ITEM B:

MODIFICATION to the Government’s Answer to RFQ Questions Log, No. 8 (issued under Amend 2).

Project Labor Agreement (PLA)

(THIS ITEM WILL BE MORE CLEARLY DEFINED IN STAGE 2 (RFP) OF THIS REQUIREMENT)

PBS Procurement Instructional Bulletin 10-04 is in effect.

A Project Labor Agreement (PLA) is a collective bargaining agreement between a contractor, its subcontractors, and labor unions in which the parties define terms of employment for all laborers, unions and non-union, to be employed on a specific construction project.

The use of PLAs applies to solicitations for construction projects with a value of $25 million or greater.

For this requirement, offerors may submit a proposal subject to the PLA requirements set forth in the Agreement section of this solicitation (a PLA proposal), a proposal not subject to the PLA requirements set forth in Agreement section of this solicitation, or both. Any proposal submitted shall clearly identify whether it is subject to such PLA requirements.

For this requirement, the assignment of 10% of the technical score for proposals subject to PLA requirement reflects the reduced project risks attributable to wage stability, efficient resolution of disputes, avoidance of work stoppages, and the potential for project-specific coordination of work rules, increased labor availability, and other benefits offered by PLAs for large scale construction projects.

A proposal submitted subject to the PLA requirements set forth in the (Stage 2) Agreement section of this solicitation will receive full credit under this evaluation factor. A proposal submitted not subject to such PLA requirements will receive no credit under this evaluation factor. (More clearly defined in Stage 2) Reference FAR 52.222-33 Notice of Requirement for Project Labor Agreement (May 2010) and FAR 52.222-34 Project Labor Agreement (May 2010)

ITEM C:

DELETE Para. V.A Evaluation of Offers in its entirety as issued in the Solicitation and INSERT the attached revised Para. V.A Evaluation of Offers (dated 03/30/12) in lieu thereof.

ITEM D:

Offerors must acknowledge receipt of all Amendments, giving number and date, on Company Letterhead. This letterhead is not to be included in the not–to-exceed numbered page count of the Technical Proposal (Volume II).

END OF AMENDMENT NO. THREE (3)

Attachment

Revised Para. V.A Evaluation of Offers (dated 03/30/12) V.A Evaluation of Offers The Government may award a contract resulting from this Solicitation to the responsible offeror whose offer conforming to the Solicitation will be the best value to the Government, Total Evaluated Price and other factors considered. In addition to Total Evaluated Price, the following non-price factors shall be used to evaluate offers:

Stage I (Request for Qualifications):

V.A.1 Experience on Comparable Projects Relative weight = 25% Description:

This factor considers the extent of the offeror’s past experience in performing similarly complex work.

Procedure for Evaluation:

The Government will evaluate whether the offeror has general construction experience involving projects possessing characteristics of similar complexity to the Eisenhower Memorial project. A project that possesses more of the “similarly complex” characteristics will be considered most similarly complex to the Eisenhower Memorial project and will receive a more favorable evaluation.

V.A.2 Key Personnel

Relative weight = 20% Description:

This factor considers the qualifications, commitment, and availability of the key personnel proposed by the offeror to execute the contract requirements for the positions proposed. Offerors must submit resumes of the individuals proposed for the following positions: Project Executive, Project Manager, Superintendent, QC/QA Manager, Underground Utility Coordinator, and Artist/Artwork Coordinator.

Procedure for Evaluation:

The Government will review the resumes submitted by the offerors to ascertain their educational background, experience, and certifications. The Government will also assess the “INDIVIDUAL’S PERFORMANCE QUESTIONNAIRE” references submitted for the Project Executive, the Project Manager, and the Superintendent regarding their individual past performances in their respective positions. The standard is met when the individuals proposed for the key positions have the requisite education, experience, and certifications to satisfactorily perform the functions required by the positions proposed. The more relevant experience, relevant higher education and certifications, the more qualified the individual will be perceived to be for the position proposed. In addition, the Government will evaluate whether the key personnel have worked together on comparable projects. The proposed individuals must be available to staff the project upon award and the offerors must provide a written commitment to provide the proposed individuals.

V.A.3 Management Approach

Relative weight = 10% (Stage I- RFQ)

Relative weight = 10% (Stage II- RFP)

Relative weight = 20% (total)

This factor considers the offeror's ability to manage the construction process.

Procedure for Evaluation:

The Government will review the offeror’s plan to insure that the proposed project organization is realistic for the scope and complexity of the project. The evaluators will also review the offeror’s proposal to determine if the proposed organization is adequate for managing their subcontractors.

V.A.4 Past Performance of Firm

Relative weight = 10%

This factor considers the offeror’s past performance as a firm in providing general construction services on the three (3) of the “similarly complex” projects identified by the offeror under V.A.1, Experience on Comparable Projects.

Procedure for evaluation:

The Government will review the questionnaires submitted directly to GSA by the offeror’s references. If considered appropriate, additional references may be contacted. Evaluators may consider performance on contracts which are not submitted by the offeror if they have knowledge of contracts not listed or if contracts are discovered during interviews that were not listed.

Stage II (Request for Proposals):

V.A.5 Labor/Trade Apprenticeship and Training Program Relative weight= 10%

V.A.6 Small Disadvantaged Business Participation Plan Relative weight= 5% V.A.7 Project Labor Agreement

Relative Weight= 10% Non-Price Factors, when combined, are significantly more important than the Total Evaluated Price.
