About this file
This document contains performance bond and labor & material payment bond templates for the Sacramento Housing Authority Repositioning Program, Inc. (SHARP), a non-profit corporation based in California. The bonds are designed to accompany construction contracts for projects undertaken by SHARP and its affiliated entities. The performance bond ensures that the contractor promptly and faithfully performs the contract work, with the surety obligated to either complete the contract or arrange for completion by another bidder if the contractor defaults. The performance bond remains in full force for one year after work completion to cover defects in workmanship or materials. The labor and material payment bond ensures payment to all claimants, including direct contractors and subcontractors, for labor and materials used in contract performance. Claimants who have not been paid within 90 days of their last work may sue on the bond, provided written notice is given within 90 days and suit is filed within one year of final labor or material supply.
Both bonds must be issued by surety companies licensed under California law and executed with a power of attorney from the signing officer. The bonds are required for a painting services contract (SHARP IFB-2026-071-PS) covering interior surface preparation, repair, priming, and finish painting at three residential properties in Sacramento: Washington Plaza Apartment, Sierra Vista Apartment, and Sutterview Apartments. Bids exceeding $300,000 require a bid bond of not less than 5% of the total bid price, while the successful bidder must furnish performance and payment bonds each at 100% of the contract price. The bond amount may be reduced by good faith payments made under the labor and material payment bond, including payments for mechanics' liens. All bonds are governed by California Civil Code provisions, with the surety waiving certain code sections and agreeing that contract modifications do not affect bond obligations.
