CLAUSES INCORPORATED BY FULL TEXT

mailto:monica.razoshepherd@navy.mil

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

FACTOR 1- Technical (Capability Approach and Key Personnel): The Offeror will be evaluated for the overall quality and expertise in support of the objectives outlined in the PWS. Note: The Government plans to incorporate all or part of the contractor’s technical proposal into the contract.

FACTOR 2- PAST PERFORMANCE: The Government will evaluate the Offeror’s relevant past performance during the last five years in the following areas: (1) Customer Satisfaction; (2) Timeliness; (3)

Technical success; and (4) Quality of Projects of Similar Scope and Magnitude.

The Government may review any other sources of information for evaluation of past performance. Other sources may include, but are not limited to past performance information retrieved through the Past

Performance Information Retrieval System (PPIRS) using all CAGE/DUNS numbers of team members

(partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s quotation, inquiries of owner representative(s), and any other known sources not provided by the offeror. Offers which lack a relevant past performance history will receive a neutral rating for this factor.

FACTOR 3- Price: The price will be evaluated to determine the reasonableness and completeness of the offeror’s proposal. One or more of the following techniques will be used to ensure a fair and reasonable price:

1. Comparison of proposed prices received in response to the solicitation.

2. Comparison of proposed prices with the independent Government estimate.

3. Comparison of proposed prices with available historical information.

4. Comparison of proposed prices with the same or similar items.

Relative Importance of the Evaluation Factors: Technical and past performance, when combined, are approximately equal to cost or price.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party.

Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)
