About this file

This is a Request for Quotation (RFQ) form for the New York State Office of Parks, Recreation and Historic Preservation (OPRHP) Foundation Installation project, designated as LI-RM-2027-501. The RFQ solicits quotations for foundation installation services related to an OPRHP project on Long Island. The document serves as the official bidding form through which interested contractors must submit their proposals and pricing information. Specific details regarding project scope, quantities, site locations, and submission deadlines would be outlined within the form itself, along with any requirements for site visits or bidders' conferences.

The RFQ form establishes the procurement mechanism and administrative requirements for contractors to participate in the competitive bidding process. Key pricing and contractual terms, any applicable set-asides for disadvantaged or minority-owned businesses, funding sources, and evaluation criteria would be specified within the document. The form likely includes sections for bidder information, itemized pricing by service component, insurance and bonding requirements, and references to any supporting project documentation necessary for contractors to develop accurate and competitive quotations.

Notwithstanding the above, at the discretion of the Agency where the delay or failure will significantly impair the value of the Contract to the State or to the Agency, the Agency may terminate the Contract or the portion thereof which is subject to delays, and thereby discharge any unexecuted portion of the Contract or the relative part thereof .

Notwithstanding the foregoing, the State reserves the right to join such action, at its sole expense, if it determines there is an issue involving a signif icant public interest.

In the event that an action or proceeding at law or in equity is commenced against the Agency arising out of a claim for death, personal injury or damage to real or personal tangible property caused by any intentional or willful act, gross negligence, or negligence of Contractor, its agents, employees, partners or Subcontractors, which shall arise from or result directly or indirectly f rom the Products supplied under this Contract, and Contractor is of the opinion that the allegations in such action or proceeding in whole or in part are not covered by the indemnification and defense provisions set forth in the Contract, Contractor shall immediately notify the Agency and the New York State Office of the Attorney General in writing and shall specify to what extent Contractor believes it is obligated to defend and indemnify under the terms and conditions of the Contract and to what extent it is not so obligated to defend and indemnify.
