| 1 | RFP | Section B.4.1 Pricing Schedules | There are no CLIN’s for Move Management and Appraised Value Sales. Please consider adding these. | The USSS does not use Move Management. The service has been added to the Rider fee table. Definition of Regular Sale under B-4 Schedules has been changed to include Appraised Value Sales, consistent with PWS B.4. |
| 2 | RFP | Section B.4.1 Pricing Schedules | Please explain what information is being requested looking in the various CLIN’s. | 108 | RFP | Page 41, Performance-Based Rate Adjustment | What is the basis for the Performance-Based Rate Adjustment and what is the adjustment range (for example, can the USSS elect to adjust rates without discussion or limitation)? In addition, the CPI adjustment references the Performance-Based Rate Adjustment. How do these two adjustments relate? | There are set dollar amounts for incentives/disincentives based on the performance requirements, reference Attachment 2--Performance Requirement Summary. There is no limit to PRS adjustments. Performance-based rate adjustments are discussed in detail with contractor before applied. Performance-based rate adjustments are not annual rate adjustments. | |
| 109 | RFP | Page 42, M-2.1, Evaluation Criteria | The fifth paragraph states that the Technical/Organization evaluation will include a risk assessment. Can the USSS advise what types of situations would represent a “proposal risk?” For example, some contractors may conduct simultaneous closings on amended value and BVO transactions to minimize risk and avoid/delay mortgage payoff. This does not conform to the ERC 11-key elements. Would this be an example of a risk that the USSS would evaluate? | Examples will not be provided. | |
| 110 | PWS | 3.A, Purpose, Page 3 | This section states that the contractor shall provide additional services such as expense processing and Household Goods services. However, there is no provision in the Price Schedule for these services. Will the USSS modify the Price Schedule to include these requirements? | See SF30 amended changes to Section B. | |
| 111 | PWS | B.3.4 Condition of Appraisal, Page 17 | Paragraph a. states that appraisers should complete appraisal in accordance with the ERC appraisal guidelines. ERC guidelines allow for forecasting. Would the USSS please confirm whether forecasting is allowable? | Yes, forecasting is allowable. | |
| 112 | PRS | 8.A and 8. B Customer Satisfaction Rate/Home Sale Services | The PWS states that the USSS anticipates approximately 100 moves annually. This equates to approximately 8 moves per month. One negative service evaluation would result in marginal contractor performance, which results in a $10,000 penalty per quarter. We recommend that the USSS consider modifying the performance requirements to accommodate lower volume. | Performance Requirements will not be changed. | |
| 113 | PRS | 8.F.2. Data Communication Capabilities | Are the penalty requirements per employee impacted by the incident or is it a single penalty per incident? | Per incident. | |
| 114 | PRS | 8.F.2. Data Communication Capabilities | What and who determine the beginning and ending of an “incident?” | Contracting Officer's Technical Representative (COTR) | |
| 115 | PRS | 8.F.2. Data Communications Capabilities | Is there a contract maximum of financial risk that a contractor should assume when developing their process controls and pricing? | The ceiling amount (maximum) will be determined at the time of award. | |
| 116 | Under the Buyer Value Option home sale program, would you allow the contractor to order inspections upfront and hold the employee responsible for the repairs and re-inspection costs, similar to the inspection process allowed for the other home sale programs? | No | |||
| 117 | On the Pricing Schedule, you request “Fees for Regular and Amended Value Sales (Brokers):” What do you mean by “Brokers”? In the grid above this, you request pricing for “Secret Service” so does “Brokers” mean the other agencies eligible to use this contract or something else? | "Brokers" refers to the "Riders". See SF30 amended changes to Section B. | |||
| 118 | In the Pricing Schedule, you ask about discounts given for participants who list their homes within 105% of the appraised value and 105% of the BMA value. 105% is and has been the industry standard for a long time, so would you consider lowering this to 100% or <100% of the BMA and appraised value? | No | |||
| 119 | General | The due date for submission of the proposal is March 9, 2012. Is that the date the proposal must be post marked or the date USSS actually receives the proposal? | The USSS must receive proposals by the due date. | ||
| 120 | General | Will USSS accept an electronic submission of the proposal rather than hard copy? | No | ||
| 121 | PWS | Section 4 Guidance | The RFP refers to FAR 31.205-35, This applies to private sector companies with federal contracts. It describes allowable relocation expenses those private sector companies may charge back to the government when relocating their employees. Please clarify how FAR 31.205-35 would apply to USSS relocating employees. | FAR 31.205-35 does not apply. | |
| 122 | PWS | Section 4 Guidance | The RFP refers to 41 CFR 302 – Relocation allowances. Are we to assume this is a reference the FTR 302? | Yes, refers to FTR 302. | |
| 123 | PWS | Section 5 Definitions | Home that cannot be financed: Please further clarify the definition of “applicable industry criteria”. Since the reality is that Fannie Mae, Freddie Mac and FHA/VA do set the “applicable industry standards”, if the definition is not limited to them then what else is permitted as “applicable industry criteria? | Industry standards are defined by Fannie Mae, Freddie Mac and FHA/VA. | |
| 124 | PWS | Section 8 DESCRIPTIONS OF SERVICES, A.2 | Marketing strategies, recommendations and advice furnished by the contractor to the employee shall be provided in writing to the employee once per week via mail, facsimile or electronic mail depending on the employee’s preference. Can this requirement be modified to every other week? | No | |
| 125 | PWS | Section 8 DESCRIPTIONS OF SERVICES, A.5 | Upon completion of program employees will receive a survey issued by the Government, and based upon this survey, the contractor will receive a performance rating as described in the Performance Requirements Summary. Does the contractor participate in survey development? May we obtain a copy of the survey? |
| Contractors normally submit their own performance surveys to the transferring employees. If USSS is sending out their own survey to the employee should the contract also send the contractors performance survey to the employee? | See answer to question 74. | |||
| 126 | PWS | B: HOME SALE SERVICES, B.1.4 | The following properties are not eligible for the Home Sale Services portion of the contract: |
e. Homes that cannot meet guidelines for Conventional or Government-insured or guaranteed financing. This is a different definition than the definition of “Homes that cannot be financed” above. Please clarify.
| g. Dwellings containing more than one unit. Does this mean no duplexes or condos? | "e" We see these as being in agreement. "g" - If property is a duplex or other multi-family dwelling where employees actual residence takes up only a portion of the property, the employee would be responsible for proportional share of contractors fee. A single condominium unit in a condominium building is eligible. | |||
| 127 | PWS | B: HOME SALE SERVICES, B.1.5.b | b. If the employee sells land in excess of that which reasonably relates to the residence site, the Government will pay only the proportional share of the contract price that reasonably relates to the residence site. The Agency will determine the amount of land that reasonably relates to the residence site, based on Agency policy, the nature of the property in question and the prevailing conditions in the market for such property in the area. The Agency may require the contractor to provide a Brokers Market Analysis and/or an appraisal(s) to assist in determining the proportion of excess land. |
| Can this be modified so the determination of excess property is based on local custom as defined by the real estate broker and/or the appraisers? | No, it will not be adjusted. Local custom is considered. | |||
| 128 | PWS | B: HOME SALE SERVICES, B.1.7.c | In cases where a further specialized inspection is recommended per the specific inspection performed, the employee will have the option of allowing the contractor to order said inspection, or the employee may order the inspection with inspectors of their choosing. |
| Can this be modified to have the contractor and not thee employee select and order the inspection? | No | |||
| 129 | PWS | B: HOME SALE SERVICES, B.1.7: Inspections | b. Major components are defined as roof (flashing and skylights); structure (including foundation, bearing walls, joints/trusses, piers/posts, retaining walls, attic roof framing, decks/balcony, porch, and chimney); plumbing systems (water supply lines, plumbing waste lines, and water heater); pool and spas; mechanical systems (heating, cooling, and electrical); wood destroying organisms; moisture/suspected fungal growth; well; septic system; underground fuel storage tanks; and suspected asbestos. If the property is identified as having Exterior Insulation and Finishing Systems (EFIS) or synthetic stucco, the contractor may inspect and test to verify proper installation and/or moisture damage. Additional inspection or tests may be necessary to verify the actual condition of a major component. |
| What about exterior conditions such as driveways, out buildings and land? | No. Exterior conditions such as driveways, out buildings and land are not major compenents. | |||
| 130 | PWS | B: HOME SALE SERVICES, B.1.7: Inspections | The initial inspection of major components may be ordered at the same time appraisals are ordered if the Broker Market Analyses, or the employee Homeowner disclosure Form, indicates possible major property condition defects. This appears to conflict with paragraph a. above which states: |
“The contractor may order inspection of major components for homes authorized to participate in the home sale service to validate a home’s eligibility for the home sale service and to expedite the offer process.”
Please clarify if ordering inspections is contingent upon the BMA or Homeowner Disclosure Form indicating a condition issue.
Would the USSS consider allowing the Employee to select a qualified inspector from a list provided by the Contractor versus choosing their own inspector? This would ensure the inspector is pre-qualified and improve the speed of the process.
If a dispute occurs, and reasonable grounds exist to question the decision of the independent inspector as to eligibility would the Agency consider getting an additional opinion on the eligibility item in question by another independent inspector?
If the inspection reveals a condition that makes a home ineligible for the home sale service, will the Contractor require the condition be repair/remediated within 30 calendar days versus allowing a binding estimate to be accepted?
Ineligible conditions should be completely satisfied to continue with home sale services.
How does the USSS want the Contractor to provide the employee an estimate of repair cost for ineligible conditions? Most inspection will give an estimate of cost to cure. Is this acceptable? The removal and remediation of many toxic and hazardous substances are difficult to estimate the cost to cure because it may require several different repairs be completed at once. In these cases the Contractor would be unable to provide a sufficient
| estimate. | We do not feel there is a conflict. Major component inspections may be ordered by the contractor contingent upon the BMA and/or Homeowner Disclosure form. The employee has the option of choosing their own inspector only for specialized inspections. COTR will determine if an additional opinion is needed. Employee will have the option of doing repairs or allowing a binding estimate to be accepted. | ||||
| 131 | PWS | B: HOME SALE SERVICES, B.1.7: Inspections | g. If a dispute occurs, and reasonable grounds exist to question the decision of the independent inspector as to ineligibility, the applicable COR shall make the final determination of employee eligibility. Can this be modified to state that final determination will be made by the applicable COR and the contractor? | No | |
| 132 | PWS | B.1.8: Vacating Date | Please clarify “Acceptance Date”. Is it the date the contractor signs the contract of sale with the employee or the date the employee vacates the property whichever the later? |
The RFP states:
“This date (vacate date) may be extended in exceptional cases when approved in advance by the contractor and the COR. However, the employee shall be charged prorated fees during the vacate period for taxes and the regular mortgage payment.”
Please clarify who is to make the mortgage, utility and tax payments while the employee is in the property. The employee or the contractor after deducting the expenses from the employee’s equity?
| Although the RFP refers to the employee being responsible for the mortgage, utility and tax payments while the employee is in the property when the vacate date has been extended past the 45 days it is assumed that the employee is responsible for those payments in all cases until vacating the property not just in the case of the vacating date being extended past the 45 days. Is this correct? | Acceptance date is contract of sale date. During the 45 days period the employee is responsible for everything while they remain in the residence. If the 45 days is extended the employee remains responsible until they vacate. | |||
| 133 | PWS | B.2.4: Buyer Value Option (BVO) | The RFP states: |
k. BVO Equity Disbursement - Upon Acquisition, the contractor will prepare a Statement of Equity, prorating all debits and credits applicable to the property through the Vacate Date or Acquisition Date, whichever is later. The contractor will disburse ONE HUNDRED PERCENT (100%) of the equity within FIVE (5) working days of Acquisition by certified check, wire transfer or cashier’s check.
| It is normal and customary to hold back 5% of the employees equity until vacate in case there is an additional prorate or repair. Can the requirement for 100% disbursement at acceptance be changed to 95% with the remaining 5% paid at vacate? | No, in all cases employee will have vacated. | ||||
| 134 | PWS | B 3.1. | Are 4 – 6 appraiser choices acceptable in major metro areas? | No | |
| 135 | PWS | B.3.2. d. | Are the following appraiser qualifications acceptable to the USSS? |
• Certified Relocation Professional (CRP) preferred
• 10 years of appraisal experience
• History of completing relocation appraisals and mortgage appraisals
• Ability to demonstrate the use of forecasting, sales prep adjustments, vacant property adjustments
• Preferred variance of 5% or less - summary of their variance 6 month, 12 month, past month required
| • Meet federal/state licensing requirements | No, acceptable criteria is listed in PWS Section B.3.2. | ||||
| 136 | PWS | B.3.2.n. | Can RAC: Relocation Appraisers & Consultants be added to the list of appraiser organizations? | Yes | |
| 137 | PWS | B.3.4 a. | Appraisals are to be made on the property based on current market conditions. Appraisals shall be conducted according to the ERC appraisal guidelines, except as modified under this contract. | ||
| We assume this means that appraisals will be based on normal marketing time up to 120 days, is this correct? | Yes | ||||
| 138 | PWS | B.4.1 c (ii) and (iii) | (ii) The employee may elect to have his/her equity payment from the contractor offset (i.e., reduced) by the estimated cost of repairs and re-inspections necessary to bring the home up to standards set by the applicable law ordinance or code. |
(iii) The employee may elect to have the funds in the amount of the estimated repairs placed in escrow with an escrow mutually acceptable to the contractor and the employee. The employee shall place funds in escrow at the time he/she accepts the contractor's contingent offer. The employee's liability for repairs and re-inspections shall not exceed their estimated cost; any additional cost will be the responsibility of the contractor. If the final cost of repairs and re-inspections is less than the amount of funds in escrow, the difference shall be credited to the employee, except in those instances when any errors and/or omissions are attributable to the employee. If the house is sold “as is” prior to the stipulated repairs being complete by the contractor, the funds deducted from the escrow shall be returned to the employee and not used for other purposes.
Can this be modified to reflect a binding estimate not just an estimate?
There are many instances where the total cost to cure cannot be estimated until the work actual begins. For example the extent of water damage underneath exterior
| siding. | No | ||||
| 139 | PWS | B.4.2. | In the event an appraiser made an “error of fact” or “mathematical error” and is unable to return their corrections in 2 working days is it acceptable to return the written offer after 2 working days as long as the Agency has been notified? Many appraisers are in the field during the day and unable to return emails/phone calls. | All errors should be addressed and corrected prior to the employee receiving their oral offer which shuold not effect the written offer being made within 2 working days after the oral offer is made. | |
| 140 | PWS | B.4.4.c. | Stipulating that the appraised value cannot be lowered as a result of the re-evaluation process is a violation of USPAP. Can this be removed from the Performance Work Statement? Appraisers would not be willing to violate USPAP. Further maintaining that the appraisals cannot be lower is considered to be directing the appraiser and can violate the tax protection. | No | |
| 141 | PWS | B.6: Amended Value Sales | The RFP states: |
B.6.4: The contractor shall amend its original offer to the employee, revising its purchase price to the amount of the potential outside buyer's purchase price as adjusted. This amended value offer may be a contingent offer only to the extent provided for "bona fide offers" as defined in this statement of work. Accordingly, no contingencies may be included other than those that: a) provide for repairs and re-inspections required under Section 8.B.1.4.i-j., 8.B.1.7 and 8.B.3.3.b.5.(iv);
b) Provide that the potential outside buyer must qualify for financing;
| Part b. above is inconsistent with the IRS revenue ruling 72-339 and 2005-74. Please clarify. | Answer can not be provided at this time. | |||
| 142 | PWS | B.7: Amended-From-Zero Sales, B.7.1: | If the employee receives an acceptable bona fide offer from a potential outside buyer prior to completion of the appraisal process he/she shall immediately notify the contractor. The employee shall not enter into a contract or sign an agreement document with the potential outside buyer. |
| Does the contractor stop the appraisal inspection process at any point or continue the appraisal process? | If the appraisal process has begun it will continue so a buyout offer can be in place in case the outside offer should fall through. | |||
| 143 | PWS | B.7: Amended-From-Zero Sales, B.7.3: | The contractor shall obtain independent broker’s market analysis by TWO (2) licensed real estate brokers of the contractor's choice. These firms shall not have a business or personal relationship with the employee, the employee’s real estate broker or the contractor that could affect the objectivity and/or independence of the inspection. The higher of these TWO (2) analyses shall serve as a benchmark of market value to help determine the reasonableness of the offer. |
| Can BMA’s previously obtained in the listing process be used? Can this be modified to use the average of the two BMA’s to serve as the benchmark of market value instead of the higher of the two BMA’s? | Yes, recently obtained BMA's may be used. No, modification referencing the averge of the two BMA's. |
