About this file

This is a Form 6 SBE/DVBE Regular Dealer-Distributor Affirmation Form for Metro's procurement process related to the purchase of four hi-rail bucket trucks for the agency's Maintenance of Way Traction Power System fleet expansion in California. The form is used to make preliminary counting determinations for Small Business Enterprises (SBEs) and Disabled Veteran Business Enterprises (DVBEs) listed as regular dealers or distributors to assess their eligibility for credit toward contract participation requirements. The affirmation form requires SBE/DVBE vendors to document their capacity and intent to perform as either regular dealers or distributors, with bidders responsible for verifying the accuracy of information provided and ensuring proper counting of SBE/DVBE participation.

The form establishes credit allocation methodology whereby SBE/DVBE regular dealers can receive 60 percent credit for materials and supplies maintained in on-hand inventory at their establishment, while SBE/DVBE distributors can receive 40 percent credit, including for drop-shipped items, contingent upon assuming responsibility for items from point of origin. Vendors must complete a series of yes-or-no questions to demonstrate whether they meet regular dealer requirements based on inventory maintenance and delivery capabilities, or alternatively qualify for distributor credit by assuming risk of loss or damage through written terms in purchase orders or bills of lading. Bidders submitting SBE/DVBE participation must attach documentation including quotes, commitments, contracts, or purchase orders showing the materials the SBE/DVBE is supplying, and both the SBE/DVBE representative and the bidder's authorized representative must sign the affirmation attesting to the accuracy of information provided and the company's ability to perform commercially useful functions consistent with the responses indicated on the form.

FORM 6

SBE/DVBE Regular Dealer/ Distributor Affirmation Form

Metro will make a preliminary counting determination for each SBE/DVBE listed as a regular dealer or distributor to assess its eligibility for 60 or 40 percent credit, respectively, of the cost of materials and supplies based on its demonstrated capacity and intent to perform as a regular dealer or distributor, as defined in the Instructions to Bidders/Proposers of the solicitation and in the Contract Compliance Manual, under the Contract at issue. An SBE/DVBE regular dealer is a firm that owns (or leases) and-operates, a store, warehouse, or other establishment in which the materials, supplies, articles, or equipment of the general character described by the specifications and required under the contract are bought, kept in sufficient quantities, and regularly sold or leased to the public in the usual course of business. Items kept and regularly sold by the SBE or DVBE are of the ‘‘general character’’ when they share the same material characteristics and application as the items specified by the contract. A SBE distributor is an established business that engages in the regular sale or lease of the items specified by the contract. An SBE/DVBE distributor assumes responsibility for the items it purchases once they leave the point of origin (e.g., a manufacturer’s facility), making it liable for any loss or damage not covered by the carrier’s insurance. An SBE/DVBE distributor may receive 40% credit for drop-shipped items. The amount of SBE or DVBE credit will be made on a contract-by-contract basis. A copy of the bidder's quote, commitment, contract, or purchase order showing the materials the SBE or DVBE regular dealer or distributor is supplying must be attached to this form.
