JUSTIFICATION AND (J&A) APPROVAL FOR USE OTHER THAN FULL AND OPEN
COMPETITION
1. Contracting Activity: Department of the Navy, Military Sealift Command (MSC) Norfolk.
2. Description of the Action Being Approved: This is a sole source justification for work to be provided under Work Items (WI) 0201, 0202, 0301, 0302, 0303, 0306, 0401, 0402, 0403, 0404, 0405, 0502, 0503, 0510, 0512, 0601, 0605, 0804, 0903, 0904, 0907, 0909, 0911, 0914 and 0915 of the Statement of
Work (SOW) for the Dry Dock (DD) of the USNS GRASP (T-ARS 51) under RFP N3220518R4555.
This Justification is covering only the portion of the acquisition which is brand-name or otherwise sole source and the approval level requirements will then only apply to the portion.
3. Description of Supply Services: MSC Norfolk requires Original Equipment Manufacturer (OEM) authorized technical field representatives and OEM parts to accomplish requirements of WIs listed below. The estimated combined dollar value of the twenty-five (25) Work Items is $XXXX which will be funded utilizing FY 19 Operation & Maintenance funds.

4. Statutory Authority Permitting Other Than Full and Open Competition: 10 U.S.C 2304 (c) (1):
Only one responsible source and no other supplies or services will satisfy agency requirements (as implemented by FAR 6.302-1(a)).
5. Rationale Justifying Use of Cited Authority:
a. WI 0201 Engine and Generator Repairs:
This work requires the supply of Caterpillar as the sole-source supplier and service representative of
USNS GRASP’s 1A, 1B, 2A & 2B main diesel engines and 1SG, 2SGA & 2SGB diesel engine.
Caterpillar is the OEM of the vessel’s main diesel engines and generator engines. The vessel’s engines are Critical Equipment, listed under SMS Form T-ARS Critical Equipment List 10.6-002-01-ARS. Per
COMSC INSTRUCTION 4490.1A, an OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment, such as these items, classified as “critical”.
Only OEM and Authorized service/parts providers have the expertise and knowledge, including access to proprietary drawings and technical manuals, to identify and provide OEM parts and components.
Material must be procured and installed, to prevent the engines from having a mechanical failure. The main engines are critical element in the propulsion system. If the main engines fail to operate, then the vessel will lose its propulsion system and will not be able to move/navigate through water: resulting in a
“No Sail”, stopping all mission operations. Authorized repair representatives will only install genuine
OEM parts supplied from within the authorized Network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured byanother company.
MSC does not have manufacturing and technical information required to evaluate and determine whether Non-OEM service and replacement parts are equivalent to the OEM service and replacementparts.
b. WI 0202 Main Reduction Gear & Thrust Bearing Maintenance:
This work requires the supply of a David Brown (Santasalo) as the sole-source supplier and service representative of USNS GRASP’s Main Reduction Gears (MRG). David Brown (Santasalo) is the OEM of the vessel’s Propulsion Drive System. The vessel’s Propulsion Drive System is Critical Equipment, listed under SMS Form T-ARS Critical Equipment List 10.6-002-01-ARS. Per COMSC INSTRUCTION
4490.1A, an OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment, such as these items, classified as “critical”. Only
OEM and Authorized service/parts providers have the expertise and knowledge, including access to proprietary drawings and technical manuals, to identify and provide OEM parts and components.
Material must be procured and installed, to prevent the MRGs from having a mechanical failure. The
MRGs are critical element in the propulsion system. If the MRGs fail to operate, then the vessel will lose its propulsion system and will not be able to move/navigate through water: resulting in a “No Sail”, stopping all mission operations. c. WI 0301 Tank Level Indicator Repair and Calibration:
This work requires supply of Electronic Marine Systems (EMS) as the sole-source supplier and service representative of EMS Marcon type tank level indicators (TLI). The USNS Grasp’s ballast tanks, potable water tanks, oily waste Tanks and fuel tanks have EMS Marcon type whose output is integrated into a EMS Marcon processing and display system. OEM-authorized service and parts providers have access to proprietary drawings and technical data, and have the expertise and knowledge to provide
OEM parts, components, and qualified services needed to calibrate and repair the existing TLI system including potable water tanks. A loss of potable water results in the inability to maintain habitability services for the ship’s crew. Use of EMS parts and services maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and determine whether non-OEM service and replacement parts are equivalent to the OEM service and replacement parts.
d. WI 0302 Automation System Service and Repair:
This work requires supply of Intech Marine as the sole-source supplier and service representative of
Automation System Service including USNS Grasp’s Main Console. Intech Marine is the OEM of the vessel’s Main Console. The vessel’s Main Console is Critical Equipment, listed under COMSC
INTRUCTION 4490.1A as Critical Equipment. Per COMSC INSTRUCTION 4490.1A, an OEM or
OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment, such as these items, classified as “critical”. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly installed or deficient parts could cause system failure impacting all electronically controlled systems. OEM-authorized
Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and determine whether non-OEM service and replacement parts are equivalent to the OEM service and replacementparts
e. WI 0303 Generator Cleaning (2SGA)
This work requires the supply of General Electric as the sole-source supplier and service representative of USNS GRASP’s Ship’s Service Generators. General Electric is the OEM for this equipment. The
Ship’s Service Generators are listed as critical equipment per SMS Form T-ARS Critical Equipment
List 10.6-002-01-ARS. Per COMSC INTRUCTION 4490.1A, OEM Representative is required to perform or supervise maintenance and repairs of equipment classified as Critical. Only General
Electric OEM service and parts providers have access to proprietary drawings and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Cleaning and repairs to the Ship’s Service Generators must be completed with strict adherence to OEM procedures.
Errors in workmanship could cause a loss of ship’s power while underway, a threat to the safety of life at sea. Premature equipment failure could also lead to damage of other systems or an electrical fire in the engine room. Authorized General Electric Representatives will only install genuine OEM parts supplied from within the authorized General Electric Distributor Network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. MSC does not have manufacturing and technical information required to evaluate and determine whether Non-OEM service and replacement parts are equivalent to the OEM service and replacement parts.
f. WI 0306 Circuit Breaker Inspection and Servicing:
This work requires supply of Gould as the sole-source supplier and service representative of USNS
Grasp’s Power Distribution Circuit Breakers. Gould is the OEM of the vessel’s Power Distribution
Circuit Breakers. The vessel’s Power Distribution Circuit Breakers is Critical Equipment, listed under
COMSC INTRUCTION 4490.1A as Critical Equipment. Per COMSC INSTRUCTION 4490.1A, an
OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment, such as these items, classified as “critical”. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly installed or deficient parts could cause system failure and loss of navigation at sea. OEM-authorized

g. WI 0401 Navigational Radar Annual Grooming:
This work requires supply of Furuno as the sole-source supplier and service representative of USNS
Grasp’s Furuno model 10CM FAR-2107 and 3CM FAR-2807 Series radars. The radars are listed as critical equipment per SMS #10.6-002-01-ARS and in COMSC Instruction 4490.1A. Per COMSC
INSTRUCTION 4490.1A, an OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment, such as these items, classified as “critical”. Only
OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services.
Incorrectly installed or deficient parts could cause system failure and loss of navigation at sea. OEM-authorized Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. h. WI 0402 Gyro System Maintenance:
This work requires the supply of Sperry as the sole-source supplier and service representative of USNS
Grasp’s main gyro compass, model MK-27F. The gyro compasses are listed as critical equipment per
SMS #10.6-002-01-ARS. Per COMSC INSTRUCTION 4490.1A, an OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment, such as these items, classified as “critical”. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly installed or deficient parts could cause system failure and loss of gyro at sea. OEM-authorized Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company.

i. WI 0403 ECDIS Annual Servicing:
This work requires supply of Transas as the sole-source supplier and service representative of USNS
Grasp’s ECDIS Navi-Sailor 4000. The ECDIS is listed as critical equipment in COMSC Instruction
4490.1A. Per COMSC INSTRUCTION 4490.1A, an OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment, such as these items, classified as “critical”. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly installed or deficient parts could cause system failure and loss of navigation at sea. OEM-authorized Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company.

j. WI 0404 SVDR Replacement:
This work requires supply of NETWAVE as the sole-source supplier and service representative of
USNS Grasp’s SVDR Model NW6000. The SVDR is listed as critical equipment in COMSC Instruction
4490.1A. Per COMSC INSTRUCTION 4490.1A, an OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment, such as these items, classified as “critical”. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly installed or deficient parts could cause system failure and loss of SVDR at sea. OEM-authorized Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and
k. WI 0405 Radio Communications Equipment Annual Recertification:
This work requires supply of Furuno Technician as the sole-source supplier and service representative o f USNS Grasp’s GMDSS and Fathometer. The GMDSS and Fathometer is listed as critical equipment in SMS #10.6-002-01-ARS. Per COMSC INSTRUCTION 4490.1A, an OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment, such as these items, classified as “critical”. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly installed or deficient parts could cause system failure and loss of communications at sea. OEM-authorized Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and determine whether non-
OEM service and replacement parts are equivalent to the OEM service and replacement parts.
l. WI 0502 Appleton Crane Inspection and Repair
The work requires supplyof Appleton Service as the sole-source supplier and service representative of
USNS Grasp’s Model EB90-65-36 Crane onboard USNS Grasp. The Crane is considered Mission
Equipment and listed as critical equipment per SMS Form T-ARS Critical Equipment List 10.6-002-01-
ARS. Per COMSC INSTRUCTION 4490.1A, an OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment, such as these items, classified as
“critical”. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly installed or deficient parts could cause system failure and loss of mission capabilities at sea. OEM-authorized Representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. m. WI 0503 RHIB Davit Overhaul:
The work requires an OEM, Allied Service Representative to perform the services and repair of Model
D6000FCTS davits onboard USNS Grasp. RHIB and davit assembly are listed as critical equipment per
SMS Form T-ARS Critical Equipment List 10.6-002-01-ARS. Per COMSC INSTRUCTION 4490.1A, an OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment, such as these items, classified as “critical”. Only OEM-authorized service and parts providers have access to proprietary drawings/technical data and have the expertise and knowledge to identify and provide OEM parts, components, and qualified services. Incorrectly installed or deficient parts could cause system failure and loss of mission capabilities at sea. OEM-authorized

n. WI 0510 #3 AC & #2 Refrigeration Plant Servicing This work requires supply of a Carrier service representative as the sole-source OEM for parts and repairs to the USNS Grasp’s no. 3 main air conditioning plant 35-ton capacity and no. 2 Refrigeration
Plant 0.7-ton capacity. The air conditioning and refrigeration plants are listed as critical equipment per the USNS Grasp’s Shipboard Automated Maintenance Management (SAMM) system. Per COMSC
INSTRUCTION 4490.1A, an OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment classified as “critical.” Only OEM-authorized service and parts providers have access to proprietary drawings and technical data, and have the expertise and knowledge to provide OEM parts, components, and qualified services. The loss of air conditioning can impact mission accomplishment in warm climates as well as result in safety hazards to the ship’s crew. OEM-authorized representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company.

o. WI 0512 OWS and Oil Content Monitor Annual
This work requires supply of RWO as the sole-source OEM for parts and servicing of the USNS
Grasp’s Model SKIT/S-DEB 2.5 M3/HR Oily Waste Separator (OWS) and Turner Designs
Hydrocarbon Instruments as the sole-source OEM for parts and servicing of the USNS Grasp’s Model
TD107C Oil Content Monitor (OCM). The OWS & OCM is listed as critical equipment per Safety
Management System (SMS) #10.6-002-01-ARS. Per COMSC INSTRUCTION 4490.1A, an OEM or
OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment classified as “critical.” Only OEM-authorized service and parts providers have access to proprietary drawings and technical data, and have the expertise and knowledge to provide OEM parts, components, and qualified services. The failure of the OWS can result in discharge of waste oil into the ocean in violation of MARPOL regulations. OEM-authorized representatives will only install genuine
OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and determine whether non-OEM service and replacement
p. WI 0601 RHIB Service and Repairs
The work item requires the supply of Willard Marine OEM parts and technical representative for the servicing the USNS Grasp’s 7M RHIB boats. The boats are critical mission equipment listed as critical equipment in Safety Management System (SMS) #10.6-002-01-ARS. Per COMSC INSTRUCTION
4490.1A, an OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment classified as “critical.” Only OEM-authorized service and parts providers have access to proprietary drawings and technical data, and have the expertise and knowledge to provide OEM parts, components, and qualified services. The loss of RHIB boat can result in the inability continue missions at sea. OEM-authorized representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company.

q. WI 0605 SCBA Annual Recertification:
This work requires supply of Scott as the sole-source OEM for parts and servicing of the USNS Grasp’s
SCBA units model AV-2000. The SCBAs are is listed as critical equipment in the USNS Grasp’s
Shipboard Automated Maintenance Module (SAMM). Per COMSC INSTRUCTION 4490.1A, an OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment classified as “critical.” Only OEM-authorized service and parts providers have access to proprietary drawings and technical data, and have the expertise and knowledge to provide OEM parts, components, and qualified services. The failure of an SCBA can result in injury or death of a crew member while in a damage control situation such as fighting a shipboard fire. OEM-authorized representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and
r. WI 0804 Radio Room Stand Alone A/C (T-ARS 17-004):
This work requires supply of a Carrier service representative as the sole-source OEM for parts and installation on the USNS Grasp’s Radio Room air conditioning unit, Carrier Corp. Model:
24AHA436A006/124AES036000 Condenser and 40MKCB32B—3 Evaporator. The air conditioning units are listed as critical equipment per the USNS Grasp’s Shipboard Automated Maintenance
Management (SAMM) system. Per COMSC INSTRUCTION 4490.1A, an OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment classified as “critical.” Only OEM-authorized service and parts providers have access to proprietary drawings and technical data, and have the expertise and knowledge to provide OEM parts, components, and qualified services. The loss of air conditioning can impact mission accomplishment in warm climates as well as result in safety hazards to the ship’s crew. The work item requires the supply of Brunvoll OEM parts and technical representatives for the servicing the USNS Grasp’s Model SPI-VP 500 Bow Thruster. The Bow Thruster is listed as critical equipment in SMS Form T-ARS Critical Equipment List 10.6-002-01-ARS. Per COMSC
INSTRUCTION 4490.1A, an OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment classified as “critical.” Only OEM-authorized service and parts providers have access to proprietary drawings and technical data, and have the expertise and knowledge to provide OEM parts, components, and qualified services. The loss of Bow
Thruster can cause loss in propulsion maneuverability and stop missions at sea. OEM-authorized representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. The work item requires the supply of John Crane OEM parts and technical representatives for the servicing the USNS Grasp’s Rudder. The Rudder is listed as critical equipment in SMS Form T-ARS
Critical Equipment List 10.6-002-01-ARS. Per COMSC INSTRUCTION 4490.1A, an OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment classified as “critical.” Only OEM-authorized service and parts providers have access to proprietary drawings and technical data, and have the expertise and knowledge to provide OEM parts, components, and qualified services. The loss of Rudder can cause loss in propulsion maneuverability at sea. OEM-authorized representatives will only install genuine OEM parts supplied from within the authorized distributor network. This maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and determine whether non-OEM service and replacement parts are equivalent to the OEM service and replacement parts.
u. WI 0907 Cathodic Protection System:
This work requires supply of Wilson Walton as the sole-source supplier and service representative of
USNS Grasp’s Model AQ4 Cathodic Protection System. The USNS Grasp’s Cathodic Protection
System is critical to maintaining corrosion and coating control on the underwater hull. Authorized service and parts providers have access to proprietary drawings and technical data, and have the expertise and knowledge to provide OEM parts, components, and qualified services needed to calibrate and repair the existing Cathodic Protection System. Loss Cathodic Protection can result in the increase of corrosion and growth on the critical surfaces of this ship including the underwater hull. Use of EMS parts and services maintains all OEM warranties and ensures equipment reliability, therefore precluding consideration of a product manufactured by another company. Notwithstanding the rationale above, MSC further does not have the manufacturing and technical information required to evaluate and

This work requires the supply of a Bird-Johnson as the sole-source supplier and service representative of USNS GRASP’s Model 79 CPP System. Bird Johnson is the OEM of the vessel’s CPP System. The vessel’s Propulsion Drive System is Critical Equipment, listed under SMS Form T-ARS Critical

This work requires the supply of a FMC Technologies as the sole-source supplier and service representative of USNS GRASP’s FMC 12” Shaft Seals. FMC is the OEM of the vessel’s Shaft Seal.
The vessel’s Propulsion Drive System including the shaft seal are Critical Equipment, listed under SMS
Form T-ARS Critical Equipment List 10.6-002-01-ARS. Per COMSC INSTRUCTION 4490.1A, an
OEM or OEM-authorized technical representative is required to perform or supervise maintenance and repairs of equipment, such as these items, classified as “critical”. Only OEM and Authorized service/parts providers have the expertise and knowledge, including access to proprietary drawings and technical manuals, to identify and provide OEM parts and components. Material must be procured and installed, to prevent the shaft seal from having a mechanical failure. The shaft seals are critical element in the propulsion system and water tight integrity of the hull. If the Shaft Seals fails to operate, then the vessel will lose water tight integrity and will not be able to move/navigate effectively through water:

4. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable: The requirement has been synopsized at the Government Point of Entry (GPE), FedBizOpps website, and the Government intends to post a Request for Proposal (RFP) along with this justification at the GPE with the intent of awarding a firm-fixed price contract to the lowest price offeror. Any prospective contractor will be required to use the OEM or OEM
Authorized vendor as a subcontractor to perform the work in the related WIs.
5. Determination of Fair and Reasonable Cost: The Contracting Officer will determine the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.
6. Actions to Removed Barriers to Future Competition: For reasons set forth in Paragraph 5, MSC has no plans at this time to compete future contracts for the types of services covered by this document. If another potential source emerges, MSC will assess whether competition for future requirements is feasible. If the prime contractor identifies an alternate source fully qualified by technical expertise, experience, and access to OEM parts and technical data, the prime contractor must submit its analysis and documentation supporting the alternate source to the Contracting Officer not later than October, 21st 2018.
