Q&A 1
QUESTIONS AND ANSWERS 1 – N32205-16-R-2012
QUESTION: Is there an incumbent?
ANSWER – Yes – N00033-14-D-8035 which was issued to The McHenry Management Group (TMMG) – CAGE Code 4ZRH5
QUESTION: MSC is asking for 7 resumes on a contract that is only 13 FTEs. We understand that this is not the case with MSC, but typically when we see an RFP that has such a high percentage of key personnel it usually means the agency already knows which contractor they would like to win. Usually we don't bid on these high percentage key person RFPs for that reason. Is it your intention to require submission of 13 resumes?
ANSWER: The SOW identifies 11 positions as Key Personnel. It is our expectation that those personnel will be an integral part of the taskings for engineering inspection and support services required under this contract. As key personnel, it is imperative that we validate their qualifications as part of the technical review process, and that we are assured that these personnel will not be substituted for other less qualified personnel after the contract is awarded.
QUESTION: The personnel requirements in section 15.1 are very significant. In particular, the requirement to have 13 of the 17 people working on this contract with an unexpired USCG License. This will drive price up significantly on this contract and severely limit competition. Reading through Section
4.0 Specific Tasks, there are no tasks that require someone with a USCG License. Is it MSC's intention to keep this requirement despite the increase in cost and reduction in competition that it would cause?
ANSWER: The technical requirements under this contract are very high, but are necessary to provide the caliber and range of technical services expected. USCG licensed personnel, along with our other specified qualifications, are necessary attributes to support the engineering taskings and ship inspection requirements for our ships. It is essential for contractor personnel to possess the knowledge, technical background and experience of commercial shipping rules and operations to mesh with MSC operating policies.
QUESTION: You are asking for resumes for both the Senior Project Engineer and the Senior Automation Engineer, but don't have any hours associated with these labor categories in your Pricing Spreadsheet.
Do we still have to provide resumes for people who will not be working on this contract?
ANSWER: We will modify the Pricing spreadsheet to correct this error.
QUESTION: Page 37 of 70 - Attachment 3 consists of both the Sample Tasks and a Past Performance Data Sheet. Paragraph 5.1.1 states that Attachment 3 is a Supplemental Pricing Sheet. Question: Is the Government going to provide a Supplemental Pricing Sheet?
ANSWER: Paragraph 5.1.1 of the PWS has been changed. Attachment III has been revised removing the Past Performance Data Sheet. There is no Supplemental Pricing Sheet, only Attachment VIII.
QUESTION: Page 38 of 70 - Government Estimated Travel - Should Total Travel be $3,963,500 vice $2,378,100? Government Estimated ODCs’ Should Total ODC’s be $146,000 vice $1,673,000?
Attachment VIII - Should Total Travel be $3,963,500 vice $2,378,100? Should Total ODC’s be $146,000 vice $1,673,000?
ANSWER: Yes to all of the above. Attached VIII has been modified and the imbedded formulas corrected.
QUESTION: Page 40 of 70 - 52.212-2 2.0 Evaluation Factors - Paragraph 2.1 states “In selecting the lowest price technically acceptable offer, the following factors will be evaluated:”, Page 42 of 70 Factor 3
– Price - “Price will not be an adjectivally scored factor in the evaluation of proposals and the importance of price does not bear a direct relationship to the importance of the non-price factors.”
Could the Government please confirm that this solicitation will be evaluated based on best value?
ANSWER: Proposals will be evaluated on the Lowest Priced Technically Acceptable criteria as stated in FAR Clause 52.212-2.
QUESTION: Form DD 254 - In Box 2.c., it shows Solicitation No. N62387-15-R-8023. Question: Should this box show the current Solicitation No. N32205-16-R-2012?
ANSWER: Yes – Block 2c should show N62387-16-R-2012. Corrected DD 254 attached.
QUESTION: Per the RFP requirements, under Section 15.1, Personnel Labor Categories, the Lead Electrical Engineer position requirement states “Possess an unexpired USCG License, including those issued for continuity only”. Would MSC consider waiving this requirement or modifying this requirement to allow for a substitution for a Licensed Electrical Engineering PE, who once held an active coast guard license and has 25 years of electrical engineering shipboard experience?
ANSWER: The technical requirements under this contract are very high, but are necessary to provide the caliber and range of technical services expected. USCG licensed personnel, along with our other specified qualifications, are necessary attributes to support the engineering taskings and ship inspection requirements for our ships. It is essential for contractor personnel to possess the knowledge, technical background and experience of commercial shipping rules and operations to mesh with MSC operating policies.
QUESTION: Per the RFP requirements, under Section 15.1, Personnel Labor Categories, the Senior Safety Specialist position requirement states “Possess an unexpired Deck or Engineering License from the United States Coast Guard for oceangoing vessels.” Would MSC consider waiving this requirement or modifying this requirement to allow substitution for a candidate who once held an active coast guard license and has 20 years of current safety shipboard experience?
ANSWER: The technical requirements under this contract are very high, but are necessary to provide the caliber and range of technical services expected. USCG licensed personnel, along with our other specified qualifications, are necessary attributes to support the engineering taskings and ship inspection requirements for our ships. It is essential for contractor personnel to possess the knowledge, technical background and experience of commercial shipping rules and operations to mesh with MSC operating policies.
QUESTION: Per the RFP requirements, under Section 15.1, many of the positions requirement states “Possess an unexpired USCG License, including those issued for continuity only”.
Would MSC consider having personnel who once held a USCG license or allow a substitution of 15 years of current shipboard experience?
ANSWER: The technical requirements under this contract are very high, but are necessary to provide the caliber and range of technical services expected. USCG licensed personnel, along with our other specified qualifications, are necessary attributes to support the engineering taskings and ship inspection requirements for our ships. It is essential for contractor personnel to possess the knowledge, technical background and experience of commercial shipping rules and operations to mesh with MSC operating policies.
QUESTION: Per the RFP requirements, under Section 15.1, there are positions listed for Senior Automation Engineer, Senior Project Engineer, and Engineer/Naval Architect. However, in Attachment VIII-Rate Table Pricing Spreadsheet, the government estimated hours are zero. If there are zero hours estimated by the government for these three positions, are we required to provide a key resume for that position?
ANSWER: Attachment VIII has been modified to correct this error.
QUESTION: Per the RFP requirements, under Section 15.1, Personnel Labor Categories, the Lead Electrical Engineer position requirement states “Possess an unexpired USCG License, including those issued for continuity only”. Would MSC consider modifying this requirement to state “One half of the proposed Lead Electrical Engineers must possess an unexpired USCG License”?
ANSWER: Yes, we will modify the Lead Electrical Engineer requirements to add: One half of the proposed Lead Electrical Engineers must possess at a minimum an unexpired USCG License, including those issued for continuity only.
QUESTION: All technical positions require an unexpired USCG licensed. Some of these are overly restrictive. For example, the lead electrical engineer, the senior automation engineer, the senior safety specialist, the naval architect, and the Senior MSR engineer all require a USCG license. For example, a retired USCG or USN Engineering Duty Officer with a master’s degree could certainly carry out all the tasks listed in section 4. There are other qualifications for the Senior Automation Engineer and Lead Electrical Engineer that are more appropriate than a USCG License. Could other qualifications, such as sea experience, master’s degree, profession engineer (PE) license be substituted for the USCG licensed?
ANSWER:
QUESTION: For the Lead Electrical Engineer, can qualifications be substituted for the USCG license such as a masters degree in electrical engineering, professional engineer license and additional years marine electrical engineering experience. There are many highly qualified marine electrical engineers that do not possess USCG licenses.
ANSWER:
QUESTION: What specific tasks does the Senior MRE Engineer carry out?
ANSWER: The Senior MRE Engineer will support shipboard inspections and testing, and will have experience with testing, analysis and diagnostic tools that may be used in the conduct of those duties.
QUESTION: Why is the Thermographic Surveyor a key person? This is an individual with minimal experience.
ANSWER: We believe that the skills, experience and product of the thermographic surveyor are extremely important to assess and maintain the material condition of our ships. We consider that position to be key, so that those individuals learn the MSC ships systems, and are able to relate new and important electrical issues as they are discovered.
QUESTION: How many resumes need to be submitted? Section 15.3 indicates 11, but the price sheet indicates hours that indicate multiple individuals in a number of key positions.
ANSWER: Section 15.3 has been clarified to indicate that the positions listed are considered to be key.
The Contractor shall provide as many resumes for each position that they propose will fill each of those positions if awarded the contract.
QUESTION: Can an individual fill multiple positions? For example, the PM is required for only 106 hours per year so he could also be the Lead QA engineer.
ANSWER: Yes, an individual can be proposed for multiple positions.
QUESTION: The Senior Automation Engineer and Senior Project Engineer are both shown as 0 hours.
Why are these position Key if there have 0 hours?
ANSWER: The pricing sheet has been updated to correct this error.
QUESTION: Can past performance questionnaires recently submitted to MSC under the MSC N7 Drawing Solicitation be used for this solicitation or do the references need to resend a new Questionnaire?
ANSWER: No – this is a separate solicitation and therefore, separate past performance questionnaires are required.
QUESTION: Section 16.2 says "All key personnel shall possess a current CONFIDENTIAL security clearance through the Defense Security Service (DSS)." We suggest changing that to "All key personnel shall possess a current CONFIDENTIAL security clearance OR HIGHER through the Defense Security Service (DSS)."
ANSWER: Concur, PWS will be corrected.
QUESTION: Section 17.5 says work may be performed up to the SECRET level. Please clarify if this is a confidential or secret level contract.
ANSWER: Concur, PWS will be corrected to state CONFIDENTIAL.
QUESTION: Section 17.7 says "Fees associated with obtaining CACs are for the Contractor's account."
Contractors do not have any way to pay for CAC fees. Suggest deleting this.
ANSWER: Concur, PWS will be corrected to remove.
QUESTION: Under Factor 1 Technical Capability, it says "The technical factor consists of three subfactors, as listed below." However, four subfactors are listed. Please provide clarification.
ANSWER: Concur, Factor 1 verbiage has been corrected to reflect 4 subfactors.
QUESTION: There are two sections both listed as 5.1.2. We suggest deleting both of these sections. Its unclear where this information would be inserted into the proposal. Also this is not a cost type contract and it is not necessary to show salaries or fringe benefits.
ANSWER: FAR Clause 52.212-1 has been revised. The documents required in the revised 5.2.1 are required and are listed as required in 5.2.10.
QUESTION: Section 5.2.8 references section 14.2.2, but 14.2.2 doesn't exist.
ANSWER: FAR Clause 52.212-1 paragraph 5.2.8 has been changed.
QUESTION: Compensation Plans have not been a requirement on prior MSC RFPs. Why is one required here? This is not a cost type contract and seems unnecessary.
ANSWER: This specific requirement has been removed from FAR Clause 52.212-1. It was under the former duplicate paragraph 5.1.2.
QUESTION: The size of the proposal seems to be extremely burdensome to MSC. With 40 pages for Volume I and II, plus 40 pages of sample tasks, plus 22 pages (minimum) for resumes, that puts the technical proposal portion over 100 pages. Does MSC have the technical bandwidth to review, what will be, thousands of pages of technical proposals? We suggest eliminating some of the sample tasks, reducing the amount of resumes and limiting the number of pages of technical proposal.
ANSWER: This is an important contract solicitation and we are fully prepared to provide an ample evaluation of submitted proposals. The offeror may decide to submit their proposals in multiple e-mails (numbered consecutively) or hand delivered or mailed IAW 52.212-1 paragraphs 2.2 through 2.5.
The following have been modified:
52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (OCT 2015)
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF
1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) "Remit to" address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the
Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent
Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.
Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.
(i) Availability of requirements documents cited in the solicitation. (1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to--GSA

If the Offeror does not become registered in the SAM database in the time prescribed by the Contracting
Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror. Offerors may obtain information on registration and annual confirmation requirements via the SAM database accessed through https://www.acquisition.gov.
(l) Debriefing. If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:
