Preservation of Natural Features:

1. Confine all operations within the work limits of the project. Exercise special care to leave the natural surroundings undamaged. Restore damaged areas, repairing or replacing damaged trees and plants, at no additional expense to the Government. Contractor will be responsible for all costs associated with restoration of the project area.

2. Do not remove, injure, or destroy trees or other plants without prior approval of the CO or COR. Consult with the CO or COR to remove agreed-on roots and branches that interfere with construction.

3. Do not fasten ropes, cables, or guys to existing trees.

4. Carefully supervise excavating, grading, filling and other construction operations near trees and natural resources to prevent damage.

L. Equipment Restrictions: Use only equipment that can safely negotiate work area and as authorized by the COR.

M. Hauling Restrictions: Comply with all legal load restrictions in the hauling of materials.

Load restrictions on park roads are identical to the state load restrictions with such additional regulations as may be imposed by the Park Superintendent. A special permit will not relieve Contractor of liability for damage which may result from moving of equipment.

N. Disposal and Recycle:

1. Unless otherwise specified by the CO, COR, or elsewhere in this Project Manual, all removed material and excess excavated material that cannot be used in construction of the project is to be disposed of outside the park at an approved landfill, recycling center, or disposed of at other locations in accordance with federal, state, and local regulations. All recyclable construction debris/scrap/materials will be turned in to a recycling center when possible.

Contractor is to provide the Government with documentation from the recycling center identifying the type, weight/volume of the recyclable materials accepted from the Contractor.

2. The Contractor shall also recycle general administrative refuse associated with this project. This refuse includes cardboard, one gallon mark 1 and mark 2 plastic bottles, type 1 and 2 plastic soda bottles, aluminum and steel soda cans, and mixed paper. All such recyclable material shall be turned over to the Park’s maintenance personnel.

O. Ozone Depleting Substances: Ozone depleting substances which the Environmental

Protection Agency designates in 40 CFR Part 82 as Class I and Class II, are to be recovered by the Contractor and returned to the Government. The ozone depleting substances may not be sold or given away to private industry unless otherwise specified by the Government.

P. Products Not Allowed: Materials containing asbestos, transformers containing PCB fluid, and the use of lead based paints or paints containing chromates are prohibited.

Q. Park and Safety Regulations: Comply with all applicable National Park Service regulations and directives pertaining to security, safety, occupational health, fire, traffic, and personnel clearances while on the premises of the Park. Contractor will brief contractor’s employees and subcontractors on the same, and maintain documentation that all employees and subcontractors have been briefed.

R. Fire Prevention and Protection:

1. A capable and qualified person shall be placed in charge of fire protection. The responsibilities shall, at a minimum, include locating and maintaining fire protective equipment.

2. Hazard Control: Take all necessary precautions to prevent fire during construction. Do not store flammable or combustible liquids in historic structures or existing buildings. Provide adequate ventilation during use of volatile or noxious substance.

3. Locate internal combustion equipment so that exhausts discharge well away from combustible materials.

4. Welding: Welding or cutting by torch will not be permitted in or on the structure unless approved in advance by the COR.

S. Nonsmoking Building: Smoking is not permitted within the building or within 25 feet of entrances, operable windows, or outdoor air intakes. Smoking shall only be allowed in smoking areas as designated by the Park.

T. Public Utilities

1. The Contractor is permitted the use of the utility services such as electric, gas, sewer, and water in the performance of this contract. Should Contractor require utilities for operation of storage trailer, Contractor shall make metered temporary connections at his own expense and be responsible for the charges incurred for the utilities consumed, to include the disconnection and removal of temporary service lines. When making a temporary connection for water, backflow devices will be used.

2. Should relocation of existing and/or new construction of commercial utilities be required, Contractor is to contact the applicable utilities and pay for all relocation and/or new utility construction and project costs.

3. The Park requires the Contractor to provide portable restroom facilities for the duration of this contract. The location for placement of these facilities must be pre-approved by the Contracting Officer (CO) or the Contracting Officer’s Representative (COR) before delivery.

4. If refuse will be generated by Contractor in the performance of this contract;

the Contractor will be responsible for providing its own dumpster. The dumpster size and staging location shall be approved and coordinated with the Contracting Officer’s Representative (COR). Contractor must not leave refuse on the ground or around the dumpster should it reach or be at full capacity.

U. Protection of Existing Utilities: Before construction begins, the Contractor shall locate all utilities in the vicinity of and ground disturbance. The Contractor shall be responsible for complying with all regulations pertaining to utilities in the State where work is to be performed. The Contractor shall assume all risks for all utilities located in the vicinity of his work, whether above or below the ground surface. The Contractor shall also be responsible for all damages and assume all expenses for direct or indirect injury caused by his work, to any of the utilities, or any person or property by reason of injury to them, whether such utilities are or are not shown on the drawings, once they have been uncovered by the work.

V. Utility Interruptions: Notify COR not less than five (5) working days in advance of proposed utility interruptions. Do not proceed with utility interruptions without CO’s written permission.

W. Security:

1. The security of Contractor’s materials, tools, equipment and other properties remain the responsibility of the Contractor at all times. The Park will accept no responsibility and shall not be liable for Contractor’s properties left on site should they become lost, damaged or stolen at any time during the contract period.

2. Contractor shall comply with all security requirements as imposed by the Park, which may include but not limited to, Contractor’s and subcontractor’s personnel, drivers and vehicles being subject to checks for valid registration and wants/warrants. Individuals who do not pass the security check will not be authorized access to the site.

X. Permits: It is the Contractor’s responsibility to arrange for the marking of utilities and acquiring any permits which may be required in the performance of the work.

Y. Inspection: Obtain the COR’s approval prior to accomplishing tasks such as closing walls, filling in trenches, or performing tests. The request for such approval shall be given with sufficient advance notice to permit an inspection of the area before the work or test is accomplished.

Z. Environmental Management System: Contractor will reduce environmental risks, promote pollution prevention, and meet all environmental regulatory requirements during the execution and completion of the contract.

AA. Traffic Control: The Contractor shall provide, erect, maintain and subsequently remove all traffic control devices required to gain access to the site and/or complete the work.

The traffic controls shall be in accordance with the ‘Arkansas Manual of Uniform Traffic Control Devices for Streets and Highways.’ Traffic control devices shall be provided with suitable supports of sufficient strength and stability. Traffic control shall be considered incidental to the completion of the project and no separate payment shall be made for this work. The Contractor shall complete the project so as to minimize the disruption of traffic flow within the work area.

BB. Patching and Repairing: After the work has been completed, any Contractor-caused damages to Government-owned structures, facilities, streets, curbs, walks, lawns, etc., shall be properly patched, repaired, or replaced to the complete satisfaction of the Contracting Officer. Any holes, cuts, breakages, and damages made in finished surfaces of the area in which work has been accomplished, shall be properly repaired and the disfigured areas otherwise repaired and resurfaced to the complete satisfaction of the

CO.

1.5 FIELD VERIFICATION

A. Field verify all new and existing dimensions affecting the work of this contract. Failure to do so prior to the submission of your quote and before ordering products shall not be cause for claim in the performance of the contract.

PROJECT MEETINGS

1.1 PRECONSTRUCTION CONFERENCE

A. Before start of construction, the Contracting Officer will arrange an on-site meeting with the Park and Contractor which is referred to as the Preconstruction Conference. After award of contract, the Contracting Officer will notify Contractor of the tentative date for the meeting. Attendance by the Contractor is mandatory. At the discretion of the Contracting Officer, the meeting may also include the Contractor’s subcontractors, and other Park personnel who have an interest or are impacted by the project. The meeting agenda will be prepared by the Contracting Officer and distributed at the Preconstruction Conference.

B. Within ten (10) calendar days after award of the contract, and prior to the

Preconstruction Conference, the Contractor must provide and submit to the Contracting Officer for the Government’s review, the documents and items listed below:

1. Certificates of Insurance in the limits and as required by the terms of the contract.

2. Alternative Payment Protection and/or Payment and Performance Bonds as may be required by the terms of the contract.

3. Comprehensive summary of submittals which are to be transmitted to the

Contracting Officer for approval throughout contract performance.

4. Proposed Construction Progress Schedule, utilizing October 1, 2014 as the date the contractor receives the Notice to Proceed. Contractor is to commence work within seven (7) calendar days from the receipt date of the Notice to Proceed.

5. Contractor to submit a Schedule of Values.

6. Letter designating your Site Superintendent and, if applicable, Alternate Site

Superintendent; Project Manager, Safety Officer, Quality Control Supervisor. As appropriate for the scope of this contract, these responsibilities may be combined and performed by one or more qualified individuals. 24-hour number or numbers where the designated Site Superintendent and an alternate can be contacted at any time shall also be provided.

7. A list of the position classifications to be used in the performance of this contract (from the contract’s DBA Wage Determination).

8. List of subcontractors, if any, being used for this project.

9. Written statements from subcontractors certifying compliance with applicable labor standard clauses. (SF Form 1413 – Statement and Acknowledgment)

10. Accident Prevention Program / Safety Plan.

11. Waste/Recycling Plan.

12. Quality Control Plan.

13. Location of source for Borrow Material (if applicable).

C. Should the above documents not be received by the Contracting Officer within seven (7) calendar days after contract award, the scheduled Pre-Construction Conference will be cancelled, Notice to Proceed will not be issued, and the Contracting Officer will consider other contractual remedies. Work shall not commence until the Contracting Officer has issued the written Notice to Proceed.

1.2 PROGRESS MEETINGS

A. Contracting Officer will schedule progress meetings with Contractor throughout the duration of the contract. Included in the meeting will be those individuals appropriate to the agenda topics. These may be held at the contract site or telephonically as determined by the Contracting Officer.

B. Topics to be discussed during the progress meetings may include, but not be limited to submittals, delivery schedules, quality control, requests for information, work in progress, schedule updates, safety, and other business relating to work under the contract.

SUBMITTALS

1.1 DESCRIPTION

A. The work of this section consists of submittal requirements before and during construction and at Project Closeout.

1.2 DEFINITIONS

A. Action Submittals: Written, graphic information, and physical samples that require

Government’s responsive approval action. Submittals may be rejected for not complying with requirements.

B. Information Submittals: Written information that does not require Government’s responsive action; but does require the Government’s acceptance. Submittals may be rejected for not complying with requirements.

1.3 RELATED REQUIREMENTS

A. Section 01770 - Project Closeout

B. Contractor is required to complete the Daily Log of Construction Form (a copy of which is located at the end of this section) and submit it to the Contracting Officer’s Representative daily, commencing on the date the Contractor is in receipt of the Notice to Proceed. Additional instructions on Contractor’s submission of daily logs shall be provided at the preconstruction conference. A transmittal form is not needed in the submission of the daily logs.

1.4 SUBMITTAL AND APPROVAL PROCEDURES

A. All submittals shall be transmitted using National Park Service form CM-16 dated R03/10

(a copy of the form is located at the end of this section). No action will be taken on a submittal item unless accompanied by this form.

B. The Contracting Officer reserves the right to require submittals in addition to those called for in the contract documents and which are identified in the Contractor’s Comprehensive Summary of Submittals. No materials will be installed or used until submittals have been approved and signed by the COR and CO.

C. Forward submittals to the Contracting Officer at least seven (7) calendar days before need for approval (action submittals) or acceptance (informational submittals). Unless a different number is specified, electronically (via e-mail) submit one (1) copy of each shop drawing, manufacturer’s catalog sheets (cut sheets), and one (1) copies of all other submittals required and requested for this project. Specimen samples are to be delivered to the COR with the accompanying transmittal form submitted to the CO. At the completion of the project and as part of the final closeout, Contractor shall also be

required to submit two (2) hard-copies, and digital files on two (2) CDs or USB flash drives, of final shop drawings, schedules, Operations and Maintenance Manual, product information, and manufacturer/dealer warranties, Contractor’s warranties, and other such documents called for within the contract documents. Acceptable applications for digital files are .pdf, .docx, .xlsx. .jpeg files are to be used for photographs only. Prior to generating and submitting files in any other application, check with the CO for acceptability.

1. Shop Drawings: Include the following information with each copy of shop drawings:

a. Date

b. Date of revisions (when applicable)

c. Contractor’s certification that shop drawing has been checked for compliance with contract documents.

d. Details of fabrication, assembly and erection including connections and engagement to contiguous work.

e. Materials used.

f. All required dimensions.

g. The term “by others” shall not be used. All work to be performed by others shall be identified by Contractor or subcontractor name, discipline, or trade.

2. Samples: Samples shall be large enough to illustrate clearly the functional characteristics and full range of color, texture, pattern, or grade.

3. Manufacturers’ Catalog Sheets (Cut Sheets): Submit only pertinent pages; mark each copy of standard printed data to identify specific products proposed for use.

4. Manufacturers’ Installation / Application Instructions: When contract documents require compliance with manufacturers’ instructions, and should such instructions provide options for installation and/or application, indicate on the instructions which option is being recommended for utilization.

5. Construction Materials: The Contractor is encouraged to submit for approval products made out of recycled or environmentally responsible material. Every effort will be made by the National Park Service to approve these materials.

D. Coordinate preparation and processing of submittals with performance of construction activities. Review them for legibility, accuracy, completeness, and compliance with contract requirements. Forward submittals that are related to or affect one another as a package to facilitate coordinated review and so as not to delay contract performance.

The Contracting Officer reserves the right to withhold action on a submittal requiring coordination with other submittals until related submittals are received. If the contractor intends to supply materials that differ from the salient characteristics which are specified in the contract documents, then a submittal will be required.

E. Approved Equals

1. For each item proposed as an “approved equal,” submit supporting data to include the following:

a. Drawings and samples as appropriate.

b. Comparison of the characteristics of the proposed item with that specified.

c. Changes required in other elements of the work because of the substitution.

d. Name, address and telephone number of the vendor.

e. Manufacturer’s literature regarding installation, operation and maintenance, schematics for electrical and hydraulic systems, lubrication requirements and parts list. Describe availability of maintenance service and state the source of replacement materials.

2. A request for approval (which is included at the end of this Section entitled

“Proposed Equal Form”) constitutes a representation that the Contractor:

a. Has investigated the proposed item and determined that it is equal or superior in all respects to that specified.

b. Will provide the same warranties for the proposed item as for the item specified.

c. Has determined that the proposed item is compatible with interfacing items.

d. Will coordinate the installation of an approved item and make all changes required in other elements of the work because of the substitution.

e. Waives all claims for additional expenses that may be incurred as a result of the substitution.

F. Submittal Identification

1. All sets of drawings, manufacturer’s catalog sheets, samples, and other documents submitted to the Contracting Officer must have the Park Name, Contract Number, and Submittal Number applied to each.

2. This identification information shall be applied to the bottom right margin on each document. If there are multiple pages to a document, the identification information need only be printed on the first page or cover sheet.

3. Identification information on samples shall be applied to the most readily visible area on the sample or on a label or tag affixed to the sample.

G. Submittal Numbering

1. Number each submittal consecutively, list on the NPS Transmittal CM-16 Form, and submit to the Contracting Officer for review. The Transmittal CM-16 Form, consisting of two pages, is found at the end of this Section.

2. For resubmittals, use the original submittal number, plus a letter suffix, beginning with the alpha character “A”.

3. Additional re-submittals of the same item shall contain the original number with the next consecutive letter; e.g., “B”, “C”, “D”, etc.

H. Transmittal Numbering

1. Number each transmittal consecutively. No two transmittals shall have the same number. The transmittal number is entered in the top right block on the Transmittal CM-16 Form.

I. Contracting Officer’s Review

1. Submittals will be returned disapproved without technical review if identification information is missing, not filled in, or if placed on the back of the submittal; an incorrect number or format of submittals is provided; the transmittal form is incorrectly filled out; submittals are not coordinated; or submittals do not show evidence of Contractor’s approval.

2. Any work done or orders for materials or services placed before approval shall be at the Contractor’s own risk.

3. After reviewing submittals, the Contracting Officer will return one copy of the

Transmittal CM-16 Form and one copy of applicable (marked up) submittal sheets to the Contractor. Shop drawing review notations will be returned on the reproducible original shop drawing. All other submitted items will be retained. The Contractor is responsible for producing additional copies for his/her own use.

4. The returned Transmittal will be marked in one of three ways as defined below:

a. APPROVED: Acceptable with no corrections.

b. APPROVED WITH NOTATIONS: Minor corrections or clarifications required. All comments are clear and no further review is required. The Contractor shall address all review comments when proceeding with the work.

c. DISAPPROVED - RESUBMIT: Rejected as not in accordance with the contract or as requiring major corrections or clarifications. The Contracting Officer will identify the reasons for disapproval. The Contractor shall revise and resubmit with the changes clearly identified within two (2) business days from Contractor’s receipt of the Returned Transmittal. A greater number of days may be granted by the Contracting Officer if the resubmittal is of such a complexity, or the period of time for the Contractor to gather the information for the re-submittal, warrants the extension.

5. Use for Construction: Use only final submittals with mark indicating “Approved” or “Approved with Notations.” Ensure all notations have been incorporated and, at a minimum, keep one copy of the final approved submittal on site for use during construction.

SECTION 01360

ACCIDENT PREVENTION

1.1 DESCRIPTION

A. The work of this section consists of establishing an effective accident prevention program and providing a safe environment for all personnel and visitors.

1.2 SUBMITTALS

A. Accident Prevention Program: After contract award and before the Preconstruction Conference, submit for approval an Accident Prevention Program / Safety Plan. The Contracting Officer’s Representative will review the proposed program for compliance with OSHA and project requirements. If the program requires any revisions or corrections, the Contractor shall resubmit the program within two (2) business days. No work on the contract site shall be performed without an approved Accident Prevention Program/ Safety Plan. The program shall include:

1. Name of responsible supervisor to carry out the program.

2. Weekly and monthly safety meetings.

3. First aid procedures.

4. Outline the hazards associated with the work and the methods proposed to ensure property protection and safety of the public, National Park Service personnel, and Contractor’s employees.

5. Training, both initial and continuing.

6. Planning for possible emergency situations such as floods, fires, power outages, explosions, spills, and/or other emergency situations giving consideration to the nature of the construction, site conditions, and degree of exposure of persons and property.

B. Submit a copy of test reports, as required by OSHA, for personnel working with hazardous materials.

C. Submit a report of safety meetings and of inspections.

1.3 QUALITY ASURANCE

A. Comply with contract clauses entitled “Accident Prevention” and “Permits and Responsibilities”. In case of conflicts between Federal, state, and local safety and health requirements, the most stringent shall apply. Equipment or tools not meeting OSHA requirements will not be allowed on the project sites. Failure to comply with the requirements of this section and related sections may result in suspension of work.

B. Qualification of Employees:

1. Ensure that employees are physically qualified to perform their assigned duties in a safe manner.

2. Do not allow employees to work whose ability or alertness is impaired because of drugs, fatigue, illness, intoxication, or other conditions that may expose themselves or others to injury.

3. Operators of vehicles, mobile equipment, hoisting equipment, and hazardous plant equipment shall be able to understand signs, signals, and operating instructions, and be capable of operating such equipment. Provide operating instructions for all equipment. Newly hired operators shall be individually tested by an experienced operator or supervisor to determine if they are capable of safely operating equipment.

1.4 ACCIDENT REPORTING

A. Reportable Accidents: A reportable accident is defined as death, occupational disease, traumatic injury to employees or the public, property damage by accident in excess of $100, and fires. Notify Contracting Officer immediately in the event of a reportable accident. Within seven (7) days of a reportable accident, fill out and forward to Contracting Officer an Accident/Property Damage Report (Form CM-22). Form may be obtained from the Contracting Officer.

B. All Other Accidents: The Contractor shall report all other accidents to the Contracting

Officer and Contracting Officer’s Representative as soon as possible and assist the Contracting Officer and other officials as required in the investigation of the accident.

1.5 FIRST AID FACILITIES

A. Provide adequate facilities for the number of employees and the type of construction at the site.

1.6 PERSONNEL PROTECTIVE EQUIPMENT

A. Meet requirements of NIOSH and MSHA.

1.7 EMERGENCY INSTRUCTIONS

A. Post telephone numbers and reporting instructions for ambulance, physician, hospital, fire department, and police in conspicuous locations at the work site.

1.8 FIRE AND LIFE SAFETY

A. Provide and maintain the fire and life safety requirements in NFPA 241 (Standard for

Safeguarding Construction, Alteration, and Demolition Operations).

B. Contractor shall have a Hazard Communications Plan; store hazardous materials in accordance with manufacturer’s and OSHA recommendations; immediately report all spills of hazardous materials to the Park; and maintain a spill emergency response kit.

1.9 PROTECTIVE EQUIPMENT

A. Inspect personal protective equipment daily and maintain in a serviceable condition.

Clean, sanitize, and repair, as appropriate, personal items before issuing them to another individual.

B. Inspect and maintain other protective equipment and devices before use and on a periodic basis to ensure safe operation.

1.10 SAFETY MEETINGS

A. As a minimum, conduct weekly 15-minute “toolbox” safety meetings. These meetings shall be conducted by a foreman and attended by all construction personnel at the work site. These meetings shall be used to review the effectiveness of the Contractor’s safety effort, to resolve current health and safety problems, to provide a forum for planning safe construction activities, and for updating the Accident Prevention Program.

B. At the discretion of the Contracting Officer or Contracting Officer’s Representative, the

CO or COR may attend the meeting.

1.11 HARD HATS AND PROTECTIVE EQUIPMENT AREAS

A. A hard hat area will be designated by the Contracting Officer. The hard hat area shall be posted by the Contractor in a manner satisfactory to the Contracting Officer.

B. It is the Contractor’s responsibility to require all those working on or visiting the site to wear hard hats and other necessary protective equipment at all times. As a minimum, provide hard hats for use by visitors. Change liners before reissuing hats.

1.12 TRAINING

A. First Aid: Provide adequate training to ensure prompt and efficient first aid.

B. Hazardous Material: Train and instruct each employee exposed to hazardous material in safe and approved methods of handling and storage. Hazardous materials are defined as explosive, flammable, poisonous, corrosive, oxidizing, irritating, or otherwise harmful substances that could cause death or injury.

SECTION 01430

CONTRACTOR QUALITY CONTROL

A. The work of this section consists of preparing and executing a Quality Control Program.

1.2 RELATED REQUIREMENTS

A. “Inspection of Construction” clause of this contract.

B. Contractor’s completion and submission of the Daily Log of Construction Form as described in Section 013300.

1.3 SUBMITTALS

A. Quality Control Plan: Due to the value and level of effort of this contract, a written

Quality Control Plan is required to be submitted.

1.4 RESPONSIBILITIES

A. The quality of all work shall be the responsibility of the Contractor.

B. The Contractor must have a designated and qualified Quality Control Supervisor on the project site whenever contract work is in progress. The Quality Control Supervisor may also perform the duties of Site Superintendent, and/or Project Manager, and/or Safety Officer.

C. Inspect and test all work at various stages of construction to ensure that the quality of materials, workmanship, construction, finish, and functional performance is in compliance with applicable specifications and drawings, and are in strict accordance with the latest trade practices, standards, and Codes.

1.5 OFF-SITE CONTROL

A. Items that are fabricated or assembled off-site shall be inspected for quality control at the place of fabrication. Inspections conducted, tests performed, and their results, must be documented on the Daily Log of Construction Form.

1.6 ON-SITE CONTROL

A. Review control submittal requirements with personnel directly responsible for the quality control work.

B. Review all applicable specification sections and drawings related to the feature of work.

C. Inspect and test all work at various stages of construction to ensure that the quality of materials, workmanship, construction, finish, and functional performance is in compliance with applicable specifications and drawings, and are in strict accordance with the latest trade practices, standards, and Codes.

D. Ensure all inspections and tests performed, and their results, are documented on the

Daily Log of Construction form.

E. The Contractor shall stop work on any item or feature pending satisfactory correction of any deficiency noted by the Quality Control Supervisor or the Contracting Officer.

F. At the request of the Contracting Officer, make available the references, regulations, publications and/or other credentials which evidence the workmanship and materials adhere to contract specifications and applicable Codes. Failure to comply with the requirements of this section and related sections may result in suspension of work.

SECTION 01560

BARRIERS

1.1 DESCRIPTION. The work of this section consists of furnishing, installing, and maintaining barriers to protect existing facilities and the public from construction operations.

2.1 GENERAL. Material may be new or used, but shall be suitable for intended purpose. Fences and barriers shall be structurally adequate and neat in appearance.

2.2 FENCING. Safety Barrier Fence: Orange plastic fence, minimum height, 4 feet.

2.3 BARRICADES AND SIGNS. Manual on Uniform Traffic Control Devices (MUTCD), most current edition with incorporated revisions.

2.4 LUMBER. Free of nails, large knot holes and splinters.

2.5 BARRIER TAPE. Banner Guard, imprinted with "CAUTION: CONSTRUCTION AREA", manufactured by Reef Industries, Inc., Houston, Texas, or approved equal.

3.1 PROTECTION OF PUBLIC

A. Fence, barricade, or otherwise block off the immediate work area to prevent unauthorized entry.

B. Erect and maintain barricades, lights, danger signals, and warning signs in accordance with MUTCD.

C. Illuminate barricades and obstructions at night, from sunset to sunrise.

D. Adequately barricade and post open cuts in or adjacent to thoroughfares.
