REQUEST FOR SPECIFICATION CLARIFICATION

TITLE: ____Additional Government Requirements (AGR) _____________________________________________________________
QUESTION:
The requirement that the 10,000 hours of “Additional Government Requirements”, aka AGR, include an “all inclusive rate” which must take into account “overtime, premium time, … as well as compensations for “acceleration, delay and disruption and other impact” is both unfair and unreasonable. This requirement in a Firm Fixed priced bid contract, where the scope and impact is unknown is in direct conflict with the FAR changes clause which states that the contractor is entitled to fair and equitable compensation for changes which includes labor, material and time.
If the hours authorized as part of the AGR are on the critical path, schedule will be impacted and cost will be impacted by definition of critical path, yet the solicitation requires that this instance be priced the same way as othe changes. The government has failed to define how much of the 10,000 hours will be on the scritical path nor when it will be awarded within the availability. An undefined scope cannot be priced as a Firm Fixed rate if the scope and time frame is undefined.
We recommend that this requirment be deleted or modified to allow impact to schedule to be evaluated within the negotiations, including but not limited to overtime, acceleration and delay and disruption.
ANSWER:
The hourly labor rate (AGR) is fixed; however, the number of hours are negotiated based on the work scope of the contract change order (CCO). Contractor shall report CCO schedule impact on its CCO proposal.
