Q&A Set 3 (180126)

RefQuestionAnswer
NoneIs there any Government Exemption offered for the General Excise Tax (GET) of Hawaii?Offerors are responsible for understanding the General Excise Tax Laws
Section J-5Will the Government please explain the intent of the ITAR country list? Is it meant to represent partner nations to be trained? Will the Government please provide clarification on how the Section J-5 ITAR Country List is applicable and the specific training or other defense services to be performed by the offeror for those countries?Partner Nation participation varies from exercise to exercise. During the JELC if foreign nationals are identified as part of training audience, the Government will provide sufficient time for vendor to obtain ITAR.
SOFAWill the Government please identify any positions under this contract which fall under article 72 SOFA status? All positions in Germany and Korea
SOFAWill the Government provide a list of any positions under the existing contract that are currently approved under article 72?All of the positons in Korea. With Germany positions, only 4 have been grandfather under the current UEWTEP, (2 of the 3 at each TSOC). The current UEWTEP contract has not yet been approved by the German Government.
SOFAWill the Government please confirm that this contract will receive article 72 approval?Current contract for support in Korea is approved, as for Germany it is a longer process and the US Government cannot confirm the contract will be approved by the German Government under article 72.
SOFAWill the government allow pricing adjustments if the contract is not approved under article 72?No, if the German Government will not approve the contractor to work under article 72, the US government will not support contractors under the UEWTEP contract to work in Germany.
SOFAWill the Government consider an ODC pricing approach that takes into consideration ODCs with DOCPER approval and ODCs without DOCPER approval in those instances where the authorization procedure for granting independent status to contractor personnel filling Analytical Support (AS) positions in Germany might be suspended for a period of time. This would help to mitigate disruption to critical services and afford realistic budgeting estimates for vendor and customer.No. The ODC plug number is based on historical data.
J-2 KSAsLine 1 of KSA: does the term “Prior SOF” refer to qualified SOF operational personnel only, or to assignment with SOF organizations, including in support roles? If only operational personnel will be accepted, which service qualifications or career designators meet that requirement?Line 1 of KSA: does the term “Prior SOF” refer to qualified SOF operational personnel only? The answer is No. Personnel will have worked in support of SOF at any SOF organization to include deployed operational head quarters or task forces and have a working knowledge of SOF operation in the labor category. If only operational personnel will be accepted, which service qualifications or career designators meet that requirement? This does not apply as stated above.
J-2 KSAsLine 1 of KSA: The rank of E-9 is omitted from the list of acceptable ranks for Prior SOF for the “SOF Operations & Planning Analyst/Trainer.” However, in line 3, Senior Enlisted Advisor is listed as acceptable for recent experience. In addition, E-9 is listed as an acceptable rank for Prior SOF. Will the government accept former E-9’s who meet the recent SEA requirement?Yes
J-2 KSAsLine 2 of KSA: does the term “operational-strategic special operations experience” refer to service in organizations above tactical level only? Does service in tactical level organizations such as an SF Battalion, SEAL teams, or SOTFs count when evaluating the 18 years of service requirement?Part 1: Yes, this is for service for organizations at the Operational-Strategic level. Part 2: Yes. However, within that 18 Years of service they must have operational-strategic special operations experience (SOTF, JSOTF, SF Battalion, Seal squadron, etc.)
J-2 KSAsLine 3 of KSA: which position does the term “primary staff billet” refer to? Are other positions such as deputies, division and section chiefs, etc. excluded from meeting this qualification?Part 1: Assigned to a Staff in a primary billet, not Term or TDY for a short time, must have filled a billet on a JMD or JTD. Part 2: No, if they are a billet on a JMD or JTD.
J-2 KSAsLine 3 of KSA: does service as primary staff in SOF organizations such as a CJSTOF, SOJTF, SOTF, SF Group, NSW Group, etc. meet the requirement for recent experience?Yes, if they are a billet on a JMD or JTD. Service as primary staff in those organizations listed, meet the experience requirement, provided they were in a JMD or JTD billet and service in that position is considered "recent" as defined in this RFP."
J-2 KSAsLine 3 of KSA: command, SEA, and primary staff billets are typically 2 years in duration, but the requirement specifies 4 years of experience. Does the government intend to exclude candidates without multiple command and primary staff billets? No, the Government does not intend to exclude candidates without multiple command and primary staff billets.
J-2 KSAsLine 3 of KSA: does the recency requirement of “within the past 5 years” refer to the last date of service in a qualifying position/organization, or must the entire 4 years of experience have taken place within the last 5 years? Each line in the KSAs are independent. Personnel must have recent experience which has taken place within the last 5 years (PERIOD). Regarding the entire 4 years of experience haven taken place within the last 5 years, the answer is No. These are independent lines within the KSA.
Can the glossary, table of contents, cover page, and other pages not in the page-limited sections be single spaced?Yes
Can the cover page exceed the 1 inch margins (e.g. graphics, logos)? No, Graphics and Logos are not desired.
For Amendment 2, from the Summary of Changes file, the directions state that the Offerors are not required to sign and return this Amendment or the Conformed RFP. However, from the first set of questions, the answer to question #19 states "This RFP will have Amendments. It is important that the conformed RFP be submitted with the proposal to confirm the Offeror has proposed to the correct/conformed amended RFP." Should we include in our proposal the conformed RFP for the latest Amendment?Individual amendments do not need to be signed and returned when published. However, the final conformed copy of the RFP (with all amendments incorporated) must be signed and included with the proposal when submitted. The Government does not anticipate additional changes to the RFP following Amendment 03, which will be uploaded to FBO 26 Jan 2018.
Given that this is an 8(a) SB award, would the Government please consider removing DFARS 252.216-7002 Alt A from the UEWTEP FRFP as the cost to administer this clause would be burdensome on a Small Business?Offerors shall propose rates using attachment J-2. The agency has authorized the contracting officer to require the identification of all subcontractors, divisions, subsidiaries, or affiliates included in a blended labor rate.
Section HGiven that the Government has confirmed that SOFA applies to UEWTEP II, will the Government please include FAR Clauses 52.229-6 Taxes-Foreign Fixed Price Contracts (FEB 2013) and 52.229-8 Foreign Cost-Reimbursement Contracts in the RFP?This effort is not a Fixed Priced contract or a Cost Reimbursement Contract. It is a Labor Hour contract with cost type CLINs. 52.229-6 and 52.229-8 do not apply
Will the Government extend the proposal submission due date?No
We understand ICE is the incumbent, of the positions identified in TO 1000, are all 153 currently filled by the incumbent? if not how many are new positions to be filled by the new contract? And can you identify those positions that are new?The Government will not disclose the business practices of the incumbent. Titles of positions may have been updated, but there are no 'new' positions for UEWTEP II.
There are several references to CAAF. Does the government anticipate any deployment to contingency locations such as Iraq, Afghanistan, Syria or Libya? If so will the allocated ODC for DBA insurance be modified to allow for the difference for DBA in those locations?Historically, there have been instances where 1-2 personnel, during the course of the contract, were sent to contingency areas, to support operations on a temporary basis. Presently there is no requirement for personnel to be in contingency areas. If the requirement arises, DBA will be billed to the ODC. The plug number for ODCs considers this.
The government makes reference to Joint Venture numerous times in this reference, Did the government sponsor any joint ventures for this effort? No
With an anticipated award date of 10 May 2018 and an expectation of a 90% FOB by 6/18/2018, it is obvious that the incumbent capture will be a critical component of this transition, specifically because all the positons require SCI which for new personnel can take significantly longer given all the security factors to transfer SCi from another agency or even within DOD. Can the government confirm that all the incumbent personnel meet the qualification requirements of the new RFP/contract? If not how many incumbert personnel do not meet requirements, and was this due to a change from the existing contract to this new contract or some other existing obstacles? The incumbent personnel meet the qualifications
Section L 1.2 states the Government will perform a virus scan (McAfee VirusScan Enterprise version 8.8) on all electronic files/CDs provided by the Offerors. Section L.1.8 states mail delivery is acceptable. Hand delivery is also permitted. Hand delivery must be made by a person from the Offeror’s/teaming partner's staff. A messenger service delivering the proposal package on behalf of the Offeror is not considered a hand delivery, and will not be accepted. All hand-carried proposal documents, to include CD-ROMs shall be delivered to the address below. Offerors are requested to provide a 24-hour notice to the Point of Contact (POC) at the telephone number below to provide notification of pending arrival.Section

L.1.9 Submit or Hand Deliver clearly marked proposals to:

Will the government confirm that they will or will not accept electronic submissions?Electronic submission, i.e. sent via email only will not be accepted. The Offeror shall submit proposals IAW Section L, Table 1.
Will the Government please confirm that subcontractors are not required to submit those items required in Section L.6 Cost/Price, other than the requirement in L.6.5 Total Employee Compensation Plan?Yes. The Government only requests subcontractor data, as it relates to total employee compensation.
From Questions & Answers Set 2, for Question 21, the Government stated that the Offerors can use the ISFD print out as proof of a Top Secret Facility Clearance. While putting together the documentation for Volume 1 - Qualifying Criteria, we realized the ISFD print out is classified as UNCLASSIFIED // FOR OFFICIAL USE ONLY. Are there any issues with Offerors submitting Volume 1 of the proposal as U//FOUO?There are no issues with submitting Volume 1 as U//FOUO. The Offeror may also submit DD Form 441 and DD Form 441-1 (if applicable) as proof of current facility clearance. Regardless of what proof the Offeror chooses to submit with their proposal, the Government will verify the information provided.
In attachment J-2, it states“The prime contractor and subcontractors will use the same fully loaded labor hour rates for each contract year.”, which appears to be inconsistent with the DFARS clause which states: 252.216-7002 Alternate A, Time-and-Materials/Labor-Hour Proposal Requirements – Non-Commercial Item Acquisition with Adequate Price Competition. As prescribed in 216.601(e), substitute the following paragraph (c) for paragraph (c) of the provision at FAR 52.216-29: ALTERNATE A, TIME-AND-MATERIALS/LABOR-HOUR PROPOSAL REQUIREMENTS—NON-COMMERCIAL ITEM ACQUISITION WITH ADEQUATE PRICE COMPETITION (FEB 2007) (c) The offeror must establish fixed hourly rates using separate rates for each category of labor to be performed by each subcontractor and for each category of labor to be performed by the offeror, and for each category of labor to be transferred between divisions, subsidiaries, or affiliates of the offeror under a common control. Would the Government consider removing the DFARS clause 252.216.7002?No, the DFARs clause remains in the RFP. Concerning "the offeror must establish fixed hourly rates using separate rates for each category of labor to be performed by each subcontractor and for each category of labor to be performed…Please see the answer to question 18.
