SECTION M
52.212-2 EVALUATION—COMMERCIAL ITEMS (OCT 2014)
ADDENDUM
EVALUATION FACTORS
1) BASIS FOR CONTRACT AWARD
Unless all offers are rejected, the Government intends to award a single, firm fixed price Indefinite Delivery, Indefinite Quantity (IDIQ) contract to the responsible Offeror whose offer, conforming to the solicitation, is determined to be the best overall value, price and other factors considered. The Government may select for award the Offeror whose price is not necessarily the lowest, but whose technical proposal is more advantageous to the Government and warrants the additional cost (Tradeoff Source Selection see FAR 15.101-1). Offerors must satisfy the requirements described in the Performance Work Statement (PWS), as well as other Request for Proposal (RFP) requirements. Proposals that take exception to any requirement may be deemed to be unacceptable.
2) EVALUATION FACTORS
The evaluation will be based on a complete assessment of the Offeror’s proposal. Proposals shall be evaluated on the following factors listed below. Factor 1: Key Personnel/Staffing Plan is significantly more than Factor 2:
Technical Approach/Capability and Factor 3: Past Performance. Factor 2: Technical Approach/Capability is more important than Factor 3: Past Performance. Factor 2: Technical Approach/Capability, Factor 3: Past Performance are significantly more important than Factor 4: Price.
• Factor 1 – KEY PERSONNEL and STAFFING PLAN
• Factor 2 – TECHNICAL APPROACH and CAPABILITY
• Factor 3 – PAST PERFORMANCE
• Factor 4 – PRICE
Factor 1: Key Personnel/Staffing Plan The Government will evaluate the extent that the proposed staffing plan has a) a complete staffing plan addressing all elements indicated in the instructions, b) key personnel matrix (meet the minimum qualifications experience, education/certification levels), c) addressed its ability to meet security requirements, and d) demonstrated how the Offeror will ensure personnel coverage during employee leave, as specified in PWS section 1.6.11.
Factor 2: Technical Approach/Capability The Government will evaluate the adequacy of the Offeror’s approach and understanding of the requirements specified in the solicitation and all attached documents, as demonstrated by the proposed technical approach and capabilities. Elements of this evaluation include:
i.) Technical Approach/Capability: The Government will evaluate the extent that the proposed technical approach/capability adequately meets the tasking and requirements throughout the performance period.
The technical approach and capability will also be evaluated based on the following elements:
• Preventive Maintenance Plan (PWS Section 5.7.3)
• Quality Control Plan (QCP) (PWS Section 1.6.1)
• Contingency Support (PWS Section 5.5) ii.) Subcontracting Plan: The Government will evaluate the Small Business Participation Plan of the offeror’s proposal in accordance with the following criteria:
• The extent to which such firms are specifically identified in proposals
• The extent of commitment to use such firms
• The complexity and variety of the work small firms are to perform
• If the prime offeror is a small business then a subcontracting plan is NOT required.
However, a statement must be enclosed within the proposal identifying the prime offeror as a small business and is not required to submit a subcontracting plan.
Factor 3: Past Performance The Government will evaluate how well the offeror has performed on contracts that have been determined to be both recent and relevant to the PWS.
Past performance is a measure of the degree to which the Offeror satisfied its customers in the past and complied with Federal, State, and local laws and regulations, as identified as the Prime Contractor or direct employee or consultant. The Government may contact some, all or none of each Offeror’s customers to ask whether: (1) the Offeror is capable, efficient, and effective; (2) the Offeror’s performance conformed to the terms and conditions of its contract; and (3) the Offeror was reasonable and cooperative during performance; (4) the Offeror was committed to customer satisfaction; (5) the Offeror was able to hire and retain qualified personnel to the satisfaction of the customer; and (6) if they would select the same Contractor or a different Contractor, given the opportunity.
The Government may also use other information available from other sources to evaluate an Offeror’s past performance, which may include, but not limited to: Past Performance Questionnaire, Federal, State and local Government agencies, Better Business Bureaus, published media, electronic databases such as the Contractor Performance Assessment Reporting System (CPARS) and the Past Performance Information Retrieval System (PPIRS), U.S. Army Corps of Engineers Constructions Contractor Appraisal Support System (CCASS), Architect/Engineer Contract Administration Support System (ACASS). The Government reserves the right to limit or expand the number of references it decides to contact and to contact references other than those provided by the Offeror.
** A relevant project is defined as:
- A contract for the maintenance of high-voltage electrical equipment
- The total contract value is between $5,000,000 to $15,000,000 during a 5-year period or $1,000,000 to $3,000,000 annually
- The offeror must be the prime contractor or subcontractor
- The three references must be on-going or completed within the previous three (3) years of the date of this solicitation (not before June 12, 2014). If the referenced contract has expired, the end date of the contract performance must have occurred within the last one year from the date of the proposal submission deadline.
-If the referenced contract is an active contract at the time of proposal submission, the start date of the contract performance must have occurred no less than one year from the date of the proposal submission deadline.
The Government will focus its evaluation on the following areas: (1) The offeror’s track record of failure rate of the equipment being maintained (2) The offeror’s track record for reliable responses to unexpected equipment failures
(3) The offeror’s track record of contract management (e.g. cost management, personnel management, level of customer intervention required) (4) The referenced customer’s willingness work with the offeror again on similar, future projects
Using the method as described in this section, the Government will assign a rating that indicates its level of confidence in the offeror’s ability to successfully perform the proposed contract requirements based on its performance on similar contracts in the past.
In the case of an Offeror without a record of relevant past performance or for whom no information on past performance is available, the Offeror will not be evaluated favorably or unfavorably on past performance.
Factor 4: Price The Government will perform a price analysis to determine the reasonableness of the offeror’s price proposal.
Reasonableness may be based on one or more of the price analysis techniques in FAR 15.404-1 including, but not limited to, comparison to the Independent Government Estimate (IGE), comparison to other offers, and/or comparisons to commercial prices. For a price to be reasonable, it must represent a price to the government that a prudent person would pay in the conduct of competitive business. Normally, price reasonableness is established through adequate price competition, but may also be determined through cost and price analysis techniques as described in FAR 15.404. The offeror’s proposed approach must be consistent with the price proposal. As part of the price evaluation, proposals may be reviewed to identify any significant unbalanced pricing in the Price Schedule. In accordance with FAR 15.404-1(g), Unbalanced Pricing, a proposal may be rejected if the Contracting Officer determines the lack of balance poses an unacceptable risk to the Government. Price will not be scored or receive an adjectival rating. The Government will determine if the offeror's proposed price reflects the offeror's understanding of the requirements and if the proposed price is consistent with the offeror's proposal.
For evaluation purposes only, the total evaluated price for task order 0001 is the sum of the total prices submitted for
(a) the base period, (b) all option periods, and (c) the six-month extension authorized by FAR clause 52.217-8. The labor mix (categories, hours, rates) will be evaluated for consistency IAW the Offeror’s approach for all of the IDIQ’s performance periods. For purposes of determining the evaluated price for the six month 52.217-8 extension, the total price is calculated as one-half of the total price of the final option year. The Government may determine that a proposal is unacceptable if the option prices are significantly unbalanced. Evaluation of options will not obligate the Government to exercise the option(s).
3) RATING METHODS
a. FACTOR 1 KEY PERSONNEL/STAFFING PLAN
Factor 1 Rating Scheme:
Volume II each proposal shall be given a single rating identified in Table 1 that most accurately describes the Offeror’s proposal for Factor 1 using the adjectival rating.
Table 1. Key Personnel and Staffing
Rating Description
Outstanding
Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.
Good
Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.
Acceptable
Proposal meets requirements and indicates an adequate approach and understanding of the requirements, and risk of unsuccessful performance is no worse than moderate.
Marginal
Proposal had not demonstrated an adequate approach and understanding of the requirements, and/or risk of unsuccessful performance is high.
Unacceptable
Proposal does not meet requirements of the solicitation, and thus contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable. Proposal is unawardable.
b. FACTOR 2 TECHNICAL APPROACH/CAPABILITY:
Volume III of each proposal shall be given a single rating identified in Table 2 that most accurately describes the Offeror’s proposal for Factor 2 using the adjectival rating.
Factor 2: Rating Scheme: The technical approach and capability evaluation rating identified in Table 2 that reflects the degree to which the proposed approach meets or does not meet the threshold performance or capability requirements through an assessment of the relative strengths, deficiencies, significant weaknesses, and risks of a proposal.
Table 2. Technical Approach and Capability
Outstanding Proposal indicates an exceptional approach and understanding of the requirements and contains multiple strengths, and risk of unsuccessful performance is low.
Good
Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.
Proposal is unawardable.
c. FACTOR 3 PAST PERFORMANCE:
Volume IV of each proposal shall be given a single rating identified in Table 2 that most accurately describes the Offeror’s proposal for Factor 2 using the past performance confidence assessment rating.
Factor 3: Rating Scheme:
There are two aspects to the past performance evaluation: recency, and relevancy.
Step 1 – Recency. The first step is to evaluate the recency of the offeror's past performance. Recency is generally expressed as a time period during which past performance references are considered relevant, and is critical to establishing the relevancy of past performance information. Performance of each reference must be on-going or completed within the previous three (3) years of the date of this solicitation (not before June 12, 2014).
Step 2 – Relevance. The second step is to determine how relevant a recent effort accomplished by the offeror is to the effort to be acquired through the source selection. The relevancy rating evaluates the aspects of an offeror's history of contract (or subcontract) performance that would provide the most context and give the greatest ability to measure whether the offeror will successfully satisfy the current requirement. There are four levels of relevancy as shown in Table 3.
Table 3. Past Performance Relevancy Rating Method Rating Definition Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Somewhat Relevant
Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.
Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
In the case of offerors for which there is no information on past contract performance or where past contract performance information is not available, the offeror may not be evaluated favorably or unfavorably on the factor of past contract performance (see FAR 15.305(a)(2)(iv).) In this case, the offeror's past performance is unknown and will be assigned a performance confidence rating of “Neutral Confidence”, shown in table 4.
Table 4. Performance Confidence Assessments Rating Method
Substantial Confidence
Based on the offeror’s recent/relevant performance record, the Government has a high expectation that the Offeror will successfully perform the required effort.
Satisfactory Confidence
Based on the offeror’s recent/relevant performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort.
Neutral Confidence
No recent/relevant performance record is available or the offeror's performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.
The offeror may not be evaluated favorably or unfavorably on the factor of past performance.
Limited Confidence Based on the offeror’s recent/relevant performance record, the Government has no expectation that the Offeror will be able to successfully perform the required effort.
No Confidence No recent/relevant performance record is available or the Offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.
d. FACTOR 4 PRICE:
Volume V the price factor will not receive a rating, but the evaluated price must be found to be fair and reasonable in order to be eligible for award. The pricing evaluation will be based on price analysis techniques found in FAR 15.404-1 to determine if they are fair and reasonable. Price analysis will be used to determine the total evaluated price to support the selection of the best overall valued offer. For evaluation purposes, the total evaluated price will be:
1. The total prices submitted for Task Order 0001’s base period and all additional ordering periods (Attachment Price Schedule), proposed labor mix for the IDIQ, and completed SF1449 CLINs.
2. An amount equal to one-half the final option year price (6 months) to cover the cost of the potential option under FAR 52.217-8.
3. Attach the Completed SF1449
