QUESTIONS AND ANSWERS 2 - 3 FOR

HTC711-12-R-R001

AERIAL DELIVERY SERVICES

QUESTION #2: Reference Attachment 5 to the Solicitation, Collective Bargaining Agreement

(Wage Determination No., CBA- 2011-4673) between Trailboss, Enterprises, and Aerial

Delivery Flight Services (ADFS) [employees] Union.

It appears that the Agreement is little more than a wage determination in and of itself and is a short version of the Wage Determinations under the Services Contract Act for other performance locales cited in the solicitation (Attachments 6,7, and 8). The hourly wage for a 23850 – Rigger and the minimum benefits in the region would bear that out. Thus, I am of the opinion that the

Agreement itself is actually a Wage Determination Agreement under the Services Contract Act and would supersede any other published wage determination covering the South Carolina performance location. I am also presuming that this agreement will follow-on with any resultant award from proposals submitted in connection with this effort. Is that so?

ANSWER #2: Attachment 5, CBA-2011-4673, is a Collective Bargaining Agreement Wage

Determination (CBA WD) and is binding on any follow-on contract period. The initial Collective

Bargaining Agreement (CBA) was executed by ADFS and Trailboss with an effective date of 30 Sep

2008. When the employees of the predecessor contractor are represented by a union, Section 4(c) of the Service Contract Act requires that for each follow-on contract period the Department of Labor

(DOL) issue a Wage Determination reflecting the wage and fringe benefit terms of the applicable collective bargaining agreement. Accordingly, the successor contractor for the subject contract shall be bound by the wage and fringe benefits terms of the CBA WD (CBA-2011-4673) regardless of any other wage determination issued by DOL covering the South Carolina performance location.

QUESTION #3: Is the Aerial Delivery Flight Services [employees] Union a recognized organization? If so, how large or small is the organization itself? I cannot find much information on them and it appears as if though it may be a loosely organized union that might have even been formed for the purposes of executing the current contract being primed by

Trailboss Enterprises.

ANSWER #3: ADFS, as described in the CBA WD, is an independent union created by and consisting of only the personnel performing Aerial Delivery Services at Joint Base Charleston.
