The FTA Requirements and Regulations impose extensive compliance obligations on contractors, including Buy America requirements mandating that all steel, iron, and manufactured products be produced in the United States unless a waiver is granted, Disadvantaged Business Enterprise (DBE) participation goals, prevailing wage requirements under the Davis-Bacon Act for construction projects exceeding $2,000, and performance bonding requirements equal to 100 percent of the contract value. Additional requirements include Americans with Disabilities Act compliance, Civil Rights protections, drug and alcohol testing programs, record retention for a minimum of three years post-contract, debarment and suspension certifications, and restrictions on lobbying and certain telecommunications equipment. The contractor must demonstrate financial stability, submit appropriate certifications regarding federal tax liability and felony convictions, and maintain compliance with environmental standards under the Clean Air Act and Federal Water Pollution Control Act. Termination provisions allow the agency to terminate for convenience or default, with specific cure periods and dispute resolution mechanisms established through the contract.
