NOTES:

1. This solicitation is for an Indefinite Delivery, Indefinite Quantity (IDIQ) type contract, for a maximum quantity of 440 Mobility Ready Storage Systems (MRSS). Two each First Article Units will be required as defined herein. The First Articles will be retained as manufacturing standards and will not be delivered as part of the production quantity. Due to the Government’s contract writing system limitations, the Contract Line Item Numbers (CLINs) are written with maximum quantities reflecting an anticipated procurement of 110 units each year; however, the contract maximum quantity of MRSS is 440, which may be procured at any time through the duration of the contract.

2. The solicitation includes stepladder pricing on CLINs 0003 through 0006. Potential offerors are encouraged to notify the Contracting Officer prior to solicitation closing if price breaks occur at different quantities than those specified, and the solicitation may be modified to revise the stepladder structure to more accurately reflect appropriate price break quantities. Do not submit a proposal containing a different stepladder structure than reflected in the solicitation, however.

3. This solicitation contains drawings and procedures subject to Export Control Laws. In order for a prospective offeror to receive a copy of the drawings, the offeror must have an approved, active DD Form 2345. Once the drawings are no longer required by the offeror (the prospective offeror chooses not to submit an offer, the offeror is not selected for award, or the offeror withdraws its offer) they shall either be returned to the soliciting Contracting Officer or destroyed and not retained by the offeror or transferred to another party.

4. Award of this solicitation will be made on the basis of Lowest Price, Technically Acceptable offer, as described in section M herein. Award is anticipated to be made on initial offers; however, if determined necessary, discussions may occur. Section L provides the proposal submission requirements.

The Government will evaluate equally, as regards time of delivery, offers that propose delivery of each quantity within the applicable delivery period specified above. Offers that propose delivery that will not clearly fall within the applicable required delivery period specified above will be considered nonresponsive and rejected. The Government reserves the right to award under either the required delivery schedule or the proposed delivery schedule, when an offeror offers an earlier delivery schedule than required above. If the offeror proposes no other delivery schedule, the required delivery schedule above will apply.

OFFEROR'S PROPOSED DELIVERY SCHEDULE

WITHIN DAYS AFTER
ITEM NO.QUANTITYDATE OF CONTRACT

(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed or otherwise furnished to the successful offeror, results in a binding contract. The Government will mail or otherwise furnish to the offeror an award not later than the day award is dated. Therefore, the offeror should compute the time available for performance beginning with the actual date of award, rather than the date the written notice of award is received from the Contracting Officer through the ordinary mails. However, the Government will evaluate an offer that proposes delivery based on the Contractor’s date of receipt of the contract or notice of award by adding (1) five calendar days for delivery of the award through the ordinary mails, or (2) one working day if the solicitation states that the contract or notice of award will be transmitted electronically. (The term “working day” excludes weekends and U.S. Federal holidays.) If, as so computed, the offered delivery date is later than the required delivery date, the offer will be considered nonresponsive and rejected.
