SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS
The following have been modified:
SECTION L
Part A General Instructions
1.0 General
1.1 This effort is a Small Business Set-aside for a five (5) year FFP IDIQ contract via the Federal Business Opportunities (FedBizOpps) website. The Offeror is required to submit sufficient information concerning the following areas to enable the Government personnel to fully ascertain capabilities of the Offeror to perform the requirements. The proposal must be sufficient in detail and scope to permit evaluation and provide the evaluators a clear understanding of the Offeror’s capability to meet or exceed the defined elements as required by the solicitation. All proposals must clearly and convincingly demonstrate that the Offeror has a thorough understanding of the requirements, associated risks, and is able, willing, and competent to devote the resources necessary to meet the requirements and that the Offeror has valid and practical solutions for all requirements and potential risk areas. The Offeror must respond to all requirements of the solicitation and not alter or rearrange the solicitation. The Offeror has the burden of proof to demonstrate compilation with the evaluation factors identified in this solicitation. The Offeror is advised that the Government may incorporate into the final contract enhancing features included in the Offeror’s proposal deemed beneficial to the Government. With the exception of the Price/Cost volume, no cost or pricing information should appear in any volume. Alternate proposals are not acceptable.
1.2 In presenting material in the proposal, the Offeror is advised that quality of information is more important than quantity. Clarity, brevity, and logical organization should be emphasized during proposal preparation. The Offeror is responsible to present enough information to allow the Government to evaluate the proposed work effort, support, and approach, as well as the price/cost proposal, without opening discussions. Statements that the prospective Offeror understands, or can and/or will comply with the specifications and paraphrasing the requirements or parts thereof without supporting documentation are considered inadequate by the Government and may render a rating of unacceptable.
1.3 The Offeror must include any data that illustrates the adequacy of the various assumptions, approaches, and solutions to problems. Failure to address a specific factor clearly may be considered a deficiency and render the proposal unacceptable. There is no need to repeat information in more than one volume if an overlap exists; the detailed information must be included in the most logical place and summarized and referenced in other areas. Unnecessarily elaborate brochures or other presentation material beyond that sufficient to present a complete and effective proposal is neither necessary nor desired.
1.4 The Offeror is required to comply with all requirements of the Request for Proposal (RFP). The Government advises the Offeror that taking exception or deviation from any term or condition of the RFP may make an offer unacceptable and the proposal unawardable, unless the RFP expressly authorized such and exception or deviation with regard to that specific term or condition. The Government may consider any exception or deviation to any term or condition of the RFP that is not expressly authorized by the RFP to be a deficiency.
1.5 The Offeror shall disclose any potential OCI situations with itself, subcontractors, partners or any other Offeror as it applies to this solicitation for the TPX 42 Recorder contract awards to the Contracting Officer as soon as the OCI is identified; including if identified prior to proposal submission, or the Offeror shall submit an affirmation statement in its proposal that they are not aware of any OCI in its Cover Letter. The disclosure shall include the facts and an analysis of the actual or perceived conflict and recommend an approach to neutralize, mitigate, or avoid the potential conflict. The Contracting Officer will determine if resolution is necessary and promptly respond to resolve any potential conflicts, which may include notifying an Offeror of their exclusion from the competition. If an Offeror fails to submit either a disclosure of potential OCI situations or an affirmative statement that the Offeror is not aware of any OCI, the Offeror may not be considered for award. The contractors who provided assistance in drafting this solicitation include Gryphon Technologies (contract # N00421-13-D-0012), SAIC (contract # N00421-16-D-0005), and ManTech (contract # N00421-13-D-0012). All of these contractors were acting as subcontractors under the aforementioned contracts. The prime contractor for N00421-13-D-0012 is CTSI and the prime contractor for N00421-16-D-0005 is AMELEX.
All communications shall be conducted only in writing and directly to the Contract Specialist or Contracting Officer as identified in the Standard Form 33 and above. Offerors shall not contact any other Government personnel other than the Contract Specialist or Contracting Officer identified. Contacting any other Government personnel other than the Contract Specialist or Contracting Officer identified may result in an organizational conflict of interest (OCI) and may result in an Offeror being excluded from competition and award.
1.6 All questions shall be submitted via email to Jason Ucci at Jason.ucci@navy.mil. It is required that all questions be received within 10 calendar days of the date of solicitation issuance. Though the Government reserves the right to hold discussions, award may be based upon initial offers. Therefore offers should take no exceptions to terms or conditions or omit any requirements. The Offeror’s initial proposal should contain the Offeror’s best terms from a cost or price or technical standpoint.
2.0 Proposal Format, Content, and Volumes
2.1 Offerors shall email its proposal to Jason.ucci@navy.mil by the date specified in block 9 of the standard form 33. The e-mail proposal submittal shall consist of separate files as set forth and named below. Offerors may encrypt or password protect proprietary information as they see fit.

If submitting multiple emails, the subject line shall include "Email 1 of 2", "Email 2 of 2", as appropriate to the number of emails submitted. Offerors shall not submit compressed or .zip files. If the Offeror does not receive confirmation of receipt, it is the responsibility of the Offeror to contact Jason Ucci to confirm their proposal has been received.

Pages containing text shall be typewritten using the standard letter size (8.5 x 11) in Microsoft Word. Text shall be in a minimum of twelve (12) point Times New Roman font and the page layout shall have no less than one inch (1) margins.
