PRE-QUALIFICATION
Ethics, Pre-Bid (2025)
Welcome to the Pre-Bid.
As a government agency, it is important to ensure the integrity of the procurement process is not compromised. In order to achieve this, there are a few rules to be aware of. These are not the only rules contained in the Contractor Code of Conduct, so please familiarize yourself with the code.
LOBBYIST REGISTRATION
Metro is required by state law to implement and maintain a Lobbyist Registration Program. The law states that all lobbyists, lobbying firms, and lobbyist employers must register with Metro prior to any lobbying contact with Metro, Board Members, or staff. The purpose of these regulations is to reveal to the public how much money is being spent on lobbying Metro.
Under the regulations, a lobbyist is defined as any person who receives compensation, other than reimbursement for reasonable travel expenses, who in a consecutive three-month period: (1) has at least one contact with an authority official or employee in an attempt to influence authority action; and (2) is compensated to engage in at least 15 hours of lobbying activity in connection with attempts to influence authority action.
It does not matter what your job title is or what you do for a living- if you meet these criteria, you would be considered a lobbyist under the regulations and would have to register prior to communicating with Metro.
Entities merely submitting proposals in response to a Metro RFP need not register.
If you lobby Metro without being registered with the MTA, and under State law you should be registered, you can be disqualified from receiving an award. You may register online at www.metro.net/about/ethics/. There is a small registration fee.
COMMUNICATIONS DURING PROCUREMENT
This procurement is currently in what we call a “Communications Blackout Period.” This period begins when the procurement solicitation is released and ends until Metro makes the recommendation for award public. A Communications Blackout Period can also restart when a protest on the recommendation is filed and continues until Metro issues the notice of determination.
The Contract Administrator is here to assist you with any questions and is the only person you may speak to during the Communications Blackout period with 3 exceptions:
(1) You may contact the Pre-Qualification Department about completing the forms in your packet that they require;
(2) You may contact the Diversity & Economic Opportunity Department with any questions concerning satisfying the goal for disadvantaged businesses; and
(3) You may contact the Ethics Department regarding ethical issues and questions about lobbying Metro.
Other than these 3 departments, all questions must be directed to the Contract Administrator;
this, in turn, helps us provide all answers from a single source. Do not contact anyone else at
Metro, including anyone that you know or may have spoken to before to discuss this procurement while it is pending recommendation. Likewise, do not contact Metro Board
Members or their staff to discuss this procurement while it is pending recommendation.
CONTRIBUTIONS
Members of the Metro Board are listed on Metro’s website; most of them are politicians. Under the Government Code, during a “pending proceeding” and for 12 months following a vote on a contract award, bidders and proposers are prohibited from making contributions over $500, and agents/lobbyists who communicate with LACMTA concerning the procurement are prohibited from making any contribution ($0), to Metro Board Members. You will be required to state in your ethics declarations whether you made any contributions prior to your proposal or bid.
GIFTS
Bidders and proposers, and their lobbyists, may not offer, give, or promise to offer or give, directly or indirectly, any gift to a Metro Board Member or employee. Furthermore, bidders and proposers, and their lobbyists, may not offer, give, or promise to offer or give, directly or indirectly, any gift to a Metro Board Member until 12 months after the contract award date.
Gifts include things such as lunch or tickets to a sporting event. Giving gifts to Metro Contract
Administrators is prohibited and a violation of this policy and can lead to disqualification from being awarded a contract.
EMPLOYMENT OF METRO PERSONNEL
Do not make offers of employment to Metro employees associated with the selection of the
Bidder during the pendency of the procurement, or as a reward for being awarded a contract.
Employees who are involved in the selection of contractors and scope of work for a procurement are particularly restricted. Each post-employment circumstance is evaluated individually, so please consult Metro’s Ethics Department to determine whether you may employ this person, at that time, for that specific work.
Lastly, please remember that Ethics Declarations must be completed by all prime contractors and subcontractors. All the questions must be answered. Failing to provide accurate and complete information could result in significant delays or cancellation of a procurement.
Thank you for your time and interest in responding to a procurement notice from Metro. Please feel free to contact the Ethics Department if you have any questions concerning the issues discussed. Take care.
